LINCOLN — A filibuster stretching over three days derailed a proposal Friday to require two-person crews on trains operated by major railroads in Nebraska.

State Sen. Mike Jacobson of North Platte — a major railroad center in the state — brought the proposal. He was able to advance it to floor debate in the State Legislature for the first time after years of trying by other senators.

But supporters failed to garner the needed 33 votes Friday to halt a filibuster and advance Legislative Bill 31. The vote was 24-19 to invoke cloture.

Jacobson argued that LB 31 that would increase safety by providing a second set of eyes on rail hazards and someone who could inform first responders, in the event of a derailment, about hazardous chemicals on the train.

Derailments and other safety problems are on the rise, the senator said, and include an explosion and fire on a train in North Platte’s Bailey Yards in September that prompted evacuations due to a cloud of toxic smoke.

The safety issue drew national attention a year ago when 28 cars of a Norfolk Southern train carrying hazardous chemicals derailed near East Palestine, Ohio, requiring the evacuation of hundreds of people.

More than 176,000 tons of contaminated soil has been removed from the accident site. In addition, 1,200 private wells and the municipal water system were tested in the area. The tests showed no impacts, according to the Environmental Protection Agency.

Train engineers, Jacobson said, are required to stay in the cab, even in the event of an accident. He added that a second crew member on a train can speed the “breaking” of a train when first responders need to cross a crossing blocked by a parked train.

“Would you feel comfortable flying without a co-pilot?” Jacobson asked.&nbsp;

Currently, 11 states, including neighboring Kansas and Colorado, have two-man crew requirements.

Union Pacific runs two-person crews on its over-the-road trains, as do other railroads, including the Burlington Northern Santa Fe. A UP spokeswoman said that the crew size issue came up in recent labor negotiations but was later not included in the agreement reached.

Opponents argued that lawmakers were interfering in what is a matter for labor negotiations and federal regulation and that Nebraska ought to wait for the feds to act on the controversial issue pitting labor unions against management.

Sen. Julie Slama of Dunbar said such a bill interfered with interstate commerce, and Omaha Sen. Kathleen Kauth said there’s no proof that two-man crews reduce derailments. Several countries, she added, have safely switched to one-person train crews.

Another opponent of the bill, Sen. Lou Ann Linehan of Elkhorn, pointed out that Union Pacific is one of the state’s top employers and a top payer of property taxes.

Jacobson pushed back on that comment, saying that “safety” rules shouldn’t be determined on how much a company pays in taxes.

The federal government might soon weigh in on this issue.

LINCOLN, NE -- As part of a comprehensive plan to reverse Nebraska’s brain drain and compete more effectively for top talent, Governor Jim Pillen today joined University of Nebraska (NU) Interim President Chris Kabourek and representatives from the Board of Regents in announcing a new scholarship for the state’s top ACT scorers. The program will cover the total cost of undergraduate attendance, plus stipends, at any NU campus.

Beginning in the 2024-25 academic year, the Office of the President will fund a new Nebraska Presidential Scholars Program that will cover tuition, fees, books, housing and all other costs of attendance, plus a $5,000 annual stipend, for any Nebraska student who scores a perfect 36 on the ACT. The announcement from the Governor and university was widely praised by agricultural, philanthropic, business and elected leaders who endorsed the vision to compete for Nebraska’s homegrown talent to meet the future needs of the state.

“This is a simple, but powerful, message to our best and brightest young people: We want you on Team Nebraska,” said Gov. Pillen. “As I travel around the state and talk to business and community leaders, something I hear again and again is that we need to do a better job of competing for talent. With the Presidential Scholars Program, we’re going to compete. I’m proud to join with President Kabourek and the Board of Regents in putting this bold plan forward.”

Kabourek said: “Governor Pillen has challenged all of us to step up and work together to solve Nebraska’s brain drain. The University of Nebraska needs to play a leading role and the Presidential Scholars Program is part of our answer to the Governor’s call. Kabourek said NU is immediately launching a fundraising effort as part of its ongoing&nbsp;Only in Nebraska&nbsp;campaign to raise private funds to create a permanent Presidential Scholars endowment that will extend the program beyond those who achieve a 36 ACT. Ultimately, the university’s goal is to provide total cost of attendance scholarships to all Nebraska students who score a 33 or above.

“My message to every Nebraska student and every parent is that if you’re willing to work hard, the University of Nebraska will do everything we can to help you become the best version of yourself and get a great education that will prepare you for success,” said Kabourek.

On average over the past three years, about 600 Nebraska students a year score at least a 33, including about 30 who score a perfect 36. But less than half of those students enroll at the University of Nebraska, including only 22 percent of students with a 36. Meanwhile, Nebraska faces a persistent brain drain, at a time when the state urgently needs more workforce to fill current and future jobs.

The university’s goal is to enroll 80 percent of students who score a 33 or higher, Kabourek shared. Furthermore, he said that elite academic performers who choose the University of Nebraska should be celebrated the way student-athletes are, with signing ceremonies and public attention to signal Nebraska’s pride in retaining them in the state.

“When we say we want the University of Nebraska to compete, this is exactly what we mean. I am thrilled that we are taking bold action to keep more of Nebraska’s best and brightest here in our state,” said Board of Regents chairman Tim Clare of Lincoln. “This is a win for our university, for students, our workforce and Nebraska’s national profile.”

The Lambing and Kidding School, on Feb. 10, will look at ways to give lambs and their kids the best chance of survival. The school is hosted by the Nebraska Sheep and Goat Producers Association and Nebraska Extension, offering tips and networking opportunities for lamb and goat producers.&nbsp;

“Often times, kids are considered extremely delicate creatures. However, given the proper environment and a good mother, they can thrive on their own without human intervention,” said Jesse Fulton, Nebraska Extension educator and Director of Nebraska Beef Quality Assurance. He will be a presenter at the school.&nbsp;

Generally, lambing takes place in the spring in Nebraska, but depending on the management plan of the producer, it can be earlier or later. The clinic will cover the basic best management practices producers should be considering to help give the lambs/kids the best chance of survival.&nbsp;

“Newborn kids sometimes need a little more attention after birth. However, this is dependent on the mothering instinct of the ewe/doe, the environmental conditions in which the lamb/kid is born, and how thrifty the lamb/kid is after parturition,” Fulton said. At the clinic, speakers will discuss considerations and best practices to help achieve a successful lambing/kidding season. Topics include proper handling techniques; feed and nutrition during lambing and kidding; ewe and doe care during childbirth; lamb and kid care after birth, and more.&nbsp;

The school will meet at 9:30 a.m. on Saturday, Feb. 10, at the North Platte NRD Office in Scottsbluff. Registration fee is $30 for non-members and $20 for members. The group will tour the Diamond S Stock Farms in Scottsbluff and CB Boer Goats in Bayard.

CHADRON – Chadron State College’s I Hate Winter Weekend activities are scheduled for Friday and Saturday. Activities will primarily take place during the weekend’s sporting events and are sponsored by CSC’s Campus Activity Board (CAB).

Friday’s scheduled activities include pajama night at the wrestling match between Chadron State College and Adams State University in the Chicoine Center at 6 p.m. and Free Bowling Night at Hilltop Lanes at 8 p.m. Students and fans are invited to wear pajamas to the wrestling duel where The Nest will be giving away prizes. Gifts and prizes will also be given away at Free Bowling Night.

Update: The wanted male Martin Palomo is in custody this afternoon with the assistance from Gering Police Department, Scotts Bluff County Sheriff’s Office, National Park Service, and Gering Fire Department. Palomo was located in Gering and taken into custody without incident.

A warrant for the arrest of Scottsbluff man has been issued in connection to a stabbing on January 1st in Morrill.&nbsp; Authorities were notified of a female stabbing victim that was treated at the Regional West Medical Center Emergency Room early morning on New Year's Day. 

Officers responded and determined that the 40-year-old female victim had been stabbed in the abdomen and sustained non-life-threatening injuries. The incident occurred at a local residence and the victim was transported to the hospital by two roommates following the incident.

During the investigation the suspect was identified as 52-year-old MARTIN PALOMO of Scottsbluff, Nebraska. An arrest warrant has been issued for Palomo, charging him with 1st Degree Domestic Assault (Class IIA Felony), Use of a Deadly Weapon to Commit a Felony (Class II Felony), Possession of a Deadly Weapon by Prohibited Person (Class III Felony), Burglary (Class IIA Felony) and Terroristic Threats (Class IIIA Felony). 

A search warrant was executed at a Gering residence after information was received that Mr. Palomo may be at that residence, but he was not located. The whereabouts of Mr. Palomo are not known at this time.

The Morrill Police Department and Scotts Bluff County Sheriff’s Office are investigating the incident and were assisted by the Scottsbluff Police Department, Gering Police Department, Mitchell Police Department, Nebraska State Patrol, Scotts Bluff County Sheriff’s Office Drone Team, Gering Fire Department, Regional West Medical Center Ambulance Service.

Anyone with information about Mr. Palomo’s whereabouts may contact the Scotts Bluff County Communications Center at 308-436-6666.

Last week Earl and I had the honor of participating in a Poverty Simulation, hosted by the Head Start Program of Educational Service Unit #13 (ESU13) and Nebraska Extension. The idea was to create a condensed month-long role-play experience giving a better understanding of the challenges facing households that live in poverty.

Head Start staff and Public School Partnership staff from the western and southern Panhandle (Scottsbluff, Gering, Mitchell, Morrill, Minatare, Bridgeport, Sidney) were placed into family units. They were challenged with navigating daily and weekly tasks. They had to apply for jobs, buy groceries, pay rent, pay utility bills, deal with issues at school, and visit social service agencies to apply for assistance.

Each week was fifteen minutes long. At the start of each week families were reminded by the moderator that they needed to focus on maintaining a place to live, paying utility and other bills, and providing food for their family. Those who had jobs had to get their children to school or child care and get to work on time. When the weekend came, businesses and agencies closed. Families regrouped, checked their finances, and made their plans for the next week.

Some of the families owned cars. Some had a car, but had to make loan payments to the bank. Many had to purchase transportation passes and use one every time they visited a business or agency.

Random events might challenge the family. An accident or illness might send them to the hospital. A wage earner might get fired. A thief might break into their house and steal furniture or an appliance. A child might get expelled from school. Some families left their children unattended at home because they couldn't afford the child care. Social services or the police might investigate them for child neglect. And the local drug dealer kept coming by to offer them an easy way to earn some extra cash.

The businesses and agencies were located at tables around the room. They were staffed by representatives of Scottsbluff and Gering agencies and by ESU 13 staff and board members. (I am on the ESU #13 Board of Education.) One of the agencies was staffed by a woman who spoke only Spanish, so the participants realized the barriers faced by not being fluent in the language.

I was the mortgage and rent collector. A few of the families were homeless, living in a shelter provided by a religious organization. The others were evenly divided between those who had mortgage payments and those who owed rent. I went around the second week to notify those families whose payments were past due (which was everyone). The last week I evicted everyone who still hadn't paid me. That meant I turned over their chairs while they were out of their home, and I took all their possessions back to my office. They could have reported me to the

police, as I had no court orders for eviction and was therefore stealing their property, but no one did.

Earl was the utility and phone bill collector. As with my job, he collected money, sent out warnings, and shut off power. (I'm not sure why we got to be the bad guys everyone owed money to... At least we weren't the drug dealer.)

How did people get the money they needed to survive? They worked, sometimes more than one job, and they had to pay a fee to the bank or Quik Cash to cash their checks. But sometimes they didn't have jobs, or they didn't earn enough to cover their expenses. They applied for assistance like housing vouchers or EBT/food stamps, but that might mean missing work or wasting precious time to stand in line at various offices. They took out loans from the bank or the payday lender. They sold items at the pawn shop. They went without food. And sometimes they still couldn't make it.

The Poverty Simulation was an eye-opening experience for everyone involved. It was designed to increase our understanding about the problems faced by low-income households. Participants, whether they be families in poverty or agencies or businesses, learned about struggles faced by so many in our area.

Scottsbluff – United Way of Western Nebraska is excited to announce that grant applications are currently being accepted from 501(c)(3) nonprofit organizations for 2024-2025 United Way funding. Fund your good work in the community through a United Way community grant. Applications are available online at www.uwwn.org/grant. United Way work focuses on identifying the issues impacting the community in the areas of health, education, and financial stability. Services provided by the organizations must promote healthier lives, better education or financial stability, provide for and contribute primarily to human care and health needs operating and serving individuals in health, welfare, recreation, youth-guidance and/or character-building field.

Funds for the United Way of Western Nebraska grants are raised in the local community during the annual United Way fundraising campaign and through United Way special events. Agencies that apply and meet the funding criteria will be interviewed by a group of United Way volunteers that determine funding levels for each agency. Agencies seeking funding from the United Way of Western Nebraska main office will be interviewed on Wednesday, April 24 and Thursday, April 25 in Scottsbluff, Box Butte County interviews will be held on Thursday May 2 in Alliance and Dawes County interviews for funding will be held on Monday, May 6 in Chadron. The amount of funding available is based on the final amount raised at the end of the United Way campaign.

United Way of Western Nebraska serves 11 counties in the Nebraska Panhandle and Platte County and Goshen County, Wyoming. The money raised in each area is available for agency funding in that county or service area. For instance, Scotts Bluff County area funds raised are granted to Scotts Bluff area nonprofits, Box Butte County funds raised are granted to Box Butte County agencies and Dawes County funds are given to Dawes County non-profits that apply for and are granted United Way funding.

Applications open for United Way of Western Nebraska Grants

LINCOLN — The Nebraska State Auditor’s Office on Wednesday accused the former director of an Ogallala senior center of improperly paying herself more than $11,000 upon leaving the job.

According to an audit of the Keith County Senior Center, Jeanine “Jeanie” Herman paid herself $2,380 twice for unused vacation leave upon her exit in March 2023.

In addition, Herman obtained checks of $7,480 for unused sick leave, even though the center didn’t pay for unused sick leave, and other checks for $1,360 for “Vacation Salary” and “Sick Salary” that also were not allowed. None of the payments was approved by the center’s board of directors, the auditor noted.

The Auditor’s Office, in a five-page letter to the senior center, said it was referring its findings to the Nebraska Attorney General’s Office and Keith County Attorney’s Office for possible criminal prosecution for theft.

Attempts to reach Herman, who served two years as the center’s director, were not immediately successful Wednesday.

The senior center did not provide an official response to the audit. But a spokesperson for the center said Wednesday that it was in the process of negotiating with Herman about the alleged overpayments.

State audit claims senior center manager in Ogallala overpaid herself

Growers getting their ground ready for planting this year may have some questions regarding soil health and keeping their lands productive. They can now find assistance with those questions from the Soil Health Exchange. A new online discussion forum hosted by the University of Nebraska-Lincoln CropWatch.&nbsp;

“This forum is specifically designed to connect and communicate with producers and stakeholders in the fields of soil health and management,” said Saurav Das, research assistant professor at Panhandle Research, Extension, and Education Center in Scottsbluff. The goal is to bridge the gap between research and its real-world application in agriculture and improve soil health management adoption.&nbsp;

The Soil Health Exchange group consists of UNL specialists who are committed to enhancing farm productivity, profitability, and environmental stewardship. “Through discussions and shared knowledge, we hope to foster a community dedicated to achieving these goals,” he said.

The Exchange will offer solutions for soil health management challenges, foster a collaborative environment for sharing knowledge and experiences, and translate research into practical field applications.

LINCOLN — For a second time, state lawmakers debated Tuesday whether Nebraska needs to pursue adopting permanent daylight saving time or join two states that have year-round standard time.

The debate pits golfers and broadcasters, who support the added evening sunshine of DST, against health experts who argue that our biological clocks and sleep patterns work best on standard time.

Under Legislative Bill 143, Nebraska would forego the annual “fall-back and spring-forward” changes to daylight saving time and adopt it year round — but only if three bordering states also make the change and the U.S. Congress approves.

State Sen. Steve Erdman of Bayard has introduced an amendment requiring the state to adopt year-round standard time, like Arizona and Hawaii.

He cited research from the American Academy of Sleep Medicine indicating that the “abrupt” switching of clocks every spring and fall causes an increase in heart attacks, mood disorders and auto crashes.

But permanent daylight saving time is the worst option, healthwise, Erdman said, and health concerns trump added sunshine for recreation.

“Our biological clocks work best on standard time … because that’s what God created,” he said.

Lincoln Sen. Danielle Conrad assumed sponsorship of LB 143 after its previous sponsor, Sen. Tom Briese, resigned to become state treasurer. Her primary goal is to end the annual clock changes in spring and fall.

She added, however, that the golf industry and state broadcasters are concerned about switching to permanent standard time and making Nebraska “an outlier” with other states.

Nineteen states, including neighboring Colorado and Wyoming, have adopted proposals to switch to permanent daylight saving time, pending congressional approval.

Switching to permanent standard time, Erdman pointed out, does not require an OK from Congress, and such congressional approval for permanent daylight time is iffy.

Legislators adjourned debate for the day Tuesday before getting to a vote on Erdman’s amendment or LB 143. Debate could resume as early as Wednesday

&nbsp; CHADRON, Neb. –&nbsp;Chadron State College Athletic Director Joel R. Smith announced he will retire, as announced by CSC Athletics Tuesday. Smith, who was the commissioner of the Rocky Mountain Athletic Conference for 12 years, has been CSC's athletic director since 2013. 

Effective immediately, Associate Athletic Director Ted Tewahade will assume additional supervisory duties. Chadron State College President Ron K. Patterson said he intends to hire an Interim Athletic Director and conduct a national search for Smith's permanent replacement soon."Chadron State College has been a wonderful place to work and live," Smith said. 

"We were able to accomplish a fair amount during my time at CSC and I'm proud of everything the student-athletes, coaches, and teams accomplished."Smith oversaw the construction of the Chicoine Center, a Track and Field Complex, and Beebe Stadium, as well as initiating an annual scholarship banquet, When Eagles Dare. Prior to working at CSC and the RMAC, he was the Director of Athletics at Fort Lewis College and the Assistant Athletic Director at Metropolitan State University of Denver.&nbsp;&nbsp;

Smith retires as Athletic Director at CSC

CHADRON – Chadron State College student Reata Cook of Sheridan, Wyoming, competed in the Miss Rodeo America Pageant during the National Finals Rodeo in Las Vegas in December.

Cook was crowned Miss Rodeo Wyoming at the 2022 Wyoming State Fair and served as Miss Rodeo Wyoming in 2023.

She is student teaching at Big Horn’s elementary school and plans to graduate in May with a degree in Elementary Education. She hopes to find a teaching position in the Sheridan area after graduation and stay close to the family ranch.

At the Miss Rodeo America Pageant, contestants are judged in three main categories: personality, appearance, and horsemanship. Throughout the eight-day competition, contestants participated in horsemanship and personality interviews, speech, a Wrangler Fashion Show, and they were provided opportunities to answer questions on-stage.

Cook believes horsemanship is key to being a rodeo queen and it is one of her favorite parts of the competition.

Cook’s goal while competing at the Miss Rodeo America Pageant was to represent herself, her state, her family, her faith, and her support system to the best of her ability.

“I walked with Philippians 4:13: ‘I can do all things through Christ who strengthens me,’ every day of the pageant,” said Cook. “I wanted to share my faith with the judges as I competed.”

Cook is grateful for the opportunity she received to represent Wyoming and the skills she has gained from the Miss Rodeo America Pageant.

“This has given me so many opportunities to travel the country, attending rodeos representing the state of Wyoming,” Cook said. “This has built my skills in personal relations, public speaking, interviewing, and riding. I have had the opportunity to interview rodeo athletes, ride an abundance of horses, and make connections with different rodeo personnel.”

According to Cook, she has always had an interest in educating others and is optimistic about her teaching opportunities in the future.

“I love mentoring kids and inspiring them to be the best version of themselves,” Cook said. “I also have had an interest in serving on a mission trip where I can use my experience in teaching and degree in education to share the gospel and teach overseas.”

Cook was born into the rodeo world. She grew up involved in the Wyoming Junior Rodeo Association and competed in the annual Sheridan County Rodeo.

“My mom was a rodeo queen in the 90s and I grew up attending the Miss Rodeo Wyoming pageant because my mom was on the board for about 10 years,” Cook said. “Rodeo is something that I have always been pretty passionate about and as a little girl it was always a big goal of mine to win Miss Rodeo Wyoming.”

Cook has earned several titles: 2012 Sheridan Wyoming Rodeo Jr. Princess, 2018 Sheridan Wyoming Sr. Princess, and 2022 Miss Sheridan Wyoming Rodeo.

During Cook’s time as Miss Rodeo Wyoming, her platform was Don’t Sell Your Saddle, aimed at speaking about the hard work and dedication it takes to break in a saddle. She traveled to Wyoming schools and read Rusty and His Saddle by Wyoming author Mary Fitchner. She believes the book inspires students to chase their goals.

Cook credits a lot of her success in rodeo to growing up on her family’s cattle ranch.

“I grew up on my family’s cattle ranch, learning the values of a farmer and rancher,” Cook said. “I was raised to appreciate hard work, dedication, family, faith, honesty, and failure leading to success. My dad taught me everything I needed to know about being on the back of a horse; a lot of life lessons were learned on the back of a horse, in the sorting pens, or out in the hay field.”

Although Cook did not earn the title of Miss Rodeo America, she is proud of her accomplishments at the pageant.

“I didn't walk away with the title of Miss Rodeo America 2024, but I did walk away with a $1,500 educational scholarship and won the Traction Financial Scholarship which was $2,500,” Cook said. “I certainly never thought I would be able to compete on such a big stage and show my true self, so that was an accomplishment in itself.”

CSC student competes at 2023 Miss Rodeo America Pageant

Building Blocks Playschool held their ribbon cutting ceremony on Monday. Their mission is to provide a safe, loving, fun, and accepting environment for the future leaders of our community; and its vision is to be the greatest place to learn, play and grow. Parents can expect children to learn through a play-based curriculum. 

In a previous article CEO Lori Mazanec said, “Box Butte General Hospital has been exploring options for adding a childcare center to help combat the healthcare workforce shortage, so the opportunity to collaborate with Shannon and Lighthouse Christian Daycare along with the grant award will allow for a fast track to expand childcare options for our team. 

Adding childcare services to our organization allows us to provide another rung for staff retention and recruitment of essential healthcare workers, additionally expanding employment opportunities at BBGH. The Trustees have been completely supportive and understand the impact this will have.”
