SIOUX FALLS, S.D. (AP) — The group that campaigned to legalize recreational marijuana in South Dakota through a voter-backed constitutional amendment has filed in court to defend the amendment in a legal challenge brought by two law enforcement officers.

 South Dakotans for Better Marijuana Laws organized a successful effort to pass a constitutional amendment legalizing cannabis for adults, as well as its commercial regulation and use by minors for medical needs. 

The amendment was approved by 54% of voters on Election Day. 

But two law enforcement officers have brought a lawsuit arguing the amendment is not legal because it covers more than one subject.

OMAHA, Neb. (AP) — A Nebraska hospital is mourning the death of a nurse who died of the coronavirus as cases surge across the state.

This year’s program ran from June 1, 2020 to October 31, 2020. “This was an unconventional year for the Passport Program, but it ended up providing people with an opportunity to still explore the state at a level they were comfortable with and in a socially distant way,” said Madison Johnson, Nebraska Passport program coordinator. “I’m happy that this program was able to provide some positivity and support to local businesses during a difficult year.” 2020 Nebraska Passport Statistics: •&nbsp;&nbsp; &nbsp;From submitted Passports, 205,229 total stamps were collected.&nbsp; •&nbsp;&nbsp; &nbsp;The average number of stamps submitted per participant was 28.&nbsp; •&nbsp;&nbsp; &nbsp;Participants included residents from 460 Nebraska communities and 40 states. •&nbsp;&nbsp; &nbsp;Passport participants ranged in age from 6 months to 94-years-old. •&nbsp;&nbsp; &nbsp;Participants submitted over 850 stories of their travels on&nbsp;<a href="http://nebraskapassport.com/" target="_blank">nebraskapassport.com</a>. CASPER, Wyo. (AP) — Officials in northern Wyoming have voted to remove Dr. Ed Zimmerman from his position as Washakie County health officer. 

Zimmerman says he believes it happened in response to the mask mandate he implemented. 

The Casper Star-Tribune reports that Washakie County Commission Chair Fred Frandson said Tuesday that Zimmerman’s departure was not a result of the local mask mandate. 

But Frandson said he could not discuss why Zimmerman was removed because the county does not publicly discuss personnel matters. 

Zimmerman says several health officials were worried they could lose their jobs by implementing a mask mandates.

The Knight Museum ands Sandhills Center annual Christmas Festival has been cancelled this year due to COVID-19.

In a news release the museum said, "We are just as disappointed as everyone else is, but feel this is the right thing to do for our community. Next year will be the 25th year for the Festival and we plan to go all out."

Knight Museum cancels annual Christmas Festival 

RAPID CITY, S.D. (AP) — A former Rapid City priest has pleaded not guilty to federal charges alleging he had sexual contact with a minor and possessed child pornography. 

Forty-two-year-old Marcin Garbacz entered his not guilty plea Tuesday.

 It was Garbacz's second court appearance in two days. Earlier this week, he was sentenced to nearly eight years in prison following his conviction on 65 financial crimes related to the theft of nearly $260,000 in cash donations from the diocese. 

Court records show an FBI agent came across child pornography on one of Garbacz’s thumb drives while investigating the the financial crimes.

AVFD sends Thanksgiving greeting, urges citizens to wear a mask

CHEYENNE, Wyo. (AP) — Wyoming Gov. Mark Gordon says he's tested positive for COVID-19. 

Gordon made the announcement Wednesday, saying he had only minor symptoms and plans to continue working remotely. 

The governor's office at the Wyoming State Capitol was closed on Tuesday for a deep cleaning after another office employee tested positive for the respiratory virus. 

The Centers for Disease Control and Prevention recommends people with COVID-19 isolate themselves for 10 days after the onset of symptoms. 

Less than two weeks ago, Gordon said Wyoming residents needed to be more responsible about preventing the spread of COVID-19 and that he was considering additional public health orders.

Grand Island and La Vista voted Tuesday to approve mask mandates, joining the likes of Omaha, Lincoln, Norfolk, Beatrice and Ralston. Gov. Pete Ricketts has rejected issuing a statewide mandate because he believes it would generate resistance. 

The number of people hospitalized with the coronavirus decreased slightly on Tuesday, to 936, but the total remains close to the point at which Ricketts said he would impose more social distancing restrictions.

The Knight Museum and Sandhills Center in Alliance had success with their&nbsp;“Harry Potter Adventures in Diagon Alley” exhibit and donated thousands of dollars to local non-profit organizations.&nbsp; The Harry Potter exhibit ran from Oct. 25 through Nov. 7.&nbsp;Kim and Max Galyen, with help from family and friends, crafted most of the Harry Potter shops and props from scratch. Approximately $4,000 of free will donations collected from the exhibit were divided among CAPStone Child Advocacy Center, Community Table, The Food Pantry and Diaper Depot. "We knew we would have several people in," said&nbsp;Jody Ringbauer, Knight Musuem and Sandhills Center Project Support Clerk. "But we had no idea the amount of money, donations and food that was brought in. It was unbelievable." Between 4,000 and 4,500 people visited the museum to enjoy the Harry Potter exhibit. There was a family from Texas that drove 14 hours to check out Diagon Alley, and several visitors from Rapid City and Denver.&nbsp; "You don't realize how many people that actually live in this community...do not know the museum we have here," said Ringbauer. "And the quality that it is and that was nice to have those people coming in." The Punishers and Guardian Bells motorcycle clubs helped the museum distribute funds to the non-profits. "Those were the people that came in and helped take the money at night and donations," Ringbauer added. "They were the ones that actually went out and purchased...[items needed by] CAPstone, they can't receive monetary donations so we went out and got different items they had on their wishlist. " The Knight Museum and Sandhills Center said they would like to thank everyone who helped raise funds including Becky Maser from the Grocery Kart.&nbsp; The museum plans on bringing back the exhibit next year.&nbsp; &nbsp;

"They were the ones that actually went out and purchased...[items needed by] CAPstone, they can't receive monetary donations so we went out and got different items they had on their wishlist. NORFOLK&nbsp; — Troopers from the Nebraska State Patrol and Iowa State Patrol will be teaming up to keep travelers safe on both sides of the Missouri River this Thanksgiving.

NSP and ISP will conduct simultaneous patrol operations on many thoroughfares in northeast Nebraska and northwest Iowa as part of the effort. The high-visibility enforcement campaign will run from Wednesday, November 25, through Sunday, November 29.

“Nebraska State Troopers work tirelessly to keep roads safe, but the effort doesn’t stop at the Nebraska border,” said Captain Dain Hicks, Commander of Troop B, which encompasses northeast Nebraska. “Our partnership with the Iowa State Patrol is designed to maintain safe roads for all motorists traveling in the area this Thanksgiving.”

“The Iowa State Patrol is dedicated to reducing fatal and serious crashes by focusing our attention on the most common factors; excessive speed, impaired drivers, distracted driving, and seatbelt use,” said Lieutenant Mindy L. Coe, Iowa State Patrol – District 5. “As we team together, it is our hope that travelers will keep these factors in mind this Holiday season and arrive at their destinations safely.”

It’s that time of year when we will begin seeing those red kettles and Salvation Army bell ringers at area stores. The Salvation Army Red Kettle Campaign for Box Butte County starts December 1 and runs through December 23.&nbsp;It’s our chance to make the holidays brighter for someone in need.

Red kettle donations stay local – directly impacting the lives of our neighbors by helping them in their time of need.&nbsp; The funds raised by Salvation Army bell ringers make a year-round impact to our community through grocery, prescription, and utility assistance. Some funds are used for motel rooms, medical gas vouchers, emergency services, and stranded motorist assistance.&nbsp;Funds serve residents of Box Butte County and are distributed by Northwest Community Action Partnership and the Alliance Police Department.

The Salvation Army is seeking volunteers to ring bells at three kettle locations in Alliance: Grocery Kart, Dollar General on Flack Avenue, and Carter’s Home, Hardware&nbsp;&nbsp;&amp; Appliance.&nbsp;The Salvation Army will have miniature Red Counter Kettles that will be located at J&amp;Js Pitstop, Git’N Split, and Grocery Kart Alcohol as well.&nbsp;

Poverty In Our Area: The Salvation Army 

LINCOLN, Neb. (AP) — The coronavirus pandemic is prompting a change in plans for the University of Nebraska’s $155 million football training facility project. 

The Lincoln Journal Star reports that the Board of Regents on Dec. 4 will hear a plan to split the project into two phases.

 Phase 1 calls for completing the new building “with shelled space at the base of a new North Stadium tower.” 

Phase 2 will build out the Academic Center and training area in the new building, and calls for the completion of renovations at the Hawks Championship Center.

It’s fitting to set aside time each year to express gratitude to God and to one another for the many blessings we enjoy.&nbsp; In seasons of peace and plenty, as well as in times of war and loss, Americans have faithfully carried on Thanksgiving traditions.&nbsp; During challenging times, it’s even more important to remember the abundant blessings we enjoy as Americans.

In 2001, President George W. Bush issued a Thanksgiving proclamation a couple months after the tragic September 11th&nbsp;terrorist attacks.&nbsp; The sentiments he expressed ring true this year in light of the coronavirus pandemic.

“During these extraordinary times, we find particular assurance from our Thanksgiving tradition, which reminds us that we, as a people and individually, always have reason to hope and trust in God, despite great adversity....In thankfulness and humility, we acknowledge, especially now, our dependence on One greater than ourselves. &nbsp;On this day of Thanksgiving, let our thanksgiving be revealed in the compassionate support we render to our fellow citizens who are grieving unimaginable loss; and let us reach out with care to those in need of food, shelter, and words of hope. &nbsp;May Almighty God, who is our refuge and our strength in this time of trouble, watch over our homeland, protect us, and grant us patience, resolve, and wisdom in all that is to come.”

As we finish 2020, let’s draw strength from the example of previous American generations who have overcome war, economic depression, disaster, and even pandemics.&nbsp; Let’s use our Nebraska grit to slow the spread of the virus as we get through this together.&nbsp;

At Thanksgiving time, we usually join with friends and family for a large meal of turkey, cranberry sauce, and pumpkin pie.&nbsp; This year, Nebraskans are holding smaller gatherings—or getting together virtually—to slow the spread of coronavirus.&nbsp; Even if you’re unable to gather with family this holiday, find a way to stay connected by phone or video.&nbsp; It’s important for us to support one another as we cope with the disruptions of the coronavirus.

Although Thanksgiving in 2020 may look different for you, there are still plenty of reasons to give thanks.&nbsp; Here are a few that come to mind for me. &nbsp;As Americans, we’re blessed to live in a time of relative peace.&nbsp; Even with the disruptions of the coronavirus, we enjoy prosperity that would have been unimaginable to the Pilgrims who landed at Plymouth Rock.&nbsp; Our Constitution allows for us to exercise many freedoms: religious freedom, freedom of the press, and the freedom of speech.&nbsp; Many military servicemen and women put their lives on the line every day to protect our Republic and these freedoms.&nbsp; We are grateful for their service and sacrifice.

Our free country and free enterprise system have given us great prosperity.&nbsp; In the midst of this pandemic, we’re blessed with technology to connect with loved ones living far away.&nbsp; We’re blessed to have excellent health care.&nbsp; We’re blessed to live in a scientifically advanced country with the capability of rapidly developing vaccines.

Despite the pandemic, Nebraska is expected to experience a bountiful harvest this year.&nbsp; Nebraska’s corn growers are forecasted to bring in a record of 1.82 billion bushels.&nbsp; Soybean production is up 5% from last year to about 300 million bushels.&nbsp; The sorghum crop of 12.4 million bushels is also projected to exceed last year’s numbers.&nbsp; Dry edible bean production is forecasted to be up 85% from 2019, and sugar beet production is expected be 38% higher than last year.

This year, we are especially grateful for our healthcare workers. &nbsp;Nurses, doctors, hospital staff, and public health leaders are on the front lines working long hours to help Nebraskans stay healthy during the pandemic.&nbsp; As we enter this holiday season, our hospitals are counting on Nebraskans to be smart in their social interactions to help slow the spread of coronavirus.&nbsp; We all need to do our part to help them by wearing a mask, washing our hands often, and watching our distance.&nbsp; Nebraskans are hard-working folks, and we don’t like to be on the sidelines.&nbsp; It’s critically important, however, for everyone to stay home when sick to slow the spread of the coronavirus.

Our Local Health Departments tell us the virus is spreading at informal gatherings, usually in people’s homes.&nbsp; As you think about celebrating the holidays, please keep gatherings small and avoid the “Three Cs”, even in private settings.&nbsp; Avoid&nbsp;crowded places&nbsp;where you can’t practice social distancing.&nbsp; Avoid&nbsp;close contacts&nbsp;where you’re within six feet of someone for 15 minutes or more.&nbsp; And avoid&nbsp;confined spaces&nbsp;with poor ventilation.&nbsp; Using these tools is the best way to support our healthcare workers and protect our hospitals.

Gov. Ricketts: Giving thanks in adversity

Two additional COVID-related deaths are being reported in the Panhandle. A Cheyenne County female in her 70s and a Kimball County female in her 90s have both recently passed away. This brings the total deaths in the Panhandle to 49.

“We wish to express our sincerest condolences in the passing of two Panhandle residents.&nbsp;We send their friends and loved ones peace and comfort during their time of loss,” expressed Kim Engel, Panhandle Public Health District Director.

We understand people may be experiencing pandemic fatigue, but this is the year to be as safe as possible for your family, friends, loved ones, and our most vulnerable community members. It takes all of us to break the transmission cycle.

There will come a time when standard family get-togethers will be safe again but this isn’t the time, unfortunately. Zoom is lifting its 40-minute time limit for free meetings on Thanksgiving. What a perfect way for people to connect via distance. It’s important to remember that the act of staying apart is the act of love this year.

An activity we are encouraging people to do is to engage in a conversation with your friends and loved ones, safely via phone call, video chat, or social media, to share what each is grateful for and mindful of. People’s mental health is just as critical as their physical health, we need people to feed that innate desire for connecting (safely, of course). Please be safe this Thanksgiving holiday.

By PPHDTwo additional COVID-related deaths are being reported in the Panhandle. A Cheyenne County female in her 70s and a Kimball County female in her 90s have both recently passed away. This brings the total deaths in the Panhandle to 49.“We wish to express our sincerest condolences in the passing of two Panhandle residents.&nbsp;We send their friends and loved ones peace and comfort during their time of loss,” expressed Kim Engel, Panhandle Public Health District Director.We understand people may be experiencing pandemic fatigue, but this is the year to be as safe as possible for your family, friends, loved ones, and our most vulnerable community members. It takes all of us to break the transmission cycle.There will come a time when standard family get-togethers will be safe again but this isn’t the time, unfortunately. Zoom is lifting its 40-minute time limit for free meetings on Thanksgiving. What a perfect way for people to connect via distance. It’s important to remember that the act of staying apart is the act of love this year.An activity we are encouraging people to do is to engage in a conversation with your friends and loved ones, safely via phone call, video chat, or social media, to share what each is grateful for and mindful of. People’s mental health is just as critical as their physical health, we need people to feed that innate desire for connecting (safely, of course). Please be safe this Thanksgiving holiday.<ul>

PPHD: Safe opportunities to connect during the Thanksgiving holiday 

LINCOLN, Neb. (AP) - A Nebraska prison inmate who had COVID-19 and other medical problems has died.

<a href="https://omaha.com/news/local/crime-and-courts/nebraska-prison-inmate-with-covid-19-dies-in-hospital/article_f484de95-5a3e-577d-9ebc-6a6ea58f6548.html" target="_blank">The Omaha World-Herald</a>&nbsp;reports that the inmate, who was in his 70s, died Monday at a hospital in Lincoln. The inmate's name was not released.

The cause of death has not been determined. A grand jury will investigate the cause of death.

Corrections Director Scott Frakes said the inmate was serving time for first-degree murder, assault and a weapons conviction out of Douglas County. The man tested negative for COVID-19 when he was admitted to the hospital last month, but recently tested positive.

At least four other Nebraska inmates with COVID-19 have died since the onset of the pandemic.

Nebraska prison inmate with COVID-19 dies

PAPILLION, Neb. (AP) — Sarpy County plans to put up a permanent memorial for two young Nebraska boys who were brutally murdered in 1983. 

The Sarpy County Sheriff's Office said in a news release Monday that the memorial will serve as a reminder of their lives and represent the county’s commitment to seeking justice for crime victims. 

Thirteen-year-old Danny Joe Eberle was delivering newspapers for the Omaha World-Herald when he went missing on Sept. 18, 1983. 

His body was found a few days later in rural Bellevue, Nebraska. 

Twelve-year-old Christopher Walden went missing while walking to school on Dec. 2, 1983. 

It was the first day his mother allowed him to do so since Eberle’s murder. His body was recovered on Dec. 5.

The American Civil Liberties Union filed the federal lawsuit on Monday against Noah’s Ark Processors in Hastings, Nebraska. 

The lawsuit says the plant has made no effort to spread workers out to limit the spread of the virus, and it fails to promptly replace workers’ masks when they become soiled with blood and sweat. 

Company officials declined to comment Monday.

 The meatpacking industry has been hit hard by the coronavirus pandemic because workers often stand shoulder-to-shoulder.

LINCOLN, Neb. (AP) — Nebraska reported one of the lowest numbers of new virus cases this month on Sunday, but the number of people hospitalized with the virus remains high and continues to strain hospital capacity in the state.

 The state reported 1,032 new virus cases Sunday. 

That was less than half of the seven-day rolling average of daily new cases in the state, which was 2,313.57. 

State data shows that 976 people were being treated for COVID-19 in the state’s hospitals, occupying 23% of the state’s hospital beds.

 The threshold of 25% that will trigger more social distancing restrictions from the state.

Ricketts warns imminent restrictions amid hospitalizations

BRADY, Neb.-A man wanted for a parole violation and who may possibly be connected to the death of a 71-year-old man in Colorado may be in Nebraska.

The body of 71-year-old Randall Schubert was found on November 5 in Longmont, Colorado.

Police in Longmont have identified 36-year-old Edward Herbert Hoid as a person of interest in the case.

Longmont police say Hoid had been living in Lyons, Colorado, but they say he may currently be residing in Brady, Nebraska.

Hoid is described as a white male, 6' tall, weighing 180 pounds, and has brown hair and blue eyes.

Police say Hoid should be considered armed and dangerous and should not be approached. Anyone who sees Hoid should contact local law enforcement immediately.&nbsp;

Hoid is currently wanted on a parole violation and has not been charged with any crime in the death of Schubert.

The City of Alliance will not be picking up blue yard waste roll out bins or dumpsters this week due to trash truck issues. 

According to a news release, the City of Alliance will be grabbing household refuse. They are hopeful to be back to regular scheduled routes next week.
