Grand Jury for the District of Nebraska

United States Attorney Susan Lehr announced the federal Grand Jury for the District of Nebraska has returned nine (9) unsealed Indictments charging ten defendants. Indictments are charging documents that contain one or more individual counts that are merely accusations, and every defendant is presumed innocent unless and until proven guilty.

Scott D. Nelson, age 53, of Council Bluffs, Iowa, is charged in a two-count Indictment.  Count I charges Nelson with sex trafficking of a minor on or about December 1, 2023, through August 9, 2024.  The maximum possible penalty if convicted not less than 10 years’ and up to life imprisonment, a $250,000 fine, a term of supervised release of not less than five years and up to a life, and a $100 special assessment.  Count II charges Nelson with sexual exploitation of children on or about December 1, 2023, through August 9, 2024.  The maximum possible penalty if convicted not less than 15 years’ and up to 30 years’ imprisonment, a $250,000 fine, a term of supervised release of not less than five years and up to a life, and a $100 special assessment. 

Mike Marquez, age 42, of Omaha, Nebraska, is charged with distribution of fentanyl resulting in death on or about June 23, 2024.  The maximum possible penalty if convicted is not less than 20 years’ and up to life imprisonment, a $10,000,000 fine, a term of supervised release of not less than three years and up to life, and a $100 special assessment.   

Clayton Reynolds, age 31, of Omaha, Nebraska, is charged in an eight-count Indictment.  Count I charges Reynolds with distribution of fentanyl on or about April 8, 2024. The maximum possible penalty if convicted is up to 20 years’ imprisonment, a $1,000,000 fine, a term of supervised release of not less than three years and up to life, and a $100 special assessment.  Count II charges Reynolds with distribution of fentanyl on or about April 23, 2024. The maximum possible penalty if convicted is up to 20 years’ imprisonment, a $1,000,000 fine, a term of supervised release of not less than three years and up to life, and a $100 special assessment.  Count III charges Reynolds with possession of a firearm during a drug trafficking crime on or about April 23, 2024. The maximum possible penalty if convicted is not less than 5 years’ and up to life imprisonment, a $250,000 fine, a term of supervised release of not more than five years, and a $100 special assessment.  Count IV charges Reynolds with distribution of fentanyl on or about June 12, 2024. The maximum possible penalty if convicted is up to 20 years’ imprisonment, a $1,000,000 fine, a term of supervised release of not less than three years and up to life, and a $100 special assessment.  Count V charges Reynolds with distribution of fentanyl on or about June 26, 2024. The maximum possible penalty if convicted is up to 20 years’ imprisonment, a $1,000,000 fine, a term of supervised release of not less than three years and up to life, and a $100 special assessment.  Count VI charges Reynolds with distribution of fentanyl on or about July 15, 2024. The maximum possible penalty if convicted is up to 20 years’ imprisonment, a $1,000,000 fine, a term of supervised release of not less than three years and up to life, and a $100 special assessment.  Count VII charges Reynolds with possession with intent to distribute 500 grams or more of methamphetamine on or about July 22, 2024. The maximum possible penalty if convicted is not less than 10 years’ and up to life imprisonment, a $1,000,000 fine, a term of supervised release of not less than three years and up to life, and a $100 special assessment.  Count VIII charges Reynolds with possession of a firearm during a drug trafficking crime on or about July 22, 2024. The maximum possible penalty if convicted is not less than 5 years’ and up to life imprisonment, a $250,000 fine, a term of supervised release of not more than five years, and a $100 special assessment.

Bany Nyuon, age 33, of Omaha, Nebraska, is charged with escape on or about August 4, 2024.  The maximum possible penalty if convicted is up to 5 years’ imprisonment, a $250,000 fine, a 3-year term of supervised release, and a $100 special assessment. 

Brian S. Castillo, age 23, of Bronx, New York, is charged in a three-count Indictment.  Count I charges Castillo with conspiracy to commit bank fraud beginning no later than January 3, 2023, and continuing to July 30, 2024.  The maximum possible penalty if convicted is not more than 30 years’ imprisonment, a $1,000,000 fine, a term of supervised release of not more than 5 years, and a $100 special assessment.  Count II charges Castillo with mail fraud from on or about January 2023, through on or about July 30, 2024.  The maximum possible penalty if convicted is not more than 20 years’ imprisonment, a $250,000 fine, a term of supervised release of not more than 3 years, and a $100 special assessment.  Count III charges Castillo with money laundering from on or about December 2023, through on or about May 18, 2024.  The maximum possible penalty if convicted is not more than 20 years’ imprisonment, a $500,000 fine or twice the value of the property involved in the transaction, whichever is greater, a term of supervised release of not more than 3 years, and a $100 special assessment. 

Sonia Martinez, age 39, and Andrew Juarez, age 36, both of Scottsbluff, Nebraska, are charged in a two-count Indictment.  Count I charges Martinez and Juarez with conspiracy to distribute more than 50 grams of methamphetamine beginning on or about January 24, 2024 and continuing to on or about May 9, 2024.  The maximum possible penalty if convicted is not less than 15 years’ and up to life imprisonment, a $20,000,000 fine, a term of supervised release of not less than 10 years, and a $100 special assessment.  Count II charges Martinez and Juarez with use and carry of a firearm in furtherance of a drug trafficking crime on or about January 24, 2024.  The maximum possible penalty if convicted is not less than 5 years’ and up to life imprisonment, a $250,000 fine, a term of supervised release of not more than 5 years, and a $100 special assessment. 

Cleophus Collier, age 34, of Lincoln, Nebraska, is charged with possession of a firearm by a prohibited person on or about June 10, 2024.  The maximum possible penalty if convicted is not more than 15 years’ imprisonment, a $250,000 fine, a term of supervised release of not more than 3 years, and a $100 special assessment.   

Michael E. Scott, age 60, of Murray, Nebraska, is charged in a three-count Indictment.  Count I charges Scott with distribution of child pornography on or about January 9, 2024.  The maximum possible penalty if convicted is not less than 15 years’ and up to 40 years’ imprisonment, a $250,000 fine, a term of supervised release of not less than 5 years and up to life, and a $100 special assessment.  Count II charges Scott with distribution of child pornography on or about January 17, 2024.  The maximum possible penalty if convicted is not less than 15 years’ and up to 40 years’ imprisonment, a $250,000 fine, a term of supervised release of not less 5 years and up to life, and a $100 special assessment.  Count III charges Scott with possession and access with intent to view child pornography on or about July 25, 2024.  The maximum possible penalty if convicted is not less than 10 years’ and up to 20 years’ imprisonment, a $250,000 fine, a term of supervised release of not less than 5 years and up to life, and a $100 special assessment. 

Angela Marie Bryant, age 45, of Lincoln, Nebraska, is charged with possession with intent to distribute 50 grams or more of meth on or about April 2, 2024.  The maximum possible penalty if convicted is not less than 10 years’ and up to life imprisonment, a $1,000,000 fine, a term of supervised release of not less than 5 years and up to life, and a $100 special assessment.
