CHEYENNE, Wyo. (Casper (Wyo.) Star-Tribune) — Gov. Mark Gordon says there are no plans to deploy Wyoming National Guard troops to quell riots in other states, but they will be available in case they are needed in Wyoming or elsewhere in the region. 

Federal officials have been asking state officials whether they would be able to deploy troops to Washington, D.C. 

 But rioting and looting as well as peaceful protests against the death of George Floyd in Minneapolis have occurred in Denver.

 Gordon spokesman Michael Pearlman says Gordon has been talking with Colorado Gov. Jared Polis, but so far states haven't asked Wyoming for help.

The Kansas Highway Patrol reported a 2014 Peterbilt semi driven by Scott T. Sell, 50, Hastings, NE., was southbound on Kansas 14 just north of Cedar Road.

The vehicle veered onto the west shoulder. The driver overcorrected. The vehicle entered the east ditch and overturned in a pasture.

Sell was pronounced dead at the scene. He was properly restrained at the time of the accident, according to the KHP.

Nebraska man dies after semi overturns on Kan. highway

MINNEAPOLIS (AP) — Prosecutors are charging a Minneapolis police officer accused of pressing his knee against George Floyd’s neck with second-degree murder, and for the first time will level charges against three other officers at the scene, a newspaper reported Wednesday.

Earlier Wednesday, the Floyd family’s attorney demanded that all four officers be charged.

“He died because he was starving for air,” Ben Crump said. “He needed a breath. So we are demanding justice. We expect all of the police officers to be arrested before we have the memorial here in Minneapolis, Minnesota, tomorrow.”

Crump said the other officers failed to protect a man who was pleading for help and said he couldn’t breathe.

Crump pointed to the criminal complaint against Chauvin, which said that while Floyd was complaining he couldn’t breathe, Lane asked Chauvin twice if they should roll him on his side. Chauvin said they should keep him on his stomach.

“To us that is intent,” Crump said. And he said the other officers were complicit because they failed to take action.

“We are expecting these officers to be charged as accomplices,” Crump said.

Minnesota Gov. Tim Walz said on a National Governors Association call that state Attorney General Keith Ellison, now leading prosecutions in the Floyd case, would make an announcement later Wednesday on the other officers. Ellison spokesman John Stiles confirmed that Ellison would give an update but would not provide any details.

Personnel records released by the city show Chauvin served as a military policeman in the U.S. Army in the late 1990s. Since being hired as a police officer in 2001, he has been awarded two medals of valor: One for being part of a group of officers who opened fire on a stabbing suspect after the man pointed a shotgun at them in 2006, and one for apprehending another man in a domestic incident in 2008. In the latter incident, Chauvin broke down a bathroom door and shot the man in the stomach.

Chauvin was reprimanded in 2008 for pulling a woman out of her car in 2007, frisking her and placing her in his squad car after he stopped her for speeding 10 miles per hour over the limit. His dashboard camera was not activated and a report said he could have interviewed the woman while standing outside her car.

Lane, 37, and Kueng both joined the department in February 2019 and neither have any complaints on their files.

Lane previously worked as a correctional officer at the Hennepin County juvenile jail and as a probation officer at a residential treatment facility for adolescent boys.

Kueng was a 2018 graduate of the University of Minnesota where he worked part-time on campus security. He also worked as a theft-prevention officer at Macy’s in downtown Minneapolis while he was in college.

Tou Thao, a native Hmong speaker, joined the police force as a part-time community service officer in 2008 and was promoted to police officer in 2009. He was laid off later that year due to budget cuts and rehired in 2012.

Crump and the Floyd family commissioned a separate autopsy that concluded he died of asphyxiation due to neck and back compression due to Chauvin’s knee on his neck and other responding officers’ knees in his back, which made it impossible for him to breathe.

Murder charge upgraded in Floyd case, 3 other cops charged

WASHINGTON (AP) — Defense Secretary Mark Esper said Wednesday he opposes using military forces for law enforcement in containing current street protests, tamping down threats from President Donald Trump, who had warned states he was willing to send troops to “dominate” the streets.

Less than 48 hours after the president threatened to use the Insurrection Act of 1807 to contain protests if governors were not able to get a handle on unrest, Esper said it should be invoked in the United States “only in the most urgent and dire of situations.” He declared, “We are not in one of those situations now.”

Esper, at Trump’s encouragement, had already authorized the movement of about 1,300 active-duty Army units to military bases just outside the nation’s capital, but they have not entered the city — and defense officials said some of the troops were beginning to return to their home bases Wednesday.

White House officials indicated even before Esper’s comments that Trump was backing away from invoking the Insurrection Act. At the same time, the president was taking credit for the deployment of federal and other law enforcement officers to the nation’s capital, saying it offered a model to states on how to stop violence accompanying some protests nationwide.

Trump argued that the massive show of force was responsible for protests in Washington and other cities turning calmer in recent days and repeated his criticism of governors who have not deployed their National Guard to the fullest.

“You have to have a dominant force,” Trump told Fox New Radio on Wednesday. “We need law and order.”

Esper, in his Pentagon remarks, strongly criticized the actions of the Minneapolis police for the incident last week that ignited the protests. In their custody, a black man, George Floyd, died after a white officer pressed his knee to Floyd’s neck for several minutes. Esper called the act “murder” and “a horrible crime.”

Esper himself has come under fire from critics, including retired senior military officers, for having walked from the White House on Monday evening with Trump and others for a presidential photo opportunity in front of St. John’s Episcopal Church, which had previously sustained damage from protesters.

Esper said that while he was aware they were heading to St. John’s, he did not know what would happen there.

“I was not aware a photo op was happening,” he said, adding that he also did not know that police had forcibly moved peaceful protesters in Lafayette Square to clear the way for Trump and his entourage.

Trump put a political spin on his criticism of states with violence. He said, “You notice that all of these places that have problems, they’re not run by Republicans. They’re run by liberal Democrats.”

The Defense Department has drafted contingency plans for deploying active-duty military if needed. Pentagon documents reviewed by The Associated Press showed plans for soldiers from an Army division to protect the White House and other federal buildings if the security situation in the nation’s capital were to deteriorate and the National Guard could not secure the facilities.

But interest in exerting that extraordinary federal authority appeared to be waning in the White House. Though the crackdown on the Washington demonstrations was praised by some Trump supporters Tuesday, a handful of Republicans expressed concern that law enforcement officers risked violating the protesters’ First Amendment rights.

The situation in Washington had escalated Monday, becoming a potent symbol of Trump’s policing tactics and a physical manifestation of the rhetorical culture war he has stoked since before he was elected. Esper says no military for protests as standby troops leave

GRAND ISLAND, Neb. (AP) — Police have arrested an Alda man accused of pointing a gun at a protester in Grand Island. 

Police said in a news release that the incident happened Tuesday night after protesters gathered in a parking lot. 

Police say 42-year-old Bobby Williamson drove by the protest and pointed a gun at a 31-year-old man participating in the protest. 

Police say witnesses corroborated the incident. 

Police say Williamson's car was quickly stopped, and three guns — including one reported stolen from Grand Island — and ammunition were found inside. 

Police said none of the guns were loaded. Williamson faces charges of making terroristic threats, possession of a stolen firearm and a weapons-use count.

Some Nebraska prison workers have been confirmed infected as well, as have seven inmates from the Community Corrections Center in Omaha.

Virus hits 11 workers, 1 patient at Lincoln Regional Center

OMAHA, Neb. (AP) — Police in Omaha are investigating the death of a man at the hands of another man who was using a wrestling move called a “half nelson” to subdue him. 

Police said Wednesday in a news release that officers were called to a home Friday for an assault report. 

Arriving officers found a 39-year-old man holding down 42-year-old Calvin Strong face down in what the younger man called a half nelson. 

Strong was unresponsive when police arrive and was taken to a hospital, where he died. 

The younger man told police the altercation began when Strong kicked in his bedroom door and began assaulting him, and police say witnesses backed up that account.&nbsp;&nbsp;

WASHINGTON (AP) —Amid racial unrest across the nation, President Donald Trump on Monday declared himself “the president of law and order” and threatened to deploy the United States military to American cities to quell a rise of violent protests.

As Trump spoke, an incredible TV split screen developed around the White House. While he addressed the nation in the White House’s idyllic Rose Garden, a series of military vehicles rolled out front on Pennsylvania Avenue and military police and law enforcement clashed with protesters at Lafayette Park.

Those peaceful demonstrators were cleared so Trump could walk across the park to St. John’s Episcopal Church, known as “The Church of the Presidents,” which suffered fire damage in a protest this week. Holding a Bible, he then stood with several of his Cabinet members as the cameras clicked.

“We have the greatest country in the world,” Trump declared. “We’re going to keep it safe.”

Trump said he would mobilize “thousands and thousands” of soldiers to keep the peace if governors did not use the National Guard to shut down the protests. Loud tear gas explosions could be heard as authorities moved what appeared to be peaceful protests in the park. The escalation came just after Attorney General William Barr came to the park to to survey the demonstrators.

According to senior defense officials, between 600 and 800 National Guard members from five states were being sent to Washington to provide assistance. Those troops were either already on the ground or will arrive by midnight.

Under the Civil War-era Posse Comitatus Act, federal troops are prohibited from performing domestic law enforcement actions such as making arrests, seizing property or searching people. In extreme cases, however, the president can invoke the Insurrection Act, also from the Civil War, which allows the use of active-duty or National Guard troops for law enforcement.

The officials said that some of the National Guard in D.C. will be armed and others will not. They said that the D.C. guard members do not have non-lethal weapons. The military police that are visible in the city are members of the Guard.

OMAHA, Neb. (AP) - A Nebraska bar owner won't be charged in connection with the fatal shooting of a 22-year-old man during weekend protests in downtown Omaha over the death of George Floyd in Minneapolis, authorities said Monday.

The shooting occurred at around 11 p.m. Saturday in the city's Old Market area and within a couple of blocks of where protesters had gathered. Police said they arrested someone within the hour in connection with the shooting of protester James Scurlock.

Douglas County Attorney Don Kleine said Monday that Jake Gardner, who owns two bars near where the shooting happened, fired the fatal shot during a scuffle with protesters outside one of his bars. Kleine said the bar owner said he feared for his life before the shooting.

Prosecutors showed video of the incident before Kleine announced that he wouldn't file charges. Shortly before the shooting the bar owner was backing up away from protesters and asking them to leave. Then the bar owner was shoved to the ground by two people before he fired two shots. Then Scurlock jumped on top of the bar owner. Kleine said Gardner asked Scurlock to get off of him several times before he fired the fatal shot.

"We felt that this case was a self-defense case at this time," he said.

Kleine said he hoped the decision not to file charges won't lead to more protests in Omaha. Gardner is white, and Scurlock was black.

"This decision may not be popular and may cause more people to be upset. I would hope that the they understand that we're doing our job to the best of our ability in looking at the evidence and the law and that's all we can do," Kleine said.

Scurlock's father, who is also named James Scurlock, said he hopes authorities will continue investigating his son's shooting death and call a grand jury to review the evidence.

"What I want is justice, not a quick answer. This was a quick answer," Scurlock said.

Following the shooting, which took place amid a second night of violent protests in Omaha, officials imposed a curfew on Nebraska's largest city, and national guard troops were mobilized to help police.

Floyd, who was black and was handcuffed, died after a white police officer, Derek Chauvin, used his knee to pin down Floyd's neck for several minutes while Floyd pleaded for air and eventually stopped moving. Chauvin and the other three officers who took part in the arrest of Floyd, who was suspected of passing a counterfeit bill, were fired Tuesday. Chauvin was charged Friday with third-degree murder and manslaughter charges, but the other three officers haven't been charged.

According to the Lincoln County Sheriff's Office, on May 30, 2020, at 4:02 p.m., the North Platte 911 Center received a call of a vehicle rollover accident at mile marker 164 on US Interstate 80 (just east of the Hershey, NE. interchange). 

Deputies and first responders arrived and found sixty-two-year-old Randy McCoy of Hastings, NE. deceased. 

Accident Investigators determined Mr. McCoy was traveling westbound on Interstate 80 and left the roadway on right. 

The vehicle entered the north ditch, struck a drainage culvert and rolled numerous times. 

The vehicle came to rest on South River Road (just north of Interstate 80. 

Mr. McCoy was not wearing a seatbelt at the time of the accident.

 Marijuana was suspected as a contributing factor in the accident.

AP- South Dakota has surpassed 5,000 confirmed cases of the coronavius. State health officials on Monday reported 41 new COVID-19 cases, bringing the state’s total to 5,034. 

 The number of deaths reported in South Dakota since the start of the pandemic remains at 62. 

The Department of Health reports 87 people are currently hospitalized, an increase of one since Sunday. 

 Of South Dakota’s confirmed coronavirus cases, Minnehaha County, the state’s most populous county, leads with 3,355.

South Dakota surpasses 5,000 positive cases of COVID-19

CHEYENNE, Wyo. (AP) — Many business owners in Wyoming's capital city were hopeful that an annual festival of rodeo and cowboy culture would go ahead this year despite the coronavirus. 

Those hopes ended Wednesday when Gov. Mark Gordon and organizers of Cheyenne Frontier Days announced that the event couldn't safely go ahead for the first time in 124 years. 

Each July, Frontier Days draws 140,000 people to Cheyenne, a city of 64,000. 

The event brings $28 million to the area, money that will be sorely missed as businesses struggle under COVID-19 restrictions. 

Business owners say they'll do their best to carry on.

No rodeo festival dashes Wyoming city's hopes amid COVID-19

SIOUX FALLS, S.D. (AP) — South Dakota Gov. Governor Kristi Noem activated the National Guard after protests in Sioux Fall turned violent over the death of George Floyd in Minneapolis last week. 

The Argus Leader reports the protest in South Dakota’s largest city started Sunday afternoon with a march downtown. 

Police said dozens of protesters later congregated at the Empire Mall and began throwing rocks at officers.

 Several businesses in the area of the Empire Mall had windows damaged.

 Police said protesters had dispersed by 11 p.m. 

Noem said about 70 Guard members will remain in the city until they are no longer needed.&nbsp;&nbsp;

OMAHA, Neb. (AP) — Officials say a third Douglas County Corrections employee has tested positive for COVID-19 as the number of virus cases continues to rise in the state. 

The ill corrections officer is recovering at home, said Corrections Director Mike Myers. 

The two other officers who contracted the virus have recovered and returned to work.

 The state Department of Health and Human Services said there have been 14,101 virus cases and 170 deaths since the outbreak began. 

On Monday, more social-distancing regulations will be eased in the state

. The relaxed rules will allow for larger crowds at public events and bars can reopen.

Third Douglas County corrections officer contracts COVID-19

Mayor Leirion Gaylor Baird today announced that, in the interest of public safety, she has issued an Emergency Declaration that will implement a curfew for all Lincoln residents from 8 p.m. tonight until 6 a.m. Monday, June 1. During these hours, the only people permitted to be out of their homes are those who are going to work, seeking medical attention or seeking the assistance of law enforcement.

The curfew is in response to the violence that erupted Saturday night after an initially peaceful assembly to protest the murder of George Floyd in Minneapolis, Minnesota. The riot resulted in injuries and property damage estimated in the tens of millions of dollars along Lincoln Mall between the State Capitol and the City-County government offices on 10th Street. It was the second night of violent protest in Lincoln.

"The protesters in Lincoln over the past few days have largely been peaceful and respectful. I fully support their calls for justice," said Mayor Gaylor Baird. "Last night, however, a smaller handful of people who apparently have other agendas committed terrible acts of destruction. The perpetrators of this violence were not limited to a single race or ethnicity; many were white. I cannot and will not condone those physical acts of destruction. No one should. That honors no one."

The Mayor issued the Emergency Declaration at a news conference Sunday afternoon attended by Police Chief Jeff Bliemeister; Kameron Neeman, the organizer of the Black Lives Matter rally from 4 to 5:30 p.m. this evening at the State Capitol; and City Council members James Michael Bowers, Roy Christensen, Bennie Shobe, Tammy Ward, and Sändra Washington.

Under the Emergency Declaration, the Mayor has also requested support from the National Guard to help protect City infrastructure and businesses.

Mayor Gaylor Baird viewed the damage along Lincoln Mall today and thanked those who were helping to clean up. "I saw dozens of people pitching in to help clean up the damage from the night before - volunteers scrubbing graffiti and picking up shattered glass," she said. "To all the people whose businesses and buildings were damaged as a result of last night's events, know that we are dedicated to doing everything we can to prevent further needless destruction."

Chief Bliemeister said police officers were struck multiple times with bottles, fireworks, and rocks, and one officer was injured. He said there were three separate assaults reported by residents as a part of the protest. One person sustained a laceration, possibly from a knife.

Most of the property damage was from a fire at the Universal Inland Insurance building, 601 S. 12th. The Hall of Justice at 575 S. 10th has about $10,000 damage, and two bus shelters were destroyed. Four people were arrested for obstructing government operations and failure to disperse. A fifth person was arrested for obstructing government operations only.
