Maxwell man sentenced to prison for sexual assault of minor

NORTH PLATTE, Neb.-A Maxwell man has been sentenced to prison for sexually assaulting a minor. 

According to online court records, Drake Baller, 21, appeared for sentencing in Lincoln County District Court on Monday.

Baller was convicted of sexually assaulting a then 15-year-old girl after pleading no contest to amended charges.

The girl told authorities that she had voluntarily gone to Haythorn Ranch in Maxwell to meet Baller in November of 2019.

The girl stated that they went to a bunkhouse on the ranch where they engaged in sexual intercourse. The girl told authorities that, during intercourse, she told Baller "no" and "stop," but he refused.

Baller originally faced two counts of sexual assault of a minor and one count of forcible sexual assault of a minor. As part of a plea deal, two of the charges were dropped.

Judge Richard Birch sentenced Baller to four to eight years in prison on one count of 1st-degree sexual assault of a minor. He was given credit for 92 days already served in jail.

Baller must also register as a sex offender.
