A Kansas man charged in the motor vehicle death of an Alliance woman has waived his right to a Preliminary Hearing and has been bound over to District Court for trial.
Ryan McElroy, 36, appeared in Box Butte County Court Thursday morning with his legal counsel, Stacy Bach of Scottsbluff. Ms. Bach is serving as court appointed counsel as McElroy cannot afford to hire an attorney.
Judge Paul Wess set McElroy’s District Court appearance for April 27 at 1:30 pm. At that time, McElroy will enter his plea and a future court date will be set.
McElroy is charged with felony counts of Manslaughter and Motor Vehicle Homicide as well as misdemeanor counts of Third Offense DUI and Willful Reckless Driving. McElroy’s vehicle was allegedly traveling in the wrong lane when he collided head on with 22-year-old Blythe Boness of Alliance.
Boness, a 2019 graduate of Alliance High Schools, was pronounced dead at the scene. The collision occurred a few miles east of Alliance on Highway 2 on Sunday, April 10.
McElroy remains housed in the Box Butte County Jail on 10% of a $100,000 bond.
Now that the case has entered District Court, prosecution will be handled by the Nebraska Attorney General’s Office.
