WASHINGTON — The Internal Revenue Service is reminding farmers and 
ranchers in applicable regions forced to sell livestock because of 
drought conditions that they may have more time to replace their 
livestock and defer tax on any gains from the forced sales.

Today, the IRS posted <a href="https://www.irs.gov/pub/irs-drop/n-22-43.pdf">Notice 2022-43</a>PDF
 listing the applicable regions, a county or other jurisdiction, 
designated as eligible for federal assistance on IRS.gov. This includes 
44 states, two U.S. Territories and two independent nations in a Compact
 of Free Association with the United States. The relief generally 
applies to capital gains realized by eligible farmers and ranchers on 
sales of livestock held for draft, dairy or breeding purposes. Sales of 
other livestock, such as those raised for slaughter or held for sporting
 purposes, or poultry, are not eligible.

The sales must be solely due to drought, causing an area to be 
designated as eligible for federal assistance. Livestock generally must 
be replaced within a four-year period, instead of the usual two-year 
period. The IRS is authorized to further extend this replacement period 
if the drought continues.

The one-year extension, announced in the notice, gives eligible 
farmers and ranchers until the end of their first tax year after the 
first drought-free year to replace the sold livestock. Details, 
including an example of how this provision works, can be found in <a href="https://www.irs.gov/irb/2006-39_IRB#NOT-2006-82">Notice 2006-82</a>.

The IRS provides this extension to eligible farmers and ranchers that
 qualified for the four-year replacement period, if the applicable 
region is listed as suffering exceptional, extreme or severe drought 
conditions during any week between September 1, 2021, and August 31, 
2022. This determination is made by the <a href="https://drought.unl.edu/">National Drought Mitigation Center</a>.

As a result, eligible farmers and ranchers whose drought-sale 
replacement period was scheduled to expire on December 31, 2022, in most
 cases now have until the end of their next tax year to replace the sold
 livestock. Because the normal drought-sale replacement period is four 
years, this extension impacts drought sales that occurred during 2018. 
The replacement periods for some drought sales before 2018 are also 
affected due to previous drought-related extensions affecting some of 
these localities.

IRS continues relief to drought-stricken farmers, ranchers

GREELEY, Colo. (AP) — A 20-year-old woman who was seriously injured when the parked police patrol vehicle she was detained in was struck by a freight train in northern Colorado has been released from the hospital.

Yareni Rios-Gonzalez, of Greeley, is recovering at home with nine broken ribs, a broken arm, a fractured sternum and numerous other injuries to her head and back, her attorney, Paul Wilkinson, told KUSA-TV.

“She is bedridden. She can move around a little bit. She also has a fractured leg that she wasn’t initially aware of,” he said. “She’s still really, really hurt.”

Multiple law enforcement agencies responded to a report of a road rage incident involving a firearm in Fort Lupton on Sept. 16. A Platteville police officer stopped Rios-Gonzalez’s car just past a set of railroad tracks and parked the patrol vehicle on the crossing.

She was placed in the back of the police vehicle, which was hit by the train as officers were searching her car.

Police bodycam and dashcam video shows officers scrambling as the train approaches and slams into the patrol vehicle, which is parked squarely on the tracks.

One officer says, “oh my God," multiple times and another yells, "stay back,” as the train's horn blares before the crash.

Bodycam footage shows officers running toward the mangled and crushed patrol vehicle through what appears to be a debris field left by the impact.

The Fort Lupton Police Department is investigating the road rage report, while the Colorado State Patrol is investigating the crash. The Colorado Bureau of Investigation is looking into the woman’s injury while she was in police custody.

No one has been charged in the alleged road rage incident or the crash.

Woman hit by train while in police car is out of hospital

WASHINGTON (AP) —A libertarian group in California filed a legal challenge to President Joe Biden’s plan for&nbsp;<a href="https://apnews.com/article/student-loan-forgiveness-biden-plan-d9c8e18774a744187c9af634bf4eb728">student debt cancellation</a>&nbsp;on Tuesday, calling it an illegal overreach that would increase state tax burdens for some Americans who get their debt forgiven.

The lawsuit, believed to be the first targeting Biden’s plan, was filed by the Pacific Legal Foundation, a Sacramento legal advocacy group. It was filed in federal court in Indiana, one of several states that&nbsp;<a href="https://apnews.com/article/biden-education-minnesota-mississippi-ffe9ed18bf0a434970ab09b1d89800e2">plan to tax</a>&nbsp;any student debt canceled by Biden’s plan.

“Congress did not authorize the executive branch to unilaterally cancel student debt,” said Caleb Kruckenberg, an attorney at the Pacific Legal Foundation. He said it’s illegal for the executive branch to create the policy “by press release, and without statutory authority.”

The suit’s plaintiff is Frank Garrison, described as a public interest attorney who lives in Indiana and is employed by the libertarian group.

Garrison is on track to get his student debt erased through a separate federal program for public servants. Although most borrowers will need to apply for Biden’s plan, Garrison and many others in that program will automatically get the relief because the Education Department has their income information on file.

Biden’s plan would automatically cancel up to $20,000 of Garrison’s debt, which in turn would trigger an “immediate tax liability” from the state of Indiana, according to the suit. Under the debt forgiveness program he’s enrolled in now, canceled debt cannot be taxed.

“Mr. Garrison and millions of others similarly situated in the six relevant states will receive no additional benefit from the cancellation — just a one-time additional penalty,” the suit argues.

Any student debt forgiven under Biden’s plan would also be subject to state taxes in Arkansas, California, Minnesota, Mississippi, North Carolina and Wisconsin, unless lawmakers in those states change their current laws.

Asked about the suit, White House press secretary Karine Jean-Pierre said anyone will be able to opt out of the cancellation. She did not explain how that would work — the White House previously said roughly 8 million Americans would automatically get the debt relief without applying.

“The bottom line is this — no one who does not want debt relief will have to get that debt relief," Jean-Pierre said at a press briefing.

A separate statement from the White House called the lawsuit “baseless,” saying opponents “are trying anything they can to stop this program that will provide needed relief to working families.”

The Pacific Legal Foundation is a legal group that promotes individual liberties and the separation of powers. It was formed in the 1970s by staff members under Ronald Reagan when he was governor of California. The group says it has argued before the U.S. Supreme Court 16 times, prevailing in 14 cases.

Biden’s plan promises to cancel $10,000 in federal student debt for borrowers with incomes of less than $125,000 per year or households making less than $250,000. Those who received federal Pell Grants to attend college would get an additional $10,000 erased.

An application to receive the benefit is expected by early October.

Conservative groups have been threatening to challenge debt cancellation since Biden first aired the idea, saying it’s legally questionable and unfairly cancels student debt at the expense of Americans who didn’t attend college. One of the main challenges has been finding someone who faces personal harm as a result of Biden’s plan, giving them legal standing to sue.

The Biden administration has repeatedly argued that the plan is on solid legal ground.

In its&nbsp;<a href="https://apnews.com/article/biden-covid-health-education-0fea030a0875c0e4e1a39b0c098bd48a">legal justification</a>&nbsp;for debt cancellation, the Biden administration invoked the HEROES Act of 2003, which aimed to provide help to members of the military. The law gives the administration “sweeping authority” to reduce or eliminate student debt during a national emergency, the Justice Department said in an August legal opinion.

Education Secretary Miguel Cardona has said he has the legal authority to cancel debt for people who faced hardship during the pandemic. Cardona says Biden’s plan will ensure borrowers aren’t worse off after the pandemic than they were before.

The suit challenges that rationale, saying Garrison and others will see their debt burdens increase as a result of Biden’s plan. It also contends that the plan doesn’t meet the requirements of the 2003 law, arguing that the problem of high student debt is not a “direct result” of the pandemic.

“Nothing about loan cancellation is lawful or appropriate,” the suit alleges. “In an end-run around Congress, the administration threatens to enact a profound and transformational policy that will have untold economic impacts.”

The legality of mass student debt cancellation has stirred debate since it became a popular idea among Democrats in recent years. After being elected, Biden himself questioned whether he had the authority to cancel debt without Congress, asking the Justice Department to study the question.

The Trump administration took steps to block broad debt cancellation during its final weeks in office, issuing an Education Department memo concluding that the secretary lacked the authority to provide such relief.

The lawsuit asks the court to overturn Biden’s plan and to temporarily halt it while legal questions are resolved.

Acting United States Attorney Steven Russell announced that Tina Smith, 35, of Denver, Colorado, was sentenced on September 26, 2022, in federal court in Lincoln, Nebraska, for conspiracy to distribute and possess with intent to distribute 50 grams or more of methamphetamine.&nbsp; United States District Judge John M. Gerrard sentenced Smith to 57 months’ imprisonment. There is no parole in the federal system.&nbsp; After her release from prison, she will begin a three-year term of supervised release.

Beginning in February 2019, and continuing through May 2019, law enforcement utilized a confidential informant to purchase methamphetamine from Smith and her co-defendant, Taylor Brown, in McCook, Nebraska. Smith was found responsible for at least 30 grams of actual methamphetamine.

Brown is scheduled to enter a plea of guilty on October 13, 2022.

This case was investigated by the Federal Bureau of Investigation and the McCook Police Department.

Public hearings set for Nebraska ballot initiatives

WASHINGTON (AP) — President Joe Biden announced a new initiative Monday that would eventually allow consumers to see a more complete price on airline tickets — including baggage and change fees — before they buy, as the White House continues to search for ways to lower costs for Americans amid persistently&nbsp;<a href="https://apnews.com/article/inflation-economy-prices-f2270f4c6ac55c084108d57cc1aec53a">high inflation</a>.

The White House says&nbsp;<a href="https://www.transportation.gov/airconsumer/AirlineAncillaryFeeNPRM" target="_blank">the proposed rule</a>&nbsp;from the Transportation Department will prevent airlines from hiding the “true cost” of airline tickets, which would help consumers save money up front and encourage more competition among airlines to offer better fares. The requirement will apply not only to airlines directly but also to third-party search sites such as Kayak and Expedia.

“You should know the full cost of your ticket right when you’re comparison shopping,” Biden said Monday, citing fees charged by airlines to check luggage or to seat families together. The new rule, the president said, will help consumers “pick the ticket that actually is the best deal for you.”

Airlines made nearly $5.3 billion in baggage fees and nearly $700 million on&nbsp;<a href="https://apnews.com/article/covid-health-travel-transportation-pete-buttigieg-ef15613d7b2eeedf72b4494a6d3a0255">cancellation</a>&nbsp;and change fees last year, according to Transportation Department figures. Airlines charge a variety of other fees for extra legroom and other perks that are not tracked by the government.

A trade group for the largest U.S. airlines said carriers already disclose terms and the total cost of a ticket. “This includes transparency regarding taxes and government fees on airline tickets, which account for more than 20% of many domestic one-stop, roundtrip tickets,” said Katherine Estep, a spokeswoman for Airlines for America.

The proposed rule seeks to target a typical situation faced by consumers where a ticket price is listed on an airline or search website, but with information often listed elsewhere about any additional airline fees, such as for checking or carrying on a bag, getting a guaranteed seat next to your child or changing or canceling a flight — fees that vary widely by airline and could quickly tack on up to hundreds of dollars more to a price of a ticket after the initial purchase. Under the proposal, that information would be made available upfront when the quoted airfare is first displayed.

They were quick to cite the estimates as evidence that the plan will “bury” taxpayers, passing along the costs to huge numbers of Americans who never went to college.

The Biden administration previously estimated the plan would cost about $24 billion a year over the next 10 years — about $240 billion for the decade — while other estimates put the total cost at $500 billion or more over the decade.

On Monday, the White House noted that the CBO’s estimated cost in the first year — $21 billion — is actually lower than the administration’s early estimate of $24 billion.

To reach the CBO’s $400 billion figure, officials looked at the immediate cost of cancellation along with the longer-term impact, including lower monthly repayments that would have been higher if not for the cancellation.

The office separately estimated that Biden’s latest extension of a&nbsp;<a href="https://apnews.com/article/student-loan-payment-moratorium-extended-d54907ea99a6745dc9f832435beda751">student loan pause</a>&nbsp;will cost an additional $20 billion. Monthly payments on federal student loans have been frozen since the first weeks of the pandemic. Biden in August continued the pause through the end of the year, calling that the final extension.

Biden has played down the cost of the cancellation plan, saying it would be offset by other measures to reduce the federal deficit, including his landmark&nbsp;<a href="https://apnews.com/article/inflation-biden-health-congress-climate-and-environment-63df07e15002c01fb560a6f0e69fcb03">Inflation Reduction Act</a>. Senate Majority Leader Chuck Schumer, D-N.Y., and Sen. Elizabeth Warren, D-Mass., who supported debt cancellation, said they don’t agree with some of the assumptions underpinning the CBO estimates. But a joint statement from the senators said the estimates show that “millions of middle class Americans have more breathing room” thanks to Biden’s plan.

“Rather than working with Congress to bring down college costs, President Biden has opted to bury the American people under our unsustainable debt,” said Rep. Virginia Foxx, the top Republican on the House education committee.

An application to receive the benefit is expected by early October. The fate of the plan largely depends on whether it can survive legal challenges that conservatives have promised to bring.

The Congressional Budget Office estimates that, out of 37 million Americans who have federal student loans, about 95% meet the income limit for $10,000 in relief. About 65% also received a Pell Grant, making them eligible for a $20,000 cancellation.

The office warned that its estimates are “highly uncertain” because it’s hard to know exactly how much borrowers would have paid in the future without Biden’s action. Some borrowers probably would have gotten their debt canceled anyway using payment plans that promise to cancel remaining debt after 10 or 20 years.

The estimates are based on everything that’s known about Biden’s plan now, but some details have yet to be hashed out. The office said it may revise its estimates as details emerge.

The $400 billion total notably does not include a separate loan payment plan that Biden proposed to help lower-income borrowers in the future. The new plan would be similar to existing plans that limit monthly bills based on a borrower’s income, but with more generous terms.

It would limit borrowers’ payments to 5% of their discretionary income, down from 10% now, and it would forgive any remaining balance after 10 years, down from 20 years now.

GOP: $400B estimated cost of student debt plan will bury taxpayers

ANCHORAGE, Alaska (AP) — A U.S. Coast Guard ship on routine patrol in the Bering Sea came across a guided missile cruiser from China, officials said Monday.

But it turned out the cruiser wasn’t alone as it sailed about 86 miles north of Alaska’s Kiska Island, on Sept. 19.

The patrol boat, known as a cutter called Kimball, later discovered there were two other Chinese naval ships and four Russian naval vessels, including a destroyer, all in single formation.

The Honolulu-based Kimball, a 418-foot (127-meter) vessel, observed as the ships broke formation and dispersed. A C-130 Hercules provided air support for the Kimball from the Coast Guard station in Kodiak.

“While the formation has operated in accordance with international rules and norms, we will meet presence with presence to ensure there are no disruptions to U.S. interests in the maritime environment around Alaska,” Rear Adm. Nathan Moore, Seventeenth Coast Guard District commander said.

The Coast Guard said Operation Frontier Sentinel guidelines call for meeting “presence with presence” when strategic competitors operate in and around U.S. waters.

The Kimball will continue to monitor the area.

The Coast Guard did not immediately respond to questions about the incident from The Associated Press.

The Chinese and Russian formation came a month after NATO Secretary General Jens Stoltenberg warned about China’s interest in the Arctic and Russia’s military buildup there.

Stoltenberg said Russia has set up a new Arctic Command and has opened hundreds of new and former Soviet-era Arctic military sites, including deep-water ports and airfields.

China has declared itself a “near Arctic” state and plans to build the world’s largest icebreaker, he said.

“Beijing and Moscow have also pledged to intensify practical cooperation in the Arctic. This forms part of a deepening strategic partnership that challenges our values and interests,” Stoltenberg said in a visit to Canada’s north.

This wasn’t the first time Chinese naval ships have sailed near Alaska waters. In September 2021, Coast Guard cutters in the Bering Sea and North Pacific Ocean encountered Chinese ships, some about 50 miles (80 kilometers) off the Aleutian Islands.

Coast Guard spots Chinese, Russian naval ships off Alaska 

CAPE CANAVERAL, Fla. (AP) — A NASA spacecraft rammed an asteroid at blistering speed Monday in an unprecedented dress rehearsal for the day a killer rock menaces Earth.

The galactic grand slam occurred at a harmless asteroid 7 million miles (9.6 million kilometers) away, with the spacecraft named Dart plowing into the small space rock at 14,000 mph (22,500 kph). Scientists expected the impact to carve out a crater, hurl streams of rocks and dirt into space and, most importantly, alter the asteroid’s orbit.

Telescopes around the world and in space aimed at the same point in the sky to capture the spectacle. Though the impact was immediately obvious — Dart’s radio signal abruptly ceased — it will be days or even weeks to determine how much the asteroid’s path was changed.

<a href="https://apnews.com/article/astronomy-space-exploration-science-asteroids-ee5f1594906d9666d0bee18209666102">The $325 million mission</a>&nbsp;was the first attempt to shift the position of an asteroid or any other natural object in space.

“No, this is not a movie plot,” NASA Administrator Bill Nelson tweeted earlier in the day. ”We’ve all seen it on movies like ‘Armageddon,’ but the real-life stakes are high,” he said in a prerecorded video.

Monday’s target: a 525-foot (160-meter) asteroid named Dimorphos. It’s actually a moonlet of Didymos, Greek for twin, a fast-spinning asteroid five times bigger that flung off the material that formed the junior partner.

The pair have been orbiting the sun for eons without threatening Earth, making them ideal save-the-world test candidates.

<a href="https://apnews.com/article/nasa-dart-spacecraft-asteroid-1f351c9ce5890c275f1f9b2c884a0278">Launched last November</a>, the vending machine-size Dart — short for Double Asteroid Redirection Test — navigated to its target using new technology developed by Johns Hopkins University’s Applied Physics Laboratory, the spacecraft builder and mission manager.

Dart’s on-board camera, a key part of this smart navigation system, caught sight of Dimorphos barely an hour before impact.

“Woo hoo,” exclaimed Johns Hopkins mission systems engineer Elena Adams. "We’re seeing Dimorphos, so wonderful, wonderful.”

With an image beaming back to Earth every second, Adams and other ground controllers in Laurel, Maryland, watched with growing excitement as Dimorphos loomed larger and larger in the field of view alongside its bigger companion.

A mini satellite followed a few minutes behind to take photos of the impact. The Italian Cubesat was released from Dart two weeks ago.

Scientists insisted Dart would not shatter Dimorphos. The spacecraft packed a scant 1,260 pounds (570 kilograms), compared with the asteroid’s 11 billion pounds (5 billion kilograms). But that should be plenty to shrink its 11-hour, 55-minute orbit around Didymos.

The impact should pare 10 minutes off that, but telescopes will need anywhere from a few days to nearly a month to verify the new orbit. The anticipated orbital shift of 1% might not sound like much, scientists noted. But they stressed it would amount to a significant change over years.

Planetary defense experts prefer nudging a threatening asteroid or comet out of the way, given enough lead time, rather than blowing it up and creating multiple pieces that could rain down on Earth. Multiple impactors might be needed for big space rocks or a combination of impactors and so-called gravity tractors, not-yet-invented devices that would use their own gravity to pull an asteroid into a safer orbit.

“The dinosaurs didn’t have a space program to help them know what was coming, but we do,” NASA’s senior climate adviser Katherine Calvin said, referring to the mass extinction 66 million years ago believed to have been caused by a major asteroid impact, volcanic eruptions or both.

The non-profit B612 Foundation, dedicated to protecting Earth from asteroid strikes, has been pushing for impact tests like Dart since its founding by astronauts and physicists 20 years ago. Monday’s feat aside, the world must do a better job of identifying the countless space rocks lurking out there, warned the foundation’s executive director, Ed Lu, a former astronaut.

Significantly less than half of the estimated 25,000 near-Earth objects in the deadly 460-foot (140-meter) range have been discovered, according to NASA. And fewer than 1% of the millions of smaller asteroids, capable of widespread injuries, are known.

The Vera Rubin Observatory, nearing completion in Chile by the National Science Foundation and U.S. Energy Department, promises to revolutionize the field of asteroid discovery, Lu noted.

Finding and tracking asteroids, “That’s still the name of the game here. That’s the thing that has to happen in order to protect the Earth,” he said.

The impact should be just enough to nudge the asteroid into a slightly tighter orbit around its companion space rock — demonstrating that if a killer asteroid ever heads our way, we’d stand a fighting chance of diverting it.

“This is stuff of science-fiction books and really corny episodes of “StarTrek” from when I was a kid, and now it's real,” NASA program scientist Tom Statler said Thursday.

Cameras and telescopes will watch the crash, but it will take days or even weeks to find out if it actually changed the orbit.

The $325 million planetary defense test began with&nbsp;<a href="https://apnews.com/article/nasa-dart-spacecraft-asteroid-1f351c9ce5890c275f1f9b2c884a0278">Dart’s launch last fall</a>.

The asteroid with the bull’s-eye on it is Dimorphos, about 7 million miles (9.6 million kilometers) from Earth. “This really is about asteroid deflection, not disruption," said Nancy Chabot, a planetary scientist and mission team leader at Johns Hopkins University's Applied Physics Laboratory, which is managing the effort. "This isn’t going to blow up the asteroid. It isn’t going to put it into lots of pieces.” Rather, the impact will dig out a crater tens of yards (meters) in size and hurl some 2 million pounds (1 million kilograms) of rocks and dirt into space.

NASA insists there’s a zero chance either asteroid will threaten Earth — now or in the future. That’s why the pair was picked.

The Johns Hopkins lab took a minimalist approach in developing Dart — short for Double Asteroid Redirection Test — given that it’s essentially a battering ram and faces sure destruction. It has a single instrument: a camera used for navigating, targeting and chronicling the final action. Believed to be essentially a rubble pile, Dimorphos will emerge as a point of light an hour before impact, looming larger and larger in the camera images beamed back to Earth. Managers are confident Dart won’t smash into the larger Didymos by mistake. The spacecraft’s navigation is designed to distinguish between the two asteroids and, in the final 50 minutes, target the smaller one.

The size of a small vending machine at 1,260 pounds (570 kilograms), the spacecraft will slam into roughly 11 billion pounds (5 billion kilograms) of asteroid. “Sometimes we describe it as running a golf cart into a Great Pyramid,” said Chabot.

Unless Dart misses — NASA puts the odds of that happening at less than 10% — it will be the end of the road for Dart. If it goes screaming past both space rocks, it will encounter them again in a couple years for Take 2.

Little Dimorphos completes a lap around big Didymos every 11 hours and 55 minutes. The impact by Dart should shave about 10 minutes off that. Although the strike itself should be immediately apparent, it could take a few weeks or more to verify the moonlet’s tweaked orbit. Cameras on Dart and a mini tagalong satellite will capture the collision up close. Telescopes on all seven continents, along with the Hubble and Webb space telescopes and NASA’s asteroid-hunting Lucy spacecraft, may see a bright flash as Dart smacks Dimorphos and sends streams of rock and dirt cascading into space. The observatories will track the pair of asteroids as they circle the sun, to see if Dart altered Dimorphos’ orbit. In 2024, a European spacecraft named Hera will retrace Dart’s journey to measure the impact results.

Although the intended nudge should change the moonlet’s position only slightly, that will add up to a major shift over time, according to Chabot. "So if you were going to do this for planetary defense, you would do it five, 10, 15, 20 years in advance in order for this technique to work,” she said. Even if Dart misses, the experiment still will provide valuable insight, said NASA program executive Andrea Riley. “This is why we test. We want to do it now rather than when there’s an actual need,” she said.

Planet Earth is on an asteroid-chasing roll. In the next few years, NASA also plans to launch a census-taking telescope to identify hard-to-find asteroids that could pose risks. Hollywood has churned out dozens of killer-space-rock movies over the decades, including 1998′s “Armageddon” which brought Bruce Willis to Cape Canaveral for filming, and last year's “Don’t Look Up” with Leonardo DiCaprio leading an all-star cast. 🎥 Defend Earth: NASA spacecraft crashes into asteroid in test

WASHINGTON (AP) — Members of Congress have officially objected to the results in four of the last six presidential elections, a partisan practice that has been legal for over a century but became much more fraught after&nbsp;<a href="https://apnews.com/article/congress-confirm-joe-biden-78104aea082995bbd7412a6e6cd13818">a violent mob</a>&nbsp;of then-President Donald Trump’s supporters&nbsp;<a href="https://apnews.com/hub/capitol-siege">attacked the U.S. Capitol</a>&nbsp;last year.

In an effort to prevent another Jan. 6, 2021,&nbsp;<a href="https://apnews.com/article/2022-midterm-elections-presidential-constitutions-congress-ba742c9f4c67c5189a6a6c9f8531721e">bills moving through the House and the Senate</a>&nbsp;would make it harder to lodge those objections when Congress counts the electoral votes in a joint session after every presidential election. The move to curtail the objections is part of a larger effort to overhaul the 1800s-era Electoral Count Act and safeguard the integrity of the vote after&nbsp;<a href="https://apnews.com/hub/donald-trump">Trump</a>&nbsp;tried to persuade his Republican allies in Congress to vote against&nbsp;<a href="https://apnews.com/article/joe-biden-wins-white-house-ap-fd58df73aa677acb74fce2a69adb71f9">Democrat Joe Biden’s victory</a>&nbsp;and overturn his 2020 defeat.

Under current law, only one member of the House and one member of the Senate has to challenge a state’s results to trigger votes on that state’s electors in each chamber. If a simple majority in each chamber votes to sustain the objection, that state’s votes can be thrown out.

The House and Senate bills would each raise that threshold substantially, with the House bill requiring a third of each chamber to object and the Senate bill requiring a fifth of each chamber to object. The House legislation,&nbsp;<a href="https://apnews.com/article/2022-midterm-elections-donald-trump-presidential-constitutions-election-2020-32c6ea94829f95d11f7696d2cba542b6">passed last week</a>, would also lay out new requirements for the grounds for an objection.

“It is just too easy to trigger an objection when it only requires one person in each chamber,” says Maine Sen. Susan Collins, a Republican co-sponsor of the Senate version. Eleven GOP senators have signed on to the legislation, which is up for a vote in a Senate committee on Tuesday.

If the bills are consolidated into one measure that becomes law, it will do away with a tradition that has become increasingly popular as Congress has become more polarized.

Democrats have objected the last three times that Republicans were elected — twice against George W. Bush and once against Trump — but in each of those cases the Democratic candidate had already conceded the election.

The stakes were raised considerably in 2021, when Trump and his allies were actively trying to thwart Biden’s win, with a strategy to throw out Biden electors in Congress and the support of a violent mob that broke into the Capitol, interrupted the joint session and threatened the lives of lawmakers and&nbsp;<a href="https://apnews.com/article/mike-pence-electoral-vote-d27490021b4203087043df1939b82f8b">Vice President Mike Pence</a>.

House Administration Chairwoman Zoe Lofgren of California, the Democratic sponsor of the House bill with Republican Rep. Liz Cheney of Wyoming, said the bill would protect the voters’ will from “frivolous” objections and more sinister efforts.

“If you want to object to the vote, you better have your colleagues and the Constitution on your side,” Lofgren said just before the bill passed. “Don’t try to overturn our democracy.”

At the 2021 joint session, two GOP senators —&nbsp;<a href="https://apnews.com/article/capitol-siege-2022-midterm-elections-biden-presidential-texas-b87d4001f2d03df10fa050af5b0b1239">Ted Cruz of Texas and Josh Hawley of Missouri</a>&nbsp;— joined a larger group of House Republicans in objecting to Biden’s electoral votes in Arizona and Pennsylvania, two swing states that Trump had won in the 2016 election but lost in 2020. Both the House and the Senate voted to certify Biden’s win in those states in the hours after the rioters had&nbsp;<a href="https://apnews.com/article/docs-expose-depth-january-6-capitol-siege-chaos-fd3204574c11e453be8fb4e3c81258c3">injured police officers</a>, rampaged through the Capitol and sent lawmakers running for their lives. But eight senators and almost 140 members of the House voted to sustain the objections.

Congress had only held such votes twice since the enactment of the Electoral Count Act 135 years ago. In 1969, two Democratic senators joined a member of the House to object to the vote of one elector in North Carolina during the certification of Republican Richard Nixon’s victory. In 2004, Democratic Sen. Barbara Boxer of California and Rep. Stephanie Tubbs Jones, D-Ohio, objected to President George W. Bush’s electors in Ohio over what they said were voting irregularities.

In both cases, the House and the Senate rejected the objections.

In several other instances, members of the House have lodged objections without the support of a senator. In 2000, several members of the Congressional Black Caucus objected to Bush’s electors in Florida after the Supreme Court had forced a halt to vote-counting in that state and decided the election. Vice President Al Gore, whom Bush had defeated, gaveled the objections down as he presided over the session.

In 2016, several Democrats stood and objected to Trump’s win over Democrat Hillary Clinton but no senator joined, and Vice President Joe Biden dismissed them. Like Gore, Clinton had already conceded defeat.

Members on both sides of the Capitol have been working on the revisions to the Electoral Count Act since the 2021 insurrection, saying the law’s vague language was not robust enough protection against Trump’s overt attempts to subvert the will of the people. The bills would also clarify that the vice president’s role is solely ceremonial and try to prevent states from creating slates of illegitimate electors, as Trump’s allies tried to do.

The House bill is more expansive than the Senate bill, and the two sides will eventually have to resolve their differences into a single measure. That includes the House language with new grounds for any objection, which would restrict the process even further.

Under the House legislation, no member could make an objection unless it fell under a strict set of parameters that relate to the Constitution — that the state is not validly a state, if the state submits too many electoral votes or if a candidate is not eligible, for example.

House Republicans argued against the legislation by saying it was a political attack on Trump, noting the frequent Democratic objections over the years. It only received nine Republican votes, all from members who are not returning to the House next year.

Rep. Jamie Raskin, D-Md., responded that if lawmakers believed there had been too many objections in the past, “you should absolutely be supporting this legislation.”

Hawley, who was photographed raising a fist to pro-Trump protesters outside the Capitol ahead of last year’s joint session, said in an interview that he is “skeptical” of the effort to change a law that has been in place for so many years.

“My concern is that it’s going to look like to Republican voters that Democrats can object as much as often as they want,” the Missouri Republican said, noting the objections in 2000, 2004 and 2016.

“As soon as Republicans do, they change the law,” Hawley said. “I can promise you, that will be the perception.”

Still, 11 Republican senators have signed on to the Senate bill, enough to break a filibuster and pass the bill in the 50-50 Senate.

Pennsylvania Sen. Pat Toomey, who is retiring, was the latest GOP senator to sign on to the legislation last week.

“The poor drafting of the 1887 Electoral Count Act endangered the transition of power from one Administration to the next,” Toomey said when he announced his support.

“Unfortunately, in the over 100 intervening years, individual Democratic and Republican members of Congress have occasionally attempted to exploit the ambiguities in this law to cast doubt on the validity of our elections, culminating in the debacle of January 6, 2021," he said. "It is past time Congress act.”

 </figure>WASHINGTON (AP) — Members of Congress have officially objected to the results in four of the last six presidential elections, a partisan practice that has been legal for over a century but became much more fraught after&nbsp;<a href="https://apnews.com/article/congress-confirm-joe-biden-78104aea082995bbd7412a6e6cd13818">a violent mob</a>&nbsp;of then-President Donald Trump’s supporters&nbsp;<a href="https://apnews.com/hub/capitol-siege">attacked the U.S. Capitol</a>&nbsp;last year.In an effort to prevent another Jan. 6, 2021,&nbsp;<a href="https://apnews.com/article/2022-midterm-elections-presidential-constitutions-congress-ba742c9f4c67c5189a6a6c9f8531721e">bills moving through the House and the Senate</a>&nbsp;would make it harder to lodge those objections when Congress counts the electoral votes in a joint session after every presidential election. The move to curtail the objections is part of a larger effort to overhaul the 1800s-era Electoral Count Act and safeguard the integrity of the vote after&nbsp;<a href="https://apnews.com/hub/donald-trump">Trump</a>&nbsp;tried to persuade his Republican allies in Congress to vote against&nbsp;<a href="https://apnews.com/article/joe-biden-wins-white-house-ap-fd58df73aa677acb74fce2a69adb71f9">Democrat Joe Biden’s victory</a>&nbsp;and overturn his 2020 defeat.Under current law, only one member of the House and one member of the Senate has to challenge a state’s results to trigger votes on that state’s electors in each chamber. Both the House and the Senate voted to certify Biden’s win in those states in the hours after the rioters had&nbsp;<a href="https://apnews.com/article/docs-expose-depth-january-6-capitol-siege-chaos-fd3204574c11e453be8fb4e3c81258c3">injured police officers</a>, rampaged through the Capitol and sent lawmakers running for their lives. But eight senators and almost 140 members of the House voted to sustain the objections.Congress had only held such votes twice since the enactment of the Electoral Count Act 135 years ago. In 1969, two Democratic senators joined a member of the House to object to the vote of one elector in North Carolina during the certification of Republican Richard Nixon’s victory. In 2004, Democratic Sen. Barbara Boxer of California and Rep. Stephanie Tubbs Jones, D-Ohio, objected to President George W. Bush’s electors in Ohio over what they said were voting irregularities.In both cases, the House and the Senate rejected the objections.In several other instances, members of the House have lodged objections without the support of a senator. Bills would curtail objections at future Jan. 6 vote counts

OMAHA, Neb. (AP) — A mining company that wants to extract an assortment of rare elements from southeast Nebraska has announced an agreement that will provide up to $285 million to help cover the roughly $1.1 billion cost of building the mine.

In addition to the acquisition of a special purpose acquisition company called GX Acquisition Corp. II that NioCorp announced Monday, the Centennial, Colorado, company also signed letters of intent to borrow up to $81 million more from Yorkville Advisors Global. So NioCorp could get as much as $366 million to&nbsp;<a href="https://apnews.com/article/joe-biden-business-united-states-environment-nebraska-6f820e066c12ad04853fc832e674a33e">finance the project</a>.

NioCorp CEO Mark Smith said “these transactions have the potential to put NioCorp on the fast track to obtain the required project financing.”

The main element NioCorp plans to produce at the mine about 80 miles (130 kilometers) south of Omaha near the town of Elk Creek is a heat resistant element called niobium along with scandium and titanium. The company has said analysis of samples from the site shows there is also a&nbsp;<a href="https://apnews.com/article/technology-united-states-nebraska-omaha-30977658a2fd9b19ad94bf9858e5e5f4">significant amount of rare earth elements</a>&nbsp;there like the ones President Joe Biden wants to produce more of domestically. But it’s not yet sure whether it will be economically feasible to also produce some of those elements that are used to create the strong magnets used in a variety of high-tech products such as electric vehicles and cell phones.

Biden has said the United States needs to reduce its dependence on foreign suppliers of critical minerals. China is the world’s biggest producer of rare earth elements.

Dean C. Kehler, Co-Chairman and CEO of GXII said NioCorp should be able to help with Biden’s goal if it can raise the rest of the money it needs to begin producing niobium, scandium and possibly rare earth elements.

It won't be clear exactly how much money this transaction will give NioCorp until closer to when the deal is expected to close early next year because some investors could pull their money out of the GXII fund before closing.

GXII is a one of the&nbsp;<a href="https://apnews.com/article/financial-markets-charlotte-705dbc9454023c64daf41e2024086c77">risky shell companies</a>&nbsp;known as SPACs that became popular on Wall Street in recent years before many of them fell out of favor and had to be liquidated without ever completing a transaction. A SPAC is essentially a blank check company created solely to merge with another business to invest in it.

While SPACs are often used to help companies go public, NioCorp is already a publicly traded company, but this deal is expected to give it a listing on the NASDAQ, which would help it attract more investors. NioCorp has been actively exploring the Nebraska site for more than seven years, and since 2013, it has raised more than $80 million to pay for its efforts.

The proposed mine is expected to create over 400 jobs if it is ever built.

The U.S. imports all the niobium and scandium and most of the titanium and rare earths that NioCorp hopes to produce. There is only one American mine that produces rare earths now at a site in California. NioCorp says its deposit of rare earth elements is second only to that Mountain Pass mine that MP Materials runs in California.

A severe allergic reaction would usually occur within a few minutes to 1 hour after getting a dose of the vaccine.  <li>Myocarditis (inflammation of the heart muscle) and pericarditis (inflammation of the lining outside the heart) have occurred in some people who have received COMIRNATY® (COVID-19 vaccine, mRNA) or Pfizer-BioNTech COVID-19 Vaccine. The observed risk is higher among adolescent males and adult males under 40 years of age than among females and older males, and the observed risk is highest in males 12 through 17 years of age. In most of these people, symptoms began within the first week following receipt of the second primary series dose or first booster dose, with most booster doses administered at least 5 months after completing primary vaccination. The chance of having this occur is very low.&nbsp;</li>
