The Buffalo County Sheriff’s Office is&nbsp;investigating&nbsp;the circumstances surrounding a two- vehicle&nbsp;fatal&nbsp;crash&nbsp;east&nbsp;of&nbsp;Ravenna&nbsp;on Highway&nbsp;2&nbsp;near the intersection of&nbsp;Pawnee&nbsp;Road. &nbsp;The crash&nbsp;occurred at approximately&nbsp;4:55&nbsp;AM&nbsp;on&nbsp;Friday,&nbsp;March 19.&nbsp;&nbsp;&nbsp;The&nbsp;two-vehicle&nbsp;crash resulted in the death of&nbsp;one&nbsp;occupant&nbsp;and&nbsp;injury to&nbsp;others.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;

According to preliminary investigation,&nbsp;two vehicles collided in a head on crash on Hwy 2. &nbsp;The crash involved a&nbsp;westbound&nbsp;2016 Chevrolet pickup driven by&nbsp;Sergio Tinajero, age&nbsp;25&nbsp;of Grand Island, NE. &nbsp;He was&nbsp;a&nbsp;lone&nbsp;occupant. &nbsp;The&nbsp;eastbound&nbsp;2019 Ford SUV&nbsp;was&nbsp;driven by&nbsp;Jessica&nbsp;Ehlers, age&nbsp;35&nbsp;of Grand Island, NE. &nbsp;There were 4 additional occupants in this vehicle. &nbsp;One of the&nbsp;occupants, Curtis Deines, age 52 of Chadron, NE died at the scene. &nbsp;All remaining persons, all adults,&nbsp;were transported from the scene to CHI-GSH in Kearney. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;

In 2020, Nebraska saw four avian mortality events affecting about 625 birds. These mortality events typically are caused by disease, trauma or emaciation and tend to occur during migration.

Lake Minatare is the Panhandle’s largest body of water and serves as a stopover location for migratory fowl, including Canada geese, snow geese, ducks and swans. It is located about 15 miles northeast of Scottsbluff.

Vaccine now available for Phase 1E at Fall River Health Services

At the forefront of many Americans’ minds right now, including mine, is the situation at our southern border. The surge of illegal immigrants attempting to enter our country at the Unites States-Mexico border is a serious problem with sweeping implications for national security, drug smuggling, and public safety, before even considering the health and safety of the skyrocketing numbers of unaccompanied children. Our country is a beacon of freedom and opportunity, but our legal process must be upheld and abided by to ensure the continued existence of such opportunity.&nbsp;

The growing number of people entering the United States illegally stems from a growing disregard at home for our immigration laws and standards. The previous administration made border security a focal point, directing additional personnel and resources to the border region and beginning construction of a wall along our southern border. President Biden has halted these efforts and has allowed human traffickers and smugglers to run wild with claims that the border is open to any and all. To fix the crisis at our southern border, we should work across the aisle to find solutions to the root problems and the gaps in our immigration system, not ignoring or encouraging further weakening of our border security.

With the border between the United States and Mexico stretching more than 1,900 miles, it is crucial action is taken to secure our borders. That is why this week I cosponsored the Stopping Border Surges Act of 2021. It would protect family units by allowing parents and children to remain together and prohibiting the release of a child to any individual other than a parent or legal guardian. These safeguards, combined with better coordination and transparency between the Departments of Homeland Security and Health and Human Services creates further accountability for children and families during immigration proceedings. The bill also would address serious, frequently exploited flaws with the asylum process. By establishing uniform standards and increasing penalties if false information is provided, it aims to restore integrity to the process and ensure those fleeing from persecution or torture can access shelter in the United States as our laws intend.

I also supported the Border Crisis Prevention Act to provide commonsense modifications to current handlings of illegal immigrants at the southern border. This bill allows DHS to provide a third country as a safe option for asylum seekers, permits increased funding for ICE in order for them to enforce existing laws and procedures, while also taking action to reduce the asylum backlog by increasing the number of federal immigration judges. Another important aspect of this bill is its explicit authorization to detain illegal immigrants who have proven dangerous or violent.&nbsp;

The continued surges in illegal immigration at our southern border is an issue far from being resolved. These two pieces of legislation are just a start in the much-needed reform to enhance our national security and sustain the integrity of our laws; they include a variety of commonsense proposals all of which would provide immediate benefits to help address the ongoing border crisis. As a nation of immigrants, the United States has served as the worldwide destination for those seeking the American dream. To maintain this legacy, we must continue to uphold these ideals of our country while acting within the law. Both sides of the aisle will have to come together in Congress to reach a solution and establish a better system going forward.

This is the second in a six-part series of articles covering basic water law in the United States, predominately in the western part of the country, and how it affects this finite resource.&nbsp;Water law has a long history. It can be traced back to Roman times and also has roots in English common law. Across the United States, it varies from state to state, and from East to West.

When conflicts arise the courts usually determine the outcome, unless there are state or federal laws or previous case studies to resolve the issue. Exceptions to the law can arise from differences in each state’s water laws.

Part one of this series covered basic concepts and legal terms related to water law and explained two basic doctrines that determine water rights or use, riparian doctrine and the doctrine of prior appropriation. This article discusses some of the other types of water rights and legal doctrines and concepts that determine how water use is regulated and adjudicated.

Diversion&nbsp;(of water) can refer either to a structure in a river or canal that diverts water from the river or canal to another watercourse, or the transfer of water from a stream, lake, aquifer, or other source of water by a canal, pipe, well, or other conduit to another watercourse or to the land, as in an irrigation system.&nbsp; In some states, this can be a&nbsp;consumptive use&nbsp;direct from a stream, such as by livestock watering. In other states, a diversion must consist of actions such as taking water through a canal or conduit.

Common law&nbsp;is a body of court decisions based on custom, traditional usage and precedent, as that of England, rather than codified written laws.&nbsp;Riparian water rights&nbsp;are a common practice under the common law doctrine. Much law, especially property law (including water law) is based exclusively on court decisions. Common law stands as long as it is not overruled or superseded by statutes. Common law fills in the gaps left by statues and constitutions.&nbsp;Statutory law&nbsp;is a body of law based on statutes enacted by a legislature.

Federal reserved (water) rights&nbsp;are created when the federal government withdraws land from the public domain to establish a federal reservation such as a national park, forest, or Indian reservation. Through this action, the government reserves water rights sufficient&nbsp;for the primary purpose for which the land was withdrawn.

Federal water rights must satisfy the administration and permitting process of the state in which the federal project is located. An important 1978 U.S. Supreme court case (California vs. United States) held that unless state law conflicts with clear congressional directives, the federal government must obtain water rights under state law for reclamation purposes.&nbsp;&nbsp;&nbsp;

This class of water rights is a judicial creation derived from Winters vs. United States&nbsp;(207 U.S. 564, 1908&nbsp;– Winters doctrine / rights) and subsequent federal case law, which collectively hold that when the federal government withdraws land from general use and reserves it for a specific purpose, the federal government by implication reserves the minimum amount of water&nbsp;unappropriated at the time the land was withdrawn or reserved&nbsp;to accomplish the primary purpose of the reservation. The right to such water is not lost by nonuse, and&nbsp;its priority date is the date the land was set aside.&nbsp;

The&nbsp;Public trust doctrine, based in Roman law, holds that certain resources belong to all the people and are therefore held in trust by the state for future generations. Since the 1970s, court rulings have expanded the concept of public trust to protect not only the traditional uses of navigation, commerce, and fishing, but also ecological preservation, open space maintenance, and scenic and wildlife habitat preservation. Public-trust uses must be considered and balanced when the rights to divert water away from&nbsp;navigable&nbsp;bodies of water are to be considered.

Therefore, in issuing or reconsidering any rights to appropriate or divert water, the state must balance public trust needs with the needs for other beneficial uses of water.

In the case of the&nbsp;National Audubon Society vs. Superior Court, (also known as Mono Lake case, California -&nbsp;Prior Appropriation vs. Public Trust Doctrine), the Court ruled that Mono Lake was subject to public trust doctrine and that the state could take back the City of Los Angeles’ 1940 appropriations if exercising the appropriations would harm the public trust. The City of Los Angeles had to give back 63 percent of its prior appropriation. So, water appropriations are revocable. Whenever the state determines that water diversions hurt the public trust, the state can revoke (or modify) and halt (or limit) the appropriations, and the appropriator is just out of luck.

Littoral water rights&nbsp;are the equivalent of&nbsp;riparian water rights&nbsp;for a lake, reservoir, or other non-flowing body of water. As with riparian water rights, littoral water rights allow persons who own land adjacent to a body of water to make reasonable use of those waters on lands within the watershed. Littoral users share the waters among themselves and the concept of priority use (prior appropriation doctrine) is not applicable. Under drought conditions, the lake or waterfront users also share shortages. Littoral rights cannot be sold or transferred to use on other (nonriparian) lands.

Prescribed water rights&nbsp;are water-use rights gained by trespass or unauthorized taking that ripen into a title, like rights to land gained through adverse possession. To perfect the right, the use of water must be adverse, hostile, open and continuous for five continuous years against the recognized water rights holder.

Nebraska duck and coot season clarified

OMAHA, Neb. (AP) — A new monthly survey of bankers points to a quickly recovering economy in rural parts of 10 Plains and Western states as the survey's individual indicators soared and the overall index rocketed to its highest reading since it began in 2006. 

The overall index of the Rural Mainstreet Survey shot up more than 18 points to 71.9 in March from February's 53.8. 

Any score above 50 suggests a growing economy. 

Creighton University economist Ernie Goss credits in part sharp gains in grain prices, federal farm support and the Federal Reserve’s record-low interest rates. 

Bankers from Colorado, Illinois, Iowa, Kansas, Minnesota, Missouri, Nebraska, North Dakota, South Dakota and Wyoming were surveyed.

During the summer of 2019, the beef industry experienced significant disruption when the beef plant in Holcomb, Kansas had a major fire. Then, during the spring of 2020, the beef industry again experienced significant disruption due to the COVID-19 Pandemic. These events have shown a bright light on the need for more capacity in the beef packing industry.

A group of cattlemen and investors, with deep Nebraska ties, have formed Sustainable Beef, LLC and seek to build a small regional plant in North Platte, Nebraska, to help the industry increase the beef supply pipelines that feed our nation and the world.

North Platte is centrally located in the lower 48 states as well as in the middle of the Sandhills, where some of the best calves in the nation are born and raised. Situated within one mile of I-80 and next to the city’s waste water treatment plant, makes this location ideal for processing and transportation.

A local rancher, Rusty Kemp, traveled with Governor Ricketts to Japan and Vietnam in the fall of 2019 and returned with the belief that Nebraska beef is highly regarded across the world, and we needed more capacity to insure our cattlemen had a place to process their livestock. The COVID-19 Pandemic confirmed his belief and started the discussions on how to achieve this goal.

The City of North Platte understands the importance of the cattle industry to the region and the economic benefits a new industry will have on the city. “From a strategic standpoint the project focuses on enhancing the area’s cattle industry, growing the area’s workforce and provides an opportunity to thrive in today’s global economy. These combined will undoubtedly contribute to the current and future successes of North Platte,” said Matthew Kibbon, City Administrator.

“Disruptions caused by fires, floods, and the current pandemic have reinforced the need for greater capacity to process Nebraska beef,” said Governor Pete Ricketts. “In response, a coalition of Nebraskans has established Sustainable Beef, a small plant in North Platte, to serve local ag producers. Our ranchers and feeders raise the best cattle anywhere in the world. Sustainable Beef will provide them with an excellent, local option to process livestock so that Nebraska beef can help feed even more people around the world. I applaud the initiative of Nebraska’s ag community to build this new beef plant,” said Governor Ricketts.

The proposed plant will exceed 300,000 square feet and cost more than $200 million to construct. Tax increment financing will be a necessary component for the required capital stack to make this project a reality. Sustainable Beef, LLC is working through the municipal process and hopes to break ground this fall and begin plant operations in early 2023. “Sustainable Beef is looking forward to working with the City of North Platte in building a new beef plant that will add value to the cattle industry and provide economic benefits to the region,” said Rusty Kemp.

“When you look at the North Platte area agriculture economy and the profound positive financial impact this will have, through major investment and job creation, it will truly help diversify our economy and build upon our natural economic strengths” said Gary Person, President &amp; CEO of North Platte Area Chamber &amp; Development Corporation.

Sustainable Beef has engaged Ernie Goss, one of the most respected Economists in the Midwest, to complete an Economic Impact Study that will demonstrate the substantial benefit this project will bring to Lincoln County. They have also engaged a team of beef processing plant professionals, Live Better Beef LLC, to assist in the long process from project concept to project completion. The new plant is budgeted to have a $50 million payroll and estimated annual economic impact on Lincoln County of $1 billion.

Eagle Radio Spring Auction sale bill 

CRAWFORD – At its March meeting, the Post Playhouse Board of Directors, in consultation with Producing Artistic Director Tom Ossowski, voted unanimously to cancel the 2021 theatrical season due to the ongoing pandemic and out of concern for the health and safety of the production team, performers, and audience members.

“While there are many positives as we anticipate an end to the pandemic, the organization cannot reasonably predict full audience attendance for a 2021 season,” Ossowski said.

Funds used to purchase tickets for the canceled 2020 season that were previously transferred to 2021 will now transfer to 2022.

At this time, the Post Playhouse expects to have a full 2022 season. Thanks to fiscally responsible decisions, the organization has withstood the financial toll of not receiving revenue for two theatrical seasons. However, the Post Playhouse still needs support, and is asking its patrons to consider donating to its annual fund. CRAWFORD – At its March meeting, the Post Playhouse Board of Directors, in consultation with Producing Artistic Director Tom Ossowski, voted unanimously to cancel the 2021 theatrical season due to the ongoing pandemic and out of concern for the health and safety of the production team, performers, and audience members.“While there are many positives as we anticipate an end to the pandemic, the organization cannot reasonably predict full audience attendance for a 2021 season,” Ossowski said.Funds used to purchase tickets for the canceled 2020 season that were previously transferred to 2021 will now transfer to 2022.At this time, the Post Playhouse expects to have a full 2022 season. Thanks to fiscally responsible decisions, the organization has withstood the financial toll of not receiving revenue for two theatrical seasons. However, the Post Playhouse still needs support, and is asking its patrons to consider donating to its annual fund. By TENA L. COOK, CSC Marketing Coordinator CHADRON – The Mari Sandoz High Plains Heritage Center will host a show of about 50 pieces by Rachel Brownlee, from March 17 to May 2. Most of the items will be charcoal drawings, however, the exhibit also features a few oil paintings, one watercolor, some calligraphy, and a steam punk style leather skirt and corset.

Brownlee, a great-great niece of Mari Sandoz, graduated from the University of Nebraska Omaha with a degree in Information Technology Innovation in 2015. The self-taught artist and contract software engineer lives on the JHL cattle ranch north of Ashby with her husband and young daughter.

She will be available to speak with the public during three artist-in-residence sessions 10 a.m. to 4 p.m. at the Sandoz Center: March 23, April 6, and May 11.

Holly Counts, who organized the exhibit, said Brownlee’s artwork is like the life and books of Sandoz, depicting western themes.

“Her work also includes Old World and fictional pieces, all of which are done in great detail. Rachel’s leatherwork comic-con outfit is reminiscent of Mari's love for fashion and brown attire," Counts said.

Brownlee was home schooled with her six siblings on her grandmother Celia (Sandoz) Ostrander’s Pine Creek Ranch about 20 miles south of Rushville. Brownlee’s father, Jules, is Celia’s son.

“There was no art education program so I just started drawing horses. One of my sisters had a how to draw horses book. She gave me a drawing pencil and that was kind of the start of my career,” Brownlee said. “It was such a special pencil that I almost never used it. I still have it.”

She said her artwork focuses on displaying the nitty gritty side of agriculture.

“Most of the time I feel like this lifestyle is portrayed quite pastorally. I feel the real value of displaying agriculture artistically is the depth of meaning behind it, which is the wrinkles, the sweat, the chipped spurs, the rusty bits, and that's what I try to portray in extreme realism. That’s my end goal,” Brownlee said

She had visited the Sandoz Center several times in the past, and called a few months ago to ask if there was interest in hosting a show of her work. In addition to completing commissioned pieces, she does software consulting, has a software product she developed, and helps on the ranch.

“It’s really neat to bring the current generation of Sandoz talent into this Center. Celia is 94 and talks about Mari all the time. She’s very concerned with maintaining both the history of Mari and the reputation of the family,” Brownlee said.

‘Shades of Light’ exhibit opens in Chadron

CHADRON – Registration opened Wednesday for student and employee volunteers, as well as jobsites for Chadron State College’s ninth annual The Big Event April 17.&nbsp;<a href="https://www.csc.edu/thebigevent/volunteerapp/index.csc" target="_blank">Volunteers</a>&nbsp;and&nbsp;<a href="https://www.csc.edu/thebigevent/jobsiteleaderapp/index.csc" target="_blank">jobsites</a>&nbsp;can register&nbsp;online. All Chadron businesses, churches, and residents are welcome to apply as jobsites.

The Big Event is a student-based, community service day designed to thank the community of Chadron. The CSC tradition started in 2013 with more than 400 volunteers and 15 job sites. The annual event attracts hundreds of CSC volunteers and various jobsites within Chadron and the surrounding area.

The Big Event staff are working closely college officials to follow Nebraska State College System COVID-19 guidelines including masks and social distancing to ensure a safe and effective event for all participants.

BILLINGS, Mont. (AP) — Attorneys general from 21 states are suing to overturn President Joe Biden's cancellation of the contentious Keystone XL oil pipeline from Canada. 

Led by Ken Paxton of Texas and Austin Knudsen of Montana, the states said in Wednesday's court filing that Biden overstepped his authority when he blocked the 1,200-mile long pipeline on his first day in office.

 The attorneys general say Congress should have the final say on the project. 

The pipeline would carry crude from western Canada's oil sands region to Gulf Coast refineries.

 Lawmakers gave the measure first-round approval with a 37-5 vote.

 The measure would create regulations to govern Nebraska casinos once they’ve opened. Casinos had been banned until voters approved a constitutional amendment in November to allow them. 

Some of the rules in the measure would prohibit patrons from using credit cards to play keno, and bars that offer the game could issue electronic tickets instead of paper tickets.

 It would also make clear that sports betting is allowed in the casinos.

SCOTTSBLUFF - Western Nebraska Community College Performing &amp; Visual Arts program will host its first live performance in over a year with the annual Spring Gala "A Lotta Fight Left in Me."

The 31st Annual Gala, featuring the WNCC Vocal Music program, will be held March 26 and 27 at the Gering Civic Center. Performances and dinner will begin at 6:30 p.m. each evening with doors opening for social hour at 6 p.m. For those who prefer to stay home, a livestream of each performance will be available starting at 6:30 p.m., and to-go meals can be picked up at the Gering Civic Center at 6 p.m.

"I have been reflecting on the past year, in which everything has been affected by the pandemic,” WNCC Vocal Music Instructor Dr. Patrick Newell said. "So many of us have lost so much – businesses, jobs, the passing of loved ones, or even just the freedom of travel and spending time together. We’re making progress, but we have to believe in a better future and fight for it. One day last fall, driving through the smoke from the wildfires in Wyoming, the Rachel Platten song came on the radio and I knew that had to be our theme."

WNCC Varsity Vocalise and Collegiate Chorale will perform songs such as "Stronger" from the Broadway Musical&nbsp;Finding Neverland, “A Thousand Years" written for&nbsp;The Twilight Saga, and classical selections by contemporary composers Kyle Pederson and André&nbsp;Thomas. The program will be filled out by soloists from the choirs, and include songs from the Broadway Musicals&nbsp;A Chorus Line,&nbsp;Spring Awakening, and&nbsp;Catch Me If You Can.

The audience is asked to observe social distancing protocols and masking before and after dinner. The choir will be masked during performances, although soloists will be unmasked. This year’s show will be shorter than usual, lasting about an hour, to limit time in the space.

Tickets are on sale now for $30, which include dinner and the show.&nbsp;&nbsp;Meals to-go are $24 and can be picked up at the front entrance to the Gering Civic Center at 6 p.m. Tickets must be purchased by March 25. WNCC to hold annual Spring Gala in-person

NORTH PLATTE&nbsp; — Investigators with the Nebraska State Patrol have arrested an Imperial man following an investigation into child pornography.

On Tuesday, March 16, investigators arrested Bill Whitlow, 53, of Imperial, for possession and distribution of child pornography. The investigation began when NSP received a cyber tip from the National Center for Missing and Exploited Children.

Investigators served a search warrant on a residence at 211 W. 5th&nbsp;Street in Imperial last week. That search resulted in the discovery of child pornography possessed by Whitlow. Whitlow was lodged in Chase County Jail.

In this campaign, troopers performed high-visibility patrols in an effort to maintain safe roadways for the large number of travelers from around Nebraska going to and from Lincoln for the NSAA&nbsp;basketball&nbsp;tournaments.

During the week of the boys&nbsp;state&nbsp;tournaments, troopers made 22 arrests for driving under the influence. In addition to those arrests, troopers also issued citations for speeding (292), driving under suspension (36), no proof of insurance (30), minor in possession (9), open alcohol container (8), no seat belt (11), and improper child restraint (4).

Throughout the enforcement effort, troopers also assisted 301 motorists in need of help on Nebraska roadways. This effort was made possible thanks in part to a grant for $11,328 from the Nebraska Department of Transportation - Highway Safety Office.

More than half a million Americans, including 186 Panhandle residents, have died of COVID-19 in the last year. Thankfully the COVID-19 vaccination will&nbsp;greatly reduce your risk of&nbsp;getting the virus, and you don’t have to pay anything to receive it.

Stopping a pandemic requires using all the tools we have available. We have all been asked to wear masks and practice social distancing to help reduce the chance of being exposed to the virus or spreading it to others. These measures are not enough to end the coronavirus pandemic. Now it is time for Americans to be vaccinated. There are three vaccines available, and all three are safe and effective.

Vaccines work with your immune system, so your body will be ready to fight the virus if you are exposed. If you do get sick from COVID-19, it will be a much milder case.&nbsp;As of March 8, 13,958 or 21.3% of Panhandle adults have received the COVID vaccine.

Many people say they will not get the vaccine because there are side effects. That is true, but these side effects indicate the vaccine is working. Most of the reactions are temporary and pass within a few days, according to the U.S. Centers for Disease Control and Prevention (CDC). Since you may feel under the weather, experts recommend not making any big plans for a few days after you get a dose of the vaccine.&nbsp;Realize that most people don’t have any side effects at all.

The most commonly reported side effects are pain and swelling at the injection site and fatigue. There have been some reports of headache, chills, low fever, muscle and joint pain, nausea, or swollen lymph nodes. &nbsp;The CDC advises against the use of pain relievers&nbsp;before&nbsp;vaccination. But if you are having side effects afterwards you can take acetaminophen or ibuprofen.

Nebraskans over the age of 18 are encouraged to register now for their COVID vaccine at&nbsp;<a href="http://vaccinate.ne.gov/" target="_blank">vaccinate.ne.gov</a>&nbsp;or by calling 833-998-2275 or 531-249-1873. Vaccine&nbsp;phases are directed by state and federal COVID Vaccine Programs and doses&nbsp;are going to the most vulnerable first.

When you register, you will fill out a short questionnaire which sorts you into a group or phase. When it is time for the group or phase to schedule, a notification email will be sent for you to schedule an appointment, or a local vaccine administrator will call individuals to schedule appointments.

The projects, worth about $140,000, are supported by the Capital Maintenance Fund, implemented by the Nebraska Legislature in 2016.

At Medicine Creek State Recreation Area, repairs to the existing retaining wall at Trail 4’s Shady Bay campground swim beach area were completed last year. The retaining wall, which serves as a shoreline protection feature, was severely damaged from years of wave-action erosion and posed a safety hazard. A new day-use and shoreline access area also was created at Trail 4½, a spur off Trail 4 leading to the boat ramp. Nebraska Game and Parks Commission Park Cash Funds made the improvements possible.

At Shady Bay Campground in 2019, 33 electric campsites were upgraded with new 20/30/50 amp pedestals; four new water hydrants and waterlines were installed; and 20 paved campsite pads were extended as part of this project. The $80,000 project was a 50/50 cost share between the U.S. Department of Interior Bureau of Reclamation and Game and Parks. The Bureau of Reclamation owns Harry Strunk Lake, more commonly known as Medicine Creek, but the recreation area is managed by Game and Parks.

Improved camping tops list of west-central Nebraska park investments

The editorial board of the Omaha World-Herald would lead one to believe that marijuana legalization is inevitable. However, by not legalizing marijuana in Nebraska we get the benefit of having a decade of research on marijuana use. Evidence demonstrates the many dangers marijuana legalization poses to our kids including anxiety, mental health, cognitive impairment, poor academic performance, suicide and psychosis.

Johnny Stack was from a suburban Colorado family who loved him. He had a happy life and a 4.0 GPA. Unfortunately, when Johnny was 14, the state of Colorado legalized marijuana. He started to “dab” marijuana that year as a freshman in high school. Three days before he died by suicide on Nov. 20, 2019, at the age of 19, he told his mom, “I want you to know you were right. You told me marijuana would hurt my brain. It’s ruined my mind and my life, and I’m sorry. I love you.”

An editorial by the Denver Post last week detailed how Colorado doctors are seeing an alarming spike in young patients suffering psychosis due to high-potency marijuana concentrates. This was a trend they admit they were skeptical of initially. The paper points to peer-reviewed research from top medical journals to back up their conclusion that high-potency marijuana poses a substantial risk to Coloradans’ mental health.

This led the Denver Post to call for regulation of marijuana like other harm-causing food, medicine or recreational drug such as caffeine, tobacco and grain alcohol. This is why I continue to urge Nebraskans to support the FDA process for the use of marijuana.

Marijuana was the most common substance present in recent data on Colorado adolescent suicides for ages 10–19. In 2016 in Colorado where toxicology data was available, marijuana was present in 31% of adolescent suicides compared to 10% for alcohol. This trend has been increasing since legalizing marijuana and is of serious concern because suicide is currently the leading cause of death of adolescents in Colorado.

Actual physical changes in the grey matter of young marijuana users has been documented. Frequent marijuana use is associated with cognitive and learning impairment, as well as poor academic performance. Increased marijuana use is associated with greater risk of depression and suicidal thoughts. And while pot advocates love to mock the “Reefer Madness” of the ’70s, the evidence is clear that use of high-THC marijuana, especially at a young age, is linked with the development of psychosis.Although no state allows the sale of marijuana to anyone under 21, the increased commercial availability of high-potency marijuana and THC products readily find their way into the hands of kids. In the Monitoring the Future Survey, almost one in 15 eighth graders used marijuana or THC in the last month, while almost one in 15 high school seniors use one of those daily.High THC use by youth is akin to playing Russian Roulette. Young adults are risking their brains abusing almost pure doses of psychoactive THC in gummies, drinks, dabs and vapes. These products are marketed directly to them on social media and packaged for youth appeal.The experience of other states has shown us what happens when states normalize the use of this Schedule 1 drug and increase access to high potency marijuana products. There is a recent study in the Journal of Studies on Alcohol and Drugs of over 3 million kids in seventh, ninth and 11th grades in California both before and after the state legalized recreational marijuana in 2016. It observed a 23% increase in past 30-day use among teens after legalization. The greatest increases were seen among the youngest kids — seventh graders.It is irresponsible for lawmakers and thought leaders to ignore the growing body of evidence about the marijuana industry marketing to youth, accessibility to kids in states with legalization, and severe and long-term negative impacts on our kids.
