LOS ANGELES (AP) — U.S. officials said Tuesday that the FBI and its European partners infiltrated and seized control of a major global malware network used for more than 15 years to commit a gamut of online crimes including crippling ransomware attacks.

They then remotely removed the malicious software agent — known as Qakbot — from thousands of infected computers.

Cybersecurity experts said they were impressed by the deft dismantling of the network but cautioned that any setback to cybercrime would likely be temporary.

“Nearly ever sector of the economy has been victimized by Qakbot,” Martin Estrada, the U.S. attorney in Los Angeles, said Tuesday in&nbsp;<a href="https://www.justice.gov/usao-cdca/pr/qakbot-malware-disrupted-international-cyber-takedown">announcing the takedown.</a>&nbsp;He said the criminal network had facilitated about 40 ransomware attacks alone over 18 months that investigators said netted Qakbot administrators about $58 million.

Qakbot's ransomware victims included an Illinois-based engineering firm, financial services organizations in Alabama and Kansas, along with a Maryland defense manufacturer and a Southern California food distribution company, Estrada said.

Officials said $8.6 million in cybercurrency was seized or frozen but no arrests were announced.

Estrada said the investigation is ongoing. He would not say where administrators of the malware, which marshaled infected machines into a botnet of zombie computers, were located. Cybersecurity researchers say they are believed to be in Russia and/or other former Soviet states.

Officials estimated the so-called malware loader, a digital Swiss knife for cybercrooks also known as Pinkslipbot and Qbot, was leveraged to cause hundreds of millions of dollars in damage since first appearing in 2008 as an information-stealing bank trojan. They said millions of people in nearly every country in the world have been affected.

Typically delivered via phishing email infections,&nbsp;<a href="https://attack.mitre.org/versions/v11/software/S0650/">Qakbot gave criminal hackers</a>&nbsp;initial access to violated computers. They could then deploy additional payloads including ransomware, steal sensitive information or gather intelligence on victims to facilitate financial fraud and crimes such as tech support and romance scams.

The Qakbot network was “literally feeding the global cybercrime supply chain,” said Donald Alway, assistant director in charge of the FBI's Los Angeles office, calling it “one of the most devastating cybercriminal tools in history.” The&nbsp;<a href="https://blog.checkpoint.com/security/check-point-shares-analysis-of-qakbot-malware-group/">most commonly detected malware</a>&nbsp;in the first half of 2023, Qakbot impacted one in 10 corporate networks and accounted&nbsp;<a href="https://www.reliaquest.com/blog/the-3-malware-loaders-behind-80-of-incidents/">for about 30% of attacks globally,</a>&nbsp;a pair of cybersecurity firms found. Such “initial access” tools allow extortionist ransomware gangs to skip the initial step of penetrating computer networks, making them major facilitators for the far-flung, mostly Russian-speaking criminals who have wreaked havoc by stealing data and disrupting schools, hospitals, local governments and businesses worldwide.

Beginning Friday in an operation officials dubbed “Duck Hunt,” the FBI along with Europol and law enforcement and justice partners in France, the United Kingdom, Germany, the Netherlands, Romania and Latvia seized more than 50 Qakbot servers and identified more than 700,000 infected computers, more than 200,000 of them in the U.S. — effectively cutting off criminals from their quarry.

The FBI then used the seized Qakbot infrastructure to remotely dispatch updates that deleted the malware from thousands of infected computers. A senior FBI official, briefing reporters on condition he not be further identified, called that number “fluid” and cautioned that other malware may have remained on machines liberated from Qakbot.

It was the FBI's biggest success against cybercrooks since it&nbsp;<a href="https://apnews.com/article/technology-politics-health-crime-us-department-of-justice-ed17a8853d78a9d0185af04cb8bd2fd2">“hacked the hackers”</a>&nbsp;with the January takedown of the prolific Hive ransomware gang.

“It is an impressive takedown. Qakbot was the largest botnet" in number of victims, said Alex Holden, founder of Milwaukee-based Hold Security. But he said it may have been a casualty of its own success in its staggering growth over the past few years. “Large botnets today tend to implode as too many threat actors are mining this data for various types of abuse.”

Cybersecurity expert Chester Wisniewski at Sophos agreed that while there could be a temporary drop in ransomware attacks, the criminals can be expected to either revive infrastructure elsewhere or move to other botnets.

Ricketts discusses reality of electric vehicles for American consumers & industry

WASHINGTON (AP) — The Biden administration is targeting the blood thinner Eliquis, diabetes treatment Jardiance and eight other medications for Medicare's first-ever drug price negotiations as it seeks to lower medical costs for Americans.

The administration on Tuesday released&nbsp;<a href="https://www.documentcloud.org/documents/23930689-medicare-drug-price-negotiation-list">a list of the 10 drugs</a>&nbsp;for which prices will be negotiated directly with the manufacturer. The move is expected to cut costs for many patients, but it faces litigation from the drugmakers and heavy criticism from Republican lawmakers, and it could be years before consumers notice any savings.

The effort is a centerpiece of President Joe Biden's&nbsp;<a href="https://apnews.com/article/joe-biden-election-2024-president-democrats-trump-9c72115656855da89a41cac3f79aa65b">reelection pitch</a>&nbsp;as the Democrat seeks to show Americans he's deserving of a second term because of the work he's doing to lower costs for them while the country is struggling with inflation. But like the drug negotiations, many of Biden's biggest policy moves take time to roll out, and his challenge is to persuade the public to be patient.

“For many Americans, the cost of one drug is the difference between life and death, dignity and dependence, hope and fear,” Biden said in a statement. “That is why we will continue the fight to lower healthcare costs — and we will not stop until we finish the job.”

Biden plans to deliver a speech on&nbsp;<a href="https://apnews.com/article/business-lifestyle-health-care-costs-medicare-prescription-drugs-2fe3928665506b9a2d9c9c38bfd4f0c9">health care costs</a>&nbsp;from the White House later Tuesday. He’ll be joined by Vice President Kamala Harris.

The drugs on the list announced Tuesday accounted for more than $50 billion in Medicare prescription drug costs between June 1, 2022, and May 31, according to the Centers for Medicare and Medicaid Services, or CMS. The diabetes treatments Jardiance from Eli Lilly and Co. and Merck’s Januvia made the list, along with Amgen’s autoimmune disease treatment Enbrel. Other drugs include Entresto from Novartis, which is used to treat heart failure.

Medicare spent about $10 billion in 2020 on Eliquis, according to AARP research. The drug from Pfizer and Bristol-Myers Squibb treats blood clots in the legs and lungs and reduces the risk of stroke in people with an irregular heartbeat called atrial fibrillation.

Senior administration officials said Tuesday that the 10 drugs selected for negotiation are among the most costly to the Medicare program. They said 8.2 million people with Medicare Part D prescription drug coverage take them.

Other drugs on the list include AstraZeneca’s diabetes and heart failure treatment Farxiga and three drugs from Johnson &amp; Johnson: the blood thinner Xarelto, the blood cancer treatment Imbruvica and it’s biggest seller, Stelara, an IV treatment for psoriasis and other inflammatory disorders.

The list also includes several versions of Novo Nordisk’s Fiasp, a fast-acting insulin taken around meals.

The Inflation Reduction Act already caps Medicare patient out-of-pocket costs for insulin at $35 a month. An administration official said Tuesday that upper limit will hold but there could be further changes in those costs.

The announcement is a significant step under the&nbsp;<a href="https://apnews.com/article/biden-climate-health-tax-law-economy-inflation-f112d7c78abaa724d22964317d213deb">Inflation Reduction Act,</a>&nbsp;which was signed by Biden last year. The law requires the federal government for the first time to start negotiating directly with companies about the prices they charge for some of Medicare’s most expensive drugs.

More than 52 million people who either are 65 or older or have certain severe disabilities or illnesses get prescription drug coverage through Medicare’s Part D program, according to CMS.

About 9% of Medicare beneficiaries age 65 and older said in 2021 that they did not fill a prescription or skipped a drug dose due to cost, according to research by the Commonwealth Fund, which studies health care issues.

The agency aims to negotiate the lowest maximum fair price for drugs on the list released Tuesday. That could help some patients who have coverage but still face big bills like high deductible payments when they get a prescription.

Currently, pharmacy benefit managers that run Medicare prescription plans negotiate rebates off a drug's price. Those rebates sometimes help reduce premiums customers pay for coverage. But they may not change what a patient spends at the pharmacy counter.

The new drug price negotiations aim "to basically make drugs more affordable while also still allowing for profits to be made,” said Gretchen Jacobson, who researches Medicare issues at Commonwealth.

Drug companies that refuse to be a part of the new negotiation process will be heavily taxed.

The pharmaceutical industry has been gearing up for months to fight these rules. Already, the plan faces several lawsuits, including complaints filed by drugmakers Merck and Bristol-Myers Squibb and a key lobbying group, the Pharmaceutical Research and Manufacturers of America, or PhRMA.

PhRMA said in a federal court complaint filed earlier this year that the act forces drugmakers to agree to a “government-dictated price” under the threat of a heavy tax and gives too much price-setting authority to the U.S. Department of Health and Human Services.

PhRMA representatives also have said pharmacy benefit managers can still restrict access to drugs with negotiated prices by moving the drugs to a tier of their formulary — a list of covered drugs — that would require higher out-of-pocket payments. Pharmacy benefit managers also could require patients to try other drugs first or seek approval before a prescription can be covered.

Republican lawmakers also have blasted the Biden administration for its plan, saying companies might pull back on introducing new drugs that could be subjected to future haggling. They’ve also questioned whether the government knows enough to suggest prices for drugs.

CMS will start its negotiations on drugs for which it spends the most money. The drugs also must be ones that don't have generic competitors and are approved by the Food and Drug Administration.

CMS plans to meet this fall with drugmakers that have a drug on its list, and government officials say they also plan to hold patient-focused listening sessions. By February 2024, the government will make its first offer on a maximum fair price and then give drugmakers time to respond.

Any negotiated prices won't take hold until 2026. More drugs could be added to the program in the coming years.

All 20 survivors were flown from Melville Island 80 kilometers (50 miles) south to Darwin within hours of the Marine V-22 Osprey crashing at 9:30 a.m. Sunday during a multinational training exercise, Northern Territory Chief Minister Natasha Fyles said.

All were taken to the Royal Darwin Hospital, and 12 had been discharged by Monday, she said.

The first five Marines to arrive at the city’s main hospital were critically injured and one underwent emergency surgery.

Fyles said she would not detail the conditions of eight who remained in the hospital out of respect for them and their families.

“It’s ... a credit to everyone involved that we were able to get 20 patients from an extremely remote location on an island into our tertiary hospital within a matter of hours,” Fyles told reporters.

The Osprey that crashed was one of two that flew from Darwin to Melville on Sunday as part of Exercise Predators Run, which involves the militaries of the United States, Australia, Indonesia, the Philippines and East Timor.

All 23 Marines aboard the lost aircraft were temporarily based in Darwin as part of the Marine Corps’ annual troop rotation.

Around 150 U.S. Marines are currently based in Darwin and up to 2,500 rotate through the city every year. They are part of a realignment of U.S. forces in the Asia-Pacific that is broadly meant to face an increasingly assertive China.

The bodies of the three Marines remained at the crash site, where an exclusion zone would be maintained, Northern Territory Police Commissioner Michael Murphy said.

The cause of the crash had yet to be explained and investigators would remain at the site for at least 10 days, Murphy said.

Emergency responders were surprised the death toll from Sunday's crash was not higher.

“For a chopper that crashes and catches fire, to have 20 Marines that are surviving, I think that’s an incredible outcome,” Murphy said.

Defense Minister Richard Marles was also greateful that the toll was not worse.

“It’s remarkable that in many ways, so many have survived,” Marles told Nine News television. “This remains a very tragic incident and the loss of those lives are keenly felt,” Marles added.

U.S. Defense Secretary Lloyd Austin paid tribute to dead Marines.

“These Marines served our country with courage and pride, and my thoughts and prayers are with their families today, with the other troops who were injured in the crash, and with the entire USMC family,” Austin tweeted.

The U.S. Embassy in Australia issued a statement offering condolences to the families and friends of the dead Marines and thanking Australian responders for their help.

U.S. Marines killed in Australian Osprey crash are identified

DAWSON COUNTY, Neb. —Law enforcement authorities are investigating a suspect after a significant drug bust.

Just after 7:30 a.m. August 24, a trooper observed an eastbound Cadillac CTS speeding near&nbsp;<a href="https://en.wikipedia.org/w/index.php?title=Lexington_Precinct,_Dawson_County,_Nebraska&amp;action=edit&amp;redlink=1">Lexington Precinct</a>&nbsp;on&nbsp;Interstate 80 in Dawson County, according to a media release from Nebraska State Patrol.

During the traffic stop, the trooper detected the odor of marijuana coming from inside the vehicle.

A search of the vehicle revealed more than 100 packages containing a total weight of 133 pounds of marijuana. 

Troopers arrested the driver, Jose Aparicio Mendoza, 28, of Mexico, on requested charges of possession of marijuana – more than one pound, possession with intent to deliver, and no operator’s license. He is being held in Dawson County Jail.

Francis’ comments were an acknowledgment of the divisions in the U.S. Catholic Church, which has been split between progressives and conservatives who long found support in the doctrinaire papacies of St. John Paul II and Benedict XVI, particularly on issues of abortion and same-sex marriage.

Many conservatives have blasted Francis’ emphasis instead on social justice issues such as the environment and the poor, while also branding as heretical his opening to letting divorced and civilly remarried Catholics receive the sacraments.

Francis made the comments in a private meeting with Portuguese members of his Jesuit religious order while visiting Lisbon on Aug. 5; the Jesuit journal La Civilta Cattolica, which is vetted by the Vatican secretariat of state, published a transcript of the encounter Monday.

During the meeting, a Portuguese Jesuit told Francis that he had suffered during a recent sabbatical year in the United States because he came across many Catholics, including some U.S. bishops, who criticized Francis’ 10-year papacy as well as today’s Jesuits.

The 86-year-old Argentine acknowledged his point, saying there was “a very strong, organized, reactionary attitude” in the U.S. church, which he called “backward.” He warned that such an attitude leads to a climate of closure, which was erroneous.

"Doing this, you lose the true tradition and you turn to ideologies to have support. In other words, ideologies replace faith,” he said.

“The vision of the doctrine of the church as a monolith is wrong,” he added. “When you go backward, you make something closed off, disconnected from the roots of the church,” which then has devastating effects on morality.

“I want to remind these people that backwardness is useless, and they must understand that there’s a correct evolution in the understanding of questions of faith and morals,” that allows for doctrine to progress and consolidate over time.

Pope: Backward U.S. conservatives have replaced faith with ideology

PHOENIX (AP) — Speaker Kevin McCarthy suggested Sunday that an&nbsp;<a href="https://apnews.com/article/biden-impeachment-mccarthy-hannity-78e4c7efeb030b29e1576f868257179b">impeachment inquiry of President Joe Biden</a>&nbsp;was becoming more likely, calling it “a natural step forward” as Congress soon ends its summer break and House Republicans seek to expand their investigative powers.

McCarthy, R-Calif., has so far avoided committing to an impeachment vote or offering a timeline for possible action. Some House Republicans are eager to go after Biden over claims of financial misconduct involving his&nbsp;<a href="https://apnews.com/hub/robert-hunter-biden">son Hunter</a>, but the Democratic president&nbsp;<a href="https://apnews.com/article/hunter-biden-irs-justice-department-congress-republicans-32d9f33fb0d05c483d76926504d45bef">has not been shown to have done anything wrong</a>.

Meanwhile, McCarthy said passing a short-term spending bill to keep the government running past the end of September would ensure that investigations of Hunter Biden could continue, a pitch directed at conservatives worried a bipartisan deal with Senate Democrats would not cut enough spending. The stopgap measure would buy time to work out a longer-term budget deal before mandatory spending cuts that neither party prefers are imposed in the new year.

“If you look at all the information we have been able to gather so far, it is a natural step forward that you would have to go to an impeachment inquiry,” McCarthy told Fox News Channel's “Sunday Morning Futures.”

An impeachment inquiry, he said, “provides Congress the apex of legal power to get all the information they need."

McCarthy is walking a tightrope as he faces pressure from members of his party looking to demonstrate support for Donald Trump in the 2024 presidential campaign. But the speaker also risks imperiling the GOP's&nbsp;<a href="https://apnews.com/article/biden-impeachment-mccarthy-hannity-78e4c7efeb030b29e1576f868257179b">fragile House majority</a>.

Even if Biden were to be impeached in the House, he is unlikely to be removed from office by the Senate, which is controlled by Democrats.

With the House set to return to work in mid-September, the Oct. 1 start of the next budget year is fast approaching and a spending deal would be needed to avoid a partial federal closure.

House Speaker: Impeachment inquiry of President Biden is likely

The Defense Department will begin training Ukrainians to fly and maintain F-16 fighter jets, according to Pentagon Press Secretary Air Force Brig. Gen. Pat Ryder.

The training is expected to begin in October at the Morris Air National Guard Base in Tucson, Arizona, and will be facilitated by the Air National Guard's 162nd Wing. &nbsp;

The U.S.-led training is "in support of the international effort to develop and strengthen Ukraine's long-term defenses," Ryder said. &nbsp;

The Netherlands and Denmark have announced their intentions to make F-16 aircraft from their fleets available to Ukraine. &nbsp;

Secretary of State Antony Blinken signaled the United States' willingness to approve the third-party transfer of the U.S.-made F-16s to Ukraine in a letter to his European counterparts last week. &nbsp;

"The training provided by the United States will complement the F-16 pilot and maintenance training that's already underway in Europe and further deepens our support of the F-16 training coalition led by Denmark and the Netherlands," Ryder said. "Moving forward we will remain in close consultation with the Danes, the Dutch and other allies to ensure U.S. training complements the broader coalition training efforts."

Ryder added that by announcing the training, the U.S. is preempting any training capacity constraints in Denmark and the Netherlands' training pipeline to ensure the aircraft are fielded to Ukraine as quickly as possible. &nbsp;

He said Ukraine will ultimately determine the number of pilots that will require the training. &nbsp;

During a briefing last week, National Security Advisor Jake Sullivan said U.S. approval for the transfer would come after consultation with Congress and after completion of training for Ukrainian pilots on the aircraft.&nbsp;

Ryder said the complete training pipeline would likely take several months, depending upon the pilots' proficiency coming into the course. &nbsp;

"Part of this training will be assessing the individual pilots' skill level, which will determine help to determine how long that training will last," he said. "Your basic, new F-16 pilot with not a lot of training on the U.S. side, that training typically lasts about eight months."

That training includes a series of courses ranging from basic flight training to instruction on fighter fundamentals, weapons employment, combat maneuvering and tactical intercepts among other concepts. &nbsp;

He said training for more experienced pilots could be completed in about five months.&nbsp;

Beyond flight training, Ryder said the F-16s require significant logistics and maintenance training for ground support personnel that ensures the aircrafts remain combat capable.

Prior to flight training, the pilots will receive language training at Lackland Air Force Base in San Antonio, Texas beginning in September.&nbsp;

The language training will ensure that all pilots have sufficient language skills to be able to fully comprehend the "complexities and specialized English required to fly the aircraft," Ryder said. &nbsp;

The announcement further underscores the United States' long-term solidarity with Ukraine as it defends itself from Russia's unprovoked war of aggression. &nbsp;

Secretary of Defense Lloyd J. Austin III highlighted that commitment earlier today in a statement marking Ukraine's 32nd anniversary of its independence. &nbsp;

"The Ukrainian people have inspired the world with their courage and resolve to defend their right to live in a sovereign, democratic and free country," he said. &nbsp;

"Today, as Ukraine commemorates another year of independence, the United States remains steadfast in our commitment to ensure that it can celebrate many more," he said. "We will support Ukraine for as long as it takes in its fight for its security and freedom."

U.S. will train Ukrainian F-16 pilots, ground crews

Almost two months after workplace accommodations for pregnant workers became law, the rules surrounding what employers can and cannot do have yet to be finalized — but that doesn’t mean the protections are not in place.

The Equal Employment Opportunity Commission’s proposed regulations are expected to offer more clarity once finalized, but workers can still access their rights under the new Pregnant Workers Fairness Act and employers are still required to understand the law and follow it.

Here’s what you need to know about why workers say the law was needed, what workers’ rights are under the law and employers’ obligations to employees.

Other federal laws cover the rights of pregnant workers but advocates have long argued that many of them are too narrow to address the situations pregnant workers face when they seek accommodations. The Americans with Disabilities Act, for instance, does not consider pregnancy to be a disability but pregnancy-related complications, such as preeclampsia, do qualify. Under the ADA, a pregnant worker can’t seek out an accommodation in the hope of preventing dangerous pregnancy-related complications.

The Pregnancy Discrimination Act, passed in 1978, prohibits discrimination against pregnant employees, but it’s difficult in practice for workers to receive accommodations under the law, because it requires finding another worker who received accommodations like the ones they’re seeking. This can be a challenging and time-consuming process because workers may not be aware of what kinds of accommodations their coworkers are seeking or may not have access to this information in the way their employer does.

Despite those laws,&nbsp;<a target="_blank" href="https://bipartisanpolicy.org/blog/bpc-morning-consult-pregnancy-discrimination/">23%</a>&nbsp;of mothers said in a survey last year that they had weighed whether or not to leave their job because their workplace lacked reasonable accommodations or they were worried about pregnancy discrimination.

The Pregnant Workers Fairness Act, which passed in December, has been in the works for a decade.&nbsp;In the intervening years, states began taking their own action. As of April, 30 states — including Alaska, Colorado, Minnesota, and Tennessee — as well as the District of Columbia, and four localities, had similar laws to the Pregnant Workers Fairness Act, some of which may offer stronger protections in certain situations than the PWFA,&nbsp;<a target="_blank" href="https://www.abetterbalance.org/resources/pregnant-worker-fairness-legislative-successes/">according to</a>&nbsp;A Better Balance, a worker advocacy nonprofit. Twenty states did not have state protections like these at the time of its state analysis, including Alabama, Missouri, Pennsylvania, Wisconsin, and Michigan. The nonprofit has a comprehensive&nbsp;<a target="_blank" href="https://www.abetterbalance.org/resources/pregnant-worker-fairness-legislative-successes/">list</a>&nbsp;of state policies on pregnant workers’ rights.

Congress and federal agencies, employment agencies, labor organizations, private employers with 15 or more workers, and state and local governments with 15 or more workers are subject to the law, according to the EEOC.

While the rules haven’t been finalized, if you think your rights have been violated, you can already take action. On June 27, the EEOC began allowing workers to file charges under the law for violations that occurred on that day or later. Workers need to take this step before they can file a lawsuit against their employer. The law protects employees and job applicants who need accommodations because of pregnancy, childbirth, or conditions related to pregnancy and childbirth. Under the Pregnant Workers Fairness Act, pregnant workers should be able to make requests for reasonable accommodations, such as closer parking, uniforms in their size, and additional rest time.

The Pregnant Workers Fairness Act is similar in many ways to the Americans with Disabilities Act. It does not require an employer to provide an accommodation if doing so would bring it “undue hardship,” or in other words, it would come at great difficulty or expense to the employer.

But the law is also a bit different than the ADA. Unlike the ADA, where the employee has to be able to do the essential functions of their job or they no longer qualify for accommodations, the Pregnant Workers Fairness Act says that workers do not always have to be able to perform an essential function temporarily because of their pregnancy. It is expected that they will be able to resume those duties in the near future.

The EEOC’s proposed rules define the “near future,” or when workers will be able to perform essential functions of their job after being temporarily unable to do so, as generally going up to 40 weeks. This does not mean workers will always have 40 weeks but that needing 40 weeks doesn’t disqualify an employee for the accommodations. The regulations also say that if there are multiple options for effective accommodations, the employer should favor the worker’s preferred accommodation.

Liz Morris, deputy director for the Center for WorkLife Law, said applicants and new employees who want to work remotely because of their pregnancy will also be covered in the Pregnant Workers Fairness Act. Applicants can request accommodations during the hiring process itself, such as making modifications to a physical test. If a pregnant applicant anticipates that they will need adjustments from an employer because of their pregnancy, the applicant can agree to a general policy without accommodations and then request them once they are employed.

The EEOC regulations also get into detail about pregnancy-related medical conditions that apply to workers under the Pregnant Workers Fairness Act, A Better Balance Vice President Elizabeth Gedmark said.

“…&nbsp;The proposed rule discusses pregnancy-related issues ranging from preterm labor to anxiety and depression while also making clear that limitations can also be ‘modest, minor, and/or episodic,’” she told States Newsroom over email.

Lactation, potential pregnancy, miscarriage, infertility and fertility treatments, and having an abortion are also listed in the regulation. An employee who needs to take leave because of a limitation due to a condition related to pregnancy and childbirth should qualify for that leave under the Pregnant Workers Fairness Act, according to the proposed rules. The EEOC gives miscarriage and childbirth as examples of reasons for workers to take different forms of leave. The same definition of “near future” also applies. I

A Better Balance provides&nbsp;<a target="_blank" href="https://www.abetterbalance.org/resources/sample-letters-to-give-to-your-employer-about-the-pregnant-workers-fairness-act/">sample letters</a>&nbsp;for employees to use when requesting work accommodations related to pregnancy.

The rules are going through a public comment period through Oct. 10, and Victor Chen, director of communications at the EEOC, told States Newsroom that employers are not required to follow the proposed rules just yet. But he added that the Pregnant Workers Fairness Act itself provides direction for employers. He suggested employers read the EEOC’s list of&nbsp;<a target="_blank" href="https://www.eeoc.gov/wysk/what-you-should-know-about-pregnant-workers-fairness-act">commonly asked questions</a>&nbsp;and listen to its&nbsp;<a target="_blank" href="https://www.youtube.com/watch?v=ftxYyTlXetE">webinar</a>. He said the EEOC “will move as quickly as possible to finalize the regulation” after the comment period closes.

Morris said that although the regulations aren’t set in stone, “If I were an employer, I would certainly follow them for now, as they are an excellent indication of how the law will ultimately be interpreted.”

The rules specify that employers can’t deny work to an applicant or employee because of their need for an accommodation, make a decision for a pregnant worker without any discussion on which accommodation they will receive or force them to go on leave if there is an accommodation they could take to continue working. They also can’t retaliate against workers for advocating for themselves under the law and reporting discrimination nor can they try to stop workers from enjoying their legal protections.

Michael Fallings, the managing partner of Tully Rinckey PLLC’s Austin office, who specializes in federal employment law, said he thinks it will be useful for employers to have more information on how to fairly treat pregnant workers seeking reasonable accommodations.

“I think it could be helpful for employers because I think some employers are in fear of litigation at times and now that you have a law in place that says what you can or cannot do, it provides some basis for the employers,” he said.

Morris said that employers should keep in mind that they need to swiftly provide accommodations and if they can’t, they should think about interim accommodations. The proposed EEOC regulations explain that an “unnecessary delay” could result in a violation of the law.

The future of the law and its regulations

The law’s regulations may be tweaked during the rulemaking process and could be eventually challenged in the courts. The Alliance Defending Freedom, which has been involved in numerous lawsuits challenging abortion rights,&nbsp; called the proposed regulations&nbsp;<a target="_blank" href="https://adflegal.org/press-release/biden-admin-hijacks-pregnant-workers-law-impose-illegal-abortion-mandate">“federal overreach.”</a>&nbsp;The ADF, a legal advocacy group, has argued that the administration doesn’t have the legal authority to include abortion in its implementation. Morris said that accommodations related to abortion are reasonable to include because the EEOC has always defined pregnancy, childbirth and related medical conditions in the courts as including abortion.

Organizations that supported or opposed the law will also have the opportunity to suggest changes to the regulations. The U.S. Chamber of Commerce advocated for the passage of the law and will provide a public comment on parts of the rule that could be changed, the group told States Newsroom, but declined to elaborate on what should be revised.

Morris said her organization also plans to submit a public comment on the proposed EEOC regulations. She wants to see some revisions on the issue of medical certification to make it even easier for employees to receive accommodations.

“A shocking number of people don’t receive prenatal care because they don’t have access to it either because of financial barriers or because they live in a remote area where it’s difficult to travel to, to receive prenatal care,” she said.

The regulations also say that if there are multiple options for effective accommodations, the employer should favor the worker’s preferred accommodation.Liz Morris, deputy director for the Center for WorkLife Law, said applicants and new employees who want to work remotely because of their pregnancy will also be covered in the Pregnant Workers Fairness Act. Applicants can request accommodations during the hiring process itself, such as making modifications to a physical test. If a pregnant applicant anticipates that they will need adjustments from an employer because of their pregnancy, the applicant can agree to a general policy without accommodations and then request them once they are employed.The EEOC regulations also get into detail about pregnancy-related medical conditions that apply to workers under the Pregnant Workers Fairness Act, A Better Balance Vice President Elizabeth Gedmark said.“…&nbsp;The proposed rule discusses pregnancy-related issues ranging from preterm labor to anxiety and depression while also making clear that limitations can also be ‘modest, minor, and/or episodic,’” she told States Newsroom over email.Lactation, potential pregnancy, miscarriage, infertility and fertility treatments, and having an abortion are also listed in the regulation. An employee who needs to take leave because of a limitation due to a condition related to pregnancy and childbirth should qualify for that leave under the Pregnant Workers Fairness Act, according to the proposed rules. The EEOC gives miscarriage and childbirth as examples of reasons for workers to take different forms of leave. The same definition of “near future” also applies. IA Better Balance provides&nbsp;<a target="_blank" href="https://www.abetterbalance.org/resources/sample-letters-to-give-to-your-employer-about-the-pregnant-workers-fairness-act/">sample letters</a>&nbsp;for employees to use when requesting work accommodations related to pregnancy.<h2>What employers need to know</h2>The rules are going through a public comment period through Oct. 10, and Victor Chen, director of communications at the EEOC, told States Newsroom that employers are not required to follow the proposed rules just yet. But he added that the Pregnant Workers Fairness Act itself provides direction for employers. He suggested employers read the EEOC’s list of&nbsp;<a target="_blank" href="https://www.eeoc.gov/wysk/what-you-should-know-about-pregnant-workers-fairness-act">commonly asked questions</a>&nbsp;and listen to its&nbsp;<a target="_blank" href="https://www.youtube.com/watch?v=ftxYyTlXetE">webinar</a>. He said the EEOC “will move as quickly as possible to finalize the regulation” after the comment period closes.Morris said that although the regulations aren’t set in stone, “If I were an employer, I would certainly follow them for now, as they are an excellent indication of how the law will ultimately be interpreted.”The rules specify that employers can’t deny work to an applicant or employee because of their need for an accommodation, make a decision for a pregnant worker without any discussion on which accommodation they will receive or force them to go on leave if there is an accommodation they could take to continue working. They also can’t retaliate against workers for advocating for themselves under the law and reporting discrimination nor can they try to stop workers from enjoying their legal protections.Michael Fallings, the managing partner of Tully Rinckey PLLC’s Austin office, who specializes in federal employment law, said he thinks it will be useful for employers to have more information on how to fairly treat pregnant workers seeking reasonable accommodations.“I think it could be helpful for employers because I think some employers are in fear of litigation at times and now that you have a law in place that says what you can or cannot do, it provides some basis for the employers,” he said.Morris said that employers should keep in mind that they need to swiftly provide accommodations and if they can’t, they should think about interim accommodations. The proposed EEOC regulations explain that an “unnecessary delay” could result in a violation of the law.<h2>The future of the law and its regulations</h2>The law’s regulations may be tweaked during the rulemaking process and could be eventually challenged in the courts. The Alliance Defending Freedom, which has been involved in numerous lawsuits challenging abortion rights,&nbsp; called the proposed regulations&nbsp;<a target="_blank" href="https://adflegal.org/press-release/biden-admin-hijacks-pregnant-workers-law-impose-illegal-abortion-mandate">“federal overreach.”</a>&nbsp;The ADF, a legal advocacy group, has argued that the administration doesn’t have the legal authority to include abortion in its implementation. Morris said that accommodations related to abortion are reasonable to include because the EEOC has always defined pregnancy, childbirth and related medical conditions in the courts as including abortion.Organizations that supported or opposed the law will also have the opportunity to suggest changes to the regulations. The U.S. Chamber of Commerce advocated for the passage of the law and will provide a public comment on parts of the rule that could be changed, the group told States Newsroom, but declined to elaborate on what should be revised.Morris said her organization also plans to submit a public comment on the proposed EEOC regulations. She wants to see some revisions on the issue of medical certification to make it even easier for employees to receive accommodations.“A shocking number of people don’t receive prenatal care because they don’t have access to it either because of financial barriers or because they live in a remote area where it’s difficult to travel to, to receive prenatal care,” she said.

“We have made progress, over the last 60 years, since Dr. King led the March on Washington," said Alphonso David, president and CEO of the Global Black Economic Forum. “Have we reached the mountaintop? Not by a long shot."

The event was convened by the Kings’ Drum Major Institute and the Rev.&nbsp;<a href="https://apnews.com/hub/al-sharpton">Al Sharpton</a>&nbsp;'s National Action Network. A host of Black civil rights leaders and a multiracial, interfaith coalition of allies rallied attendees on the same spot where as many as 250,000 gathered in 1963 for what is still considered one of the greatest and most consequential racial justice and equality demonstrations in U.S. history.

Inevitably, Saturday's event was shot through with contrasts to the initial, historic demonstration. Speakers and banners talked about the importance of LGBTQ and Asian American rights. Many who addressed the crowd were women after only one was given the microphone in 1963.

Pamela Mays McDonald of Philadelphia attended the initial march as a child. “I was 8 years old at the original March and only one woman was allowed to speak — she was from Arkansas where I’m from — now look at how many women are on the podium today,” she said.

For some, the contrasts between the size of the original demonstration and the more modest turnout Saturday were bittersweet. “I often look back and look over to the reflection pool and the Washington Monument and I see a quarter of a million people 60 years ago and just a trickling now," said Marsha Dean Phelts of Amelia Island, Florida. “It was more fired up then. But the things we were asking for and needing, we still need them today.”

As speakers delivered messages, they were overshadowed by the sounds of passenger planes taking off from Ronald Reagan National Airport. Rugby games were underway along the Mall in close proximity to the Lincoln Memorial while joggers and bikers went about their routines.

Yolanda King, the 15-year-old granddaughter of the Rev. Martin Luther King, Jr., roused marchers with remarks delivered from the same spot her grandfather gave the “I Have A Dream” speech sixty years ago.

“If I could speak to my grandfather today, I would say I’m sorry we still have to be here to rededicate ourselves to finishing your work and ultimately realizing your dream,” she said. “Today, racism is still with us. Poverty is still with us. And now, gun violence has come for places of worship, our schools and our shopping centers.”

From the podium, Sharpton promised more demonstrations to push back against injustices, new and old.

“Sixty years ago Martin Luther King talked about a dream. Sixty years later we’re the dreamers. The problem is we’re facing the schemers,” Sharpton said. “The dreamers are fighting for voting rights. The schemers are changing voter regulations in states. The dreamers are standing up for women’s right to choose. The schemers are arguing whether they are going to make you stop at six weeks or 15 weeks."

After the speeches, the crowd marched to the Martin Luther King Jr. Memorial.

Several leaders from groups organizing the march met Friday with Attorney General&nbsp;<a href="https://apnews.com/hub/merrick-garland">Merrick Garland</a>&nbsp;and Assistant Attorney General Kristen Clarke of the civil rights division, to discuss a range of issues, including voting rights, policing and redlining.

Now she's so disillusioned she's stopped singing “We Shall Overcome,” the anthem of the civil rights movement.But even at age 92, she returned to Washington for the 60th anniversary, bringing three generations of her family, all the way down to her 18-month-old grandchild. “I think that’s why we all are here because we do expect the world to get better," Manns-Baugh said.
