LINCOLN, Neb. (AP) — A Nebraska lawmaker is taking another shot at trying to pass a bill that would not only allow people to carry concealed handguns without a permit, it would prohibit the state's cities and counties from issuing local laws to do so within their borders.

Sen. Tom Brewer, of Gordon, defended the bill in a hearing before the Legislature's Judiciary Committee on Tuesday that drew more than 100 people both for and against it. Brewer brought with him a state attorney general's opinion that determined such a law would need to be implemented statewide.

"You can either follow the Constitution, or you can have carve-outs. But you can't do both," said Brewer, a combat veteran who was shot several times during a firefight with the Taliban in 2003. Given his harried combat experience, he said, "I understand the significance of what I'm asking for here."

Brewer has introduced the measure every year since 2017. This year, his proposal has 25 cosponsors and is again listed as his priority bill, increasing the odds that lawmakers will debate it on the Senate floor.

According to the U.S. Concealed Carry Association, permit-less concealed carry is already allowed in 25 conservative-leaning states, including Iowa, Kansas, Missouri, South Dakota and Wyoming — five of the six states that border Nebraska.

Nebraska already allows gun owners to carry firearms in public view, as long as they don't have a criminal record that bars them from possessing one and aren't in a place where guns are prohibited. To legally conceal the gun, Nebraskans are required to submit to a Nebraska State Patrol background check, get fingerprinted and take a gun safety course at their own expense.

The bill is championed by gun rights advocates who call it "constitutional carry," in reference to the Second Amendment right to keep and bear arms. Opponents argue that allowing people to carry handguns without registering with law enforcement is a threat to public safety.

More than a dozen people testified in favor of the bill, and the group included some unexpected backers, such as attorney Spike Eickholt, who represented the Nebraska Criminal Defense Association. That group, Eickholt said, finds those in the state's largest cities of Omaha and Lincoln — particularly minority populations — are disproportionately targeted by police over concealed carry laws. Others also testified that the $100 cost of a conceal carry permit that must be renewed every five years discriminates against poor residents.

Omaha Police Chief Todd Schmaderer was among those who testified against the bill, noting that the city's gang violence and its population of about 500,000 would make permit-less concealed carry a dangerous proposition in the city.

"I completely understand why they don't need it in small towns. In Omaha, we have that need," Schmaderer said. "It plays a role in how we address violent crime."

Brewer's attempt to pass a nearly identical bill last year won initial approval but stalled on the second of three required votes in the waning days of the legislative session over objections to the proposal's elimination of mandatory training to obtain a concealed-carry permit. Brewer declined to include the required training feature again this year, saying Tuesday that while he believes in the importance of gun safety training, "it should not be mandatory."

Last year, Brewer's bill fell two votes short of the 33-vote supermajority needed to overcome a filibuster. The one-chamber Legislature is officially nonpartisan, but 17 of the state's 49 lawmakers this year are registered Democrats. If all of them oppose the measure, it would leave bill supporters at least one vote short of being filibuster-proof.

Such gun bills have triggered disconcerting reactions in the State Capitol before. In 2020, some gun-rights activists protesting a measure that would have imposed new restrictions on gun ownerships showed up carrying loaded semi-automatic rifles, which they are legally allowed to carry inside the Capitol.

Omaha Sen. Machaela Cavanaugh, who described being in a hearing room with armed people as "terrifying," has introduced a bill to prohibit possession of deadly weapons in the State Capitol or on State Capitol grounds. That bill has been referred to the Judiciary Committee, but it had not been assigned a hearing as of Thursday.

Nebraska lawmaker again pushes no-permit conceal carry

The Nebraska
Department of Transportation (NDOT) is excited to announce winners of its
second “Name a Snowplow” contest! With almost 700 submissions by elementary school
students from throughout the state, the list was narrowed down to 16 winners, two from each of NDOT’s eight highway
districts.

Ankeny, NDOT Director
of Communications and Public Policy,
the creativity of students’ submissions was impressive once again, making it difficult to narrow down the list. Some of the winning names included Super
Scooper, Plowabunga, Snow Big Deal, and Snowbi-Wan Kenobi.

“We received
entries from all corners of the state, including Crawford, Sidney, Falls City,
and Pender,” Ankeny said. “Not only is it
a chance for students to get
involved, but it is also a great way to recognize our
hardworking snowplow drivers and maintenance workers who are often the unsung
heroes in keeping our roads safe during and after winter weather.”

The selected
plows will be branded with their new monikers and will be updated on NDOT’s <a href="https://plows.nebraska.gov/">plows.nebraska.gov</a> and on <a href="https://new.511.nebraska.gov/">511.nebraska.gov</a> where
the name and location of each plow will be available in real time. While NDOT
has over 600 snowplows, these 16 winners will be added to the 17 winners from the inaugural
“Name a Snowplow” contest and will be the only ones identified by name for now.

NDOT will share additional information on its social media pages, including when the names
are placed on the snowplows.

Happy Thursday. I have again found myself in Scottsbluff for appointments, so when in Rome...This week I decided to stop into one of my favorite spots for lunch.  Wonderful Kitchen is right by the Walmart store on the corner (across the road from Chilis). 

Their food and staff are beyond awesome.  This is a dine-in or carry-out. I don't know about you, but one food I want to dine in and eat, is Chinese. Their staff are all very great folks, they remember you, even when you haven't been in for awhile. 

One of the best things is their lunch menu. Nearly everything on it is only $9.95, which of course includes a soup, crabmeat rangoon, egg roll and a pot of tea. 

And there is so much, it never fails, I end up getting a box and enjoying it again for another meal, The flavor is beyond words. This is my favorite Chinese restaurant hands down. If you get that way, stop in for lunch, your tummy will be glad you did.&nbsp;

City of Alliance reminds community about licensed contractors 

As many community members are aware, there are a lot of rumors being heard about a call of service the Chadron Police Department took on Saturday, January 21, 2023. Some of the rumors we have heard and observed on different medium include allegations that there was a stabbing, abduction and sexual assault.

The Chadron Police Department can confirm a call of service was reported from a resident reporting an assault. We can also report there was no immediate threat to the community and there is not an ongoing threat to the community. 

The investigation of the assault continues and will be ongoing with several officers and an investigator working diligently to complete the investigation. When the investigation is complete, we will release any information that we can about the incident.

Many of us remember having chickenpox when we were kids. Fever, blisters, scabs, itchy, itchy, itchy. As we age, we have to worry about its sister disease, shingles. Shingles is caused by the same virus as chickenpox. Even though we recovered from chickenpox long ago, the virus continues to live in some of our nerve cells. The good news - the shingles vaccine is now covered for those on Medicare Part D, the drug supplement.

Hundreds of thousands of Americans get shingles every year. Although people do not die from shingles, it hurts. Usually, shingles develops on just one side of the body or face, and in a small area. The most common place for shingles to occur is around one side of the waistline. People with shingles have one or more of the following symptoms:

· Tingling, itching, or numbness of the skin

· Chills, fever, headache, or upset stomach

Most cases of shingles last three to five weeks. For some people, the symptoms of shingles are mild. They might just have some itching. For others, shingles can cause intense pain that can be felt from the gentlest touch or breeze. PHN (post-herpetic neuralgia, the ongoing pain) can last for months, even years. The older you are when you get shingles, the greater your chances of developing PHN.

Shingrix is a relatively new vaccine that is more than 90% effective at preventing shingles and PHN. Immunity stays strong for at least the first seven years after vaccination.

Your doctor or pharmacist can give you Shingrix as a shot in your upper arm. Adults 50 years and older should get two doses of Shingrix, separated by 2 to 6 months. Adults 19 years and older who have weakened immune systems should also get two doses of Shingrix. Even people who had the shingles vaccine Zostavax should get the new, much more effective vaccine.

If you had shingles in the past, Shingrix can help prevent you from getting it again. There is no specific length of time that you need to wait after having shingles before you can receive Shingrix, but generally you should make sure the shingles rash has gone away before getting vaccinated.

Studies show that Shingrix is safe. You are likely to have temporary side effects from getting the shots. Most people got a sore arm with mild or moderate pain, and some also had redness and swelling where they got the shot. Some people felt tired or had a headache. Symptoms went away on their own in a couple of days.

Vaccination is the most cost-effective way to prevent diseases. Most insurance companies cover vaccines, but you may have to reach a certain age to be eligible for Shingrix. Medicare prescription drug plans (Medicare Part D) cover all the recommended, commercially available vaccines needed to prevent illness. Because of the Inflation Reduction Act, starting January 1, 2023, older Americans should be able to get the Shingrix vaccine at no cost! Take advantage of the opportunity to prevent what can be a very painful disease.

Getting Ahead: Shingles 

Scottsbluff –Radio airwaves throughout Western Nebraska are set for the annual United Way Radiothon on Thursday, January 26th from 7 am to 6 pm. Rural Radio, Eagle Communications, Chadrad and KSID stations are uniting together for one day to raise funds to benefit United Way of Western Nebraska and the nonprofit partners United Way funds. Donations from the Radiothon will help United Way get closer to their $400,000 campaign goal!

Volunteers will be answering the phones at Main Street Market to accept donations for United Way. The local radio stations will be broadcasting throughout the day with United Way partner agency interviews and updates. Hourly prizes donated by generous local businesses will be announced and given away throughout the day to encourage donating to United Way of Western Nebraska. United Way Board, Staff, representatives from funded agencies and volunteers will be on site accepting phone-in pledges and walk-in donations.

Donors at the Community Partner level of $12.50 or more per month (or a one-time donation of $150 or more) will receive a commemorative Radiothon t-shirt and have the opportunity to win gift cards throughout the day. Donations are welcome via credit card, debit card, cash or check with options for a one-time donation or recurring monthly donations. The dollars raised support United Way community impact work and help fund local programs and organizations who help families in need in our communities.

Throughout the day many of the 27 programs that are currently funded by United Way of Western Nebraska will be on air talking about their programs, the services they provide and the importance of the United Way funding they receive to help carry out their work. Radiothon donations will be distributed to the area where those donors live to ensure their donor dollars stay in their communities.

United Way 'Radiothon' set for Jan. 26

CHADRON – Travels with Mari is an exhibit in the Mari Sandoz High Plains Heritage Center from Jan. 9 through May 12. It features photographs from Sandoz’s trips across the U.S. from the 1940s to 1960s. In addition to photos, exhibit artifacts include suitcases, a hat box, purses, perfume bottles, and clothing. One display case is filled with accessories such as bracelets, earrings, necklaces, and scarves, according to Courtney Kouba, assistant archivist.

“There's a lot of unusual items in this exhibit that otherwise would just be in the archive. Mari used her accessories to brighten up her look because her favorite color was brown and most of her clothes were neutral colors,” Kouba said. “When you look at her clothing and accessories from New York, Mari shopped at Saks Fifth Avenue. You see that label over and over. She had a credit card from there. I'm sure she went to other upscale places, too. She really liked fashion.”

For the travel-themed exhibit labels, Kouba formatted excerpts from Sandoz’s letters into postcards.

One display case is focused on Sandoz’s research, including a photograph of her with a park ranger during a trip to what is now the Little Bighorn Battlefield National Monument.

“I love that she's wearing pants because otherwise most of the photos show her in dresses and skirts,” Kouba said.

Another photo shows Sandoz and her friend, Eleanor Hinman, posing during their 3,000-mile road trip to conduct Native American research for the book Crazy Horse.

Kouba said one photo shows a bit more of Sandoz’s relaxed side when she was on the KUON radio station in Lincoln.

“Mari did a series on history and the plains writing. In one photo, she's teaching the rabbit dance while talking about the Sioux,” Kouba said.

LINCOLN, Neb.-A string of drawings without a jackpot winner has grown the estimated Powerball® jackpot to its highest level since October 2022. Because of the high jackpot, the Nebraska Lottery reminds customers to play responsibly.

The Powerball jackpot starts at $20 million and continues to grow each drawing until it is won. There have been 28 consecutive Powerball drawings since November 21, 2022, without a jackpot winner. This run has grown the estimated jackpot for the Wednesday, January 25 drawing to $526 million or $284 million with the cash option selected.

This jackpot run has produced three big Powerball winners in Nebraska.

The largest Powerball jackpot on record occurred in November 2022 when one winner in California won a $2.04 billion jackpot.

Ten jackpots ranging from $2.5 million to $365 million have been won in Nebraska since the Nebraska Lottery began offering Powerball in July of 1994. The largest Powerball jackpot won in Nebraska occurred in February 2006 when a group of eight coworkers at the ConAgra Foods ham and corned beef plant in Lincoln split a $365 million jackpot.

Powerball jackpot grows to $526 million

OMAHA, Neb. (AP) — Union Pacific's fourth-quarter profit slipped 4% as severe winter weather snarled shipments in late December and the railroad continued to struggle to improve its operations enough to handle all the cargo businesses want to ship.

The Omaha, Nebraska-based railroad said it earned $1.6 billion, or $2.67 per share, in the fourth quarter. That's down from $1.7 billion, or $2.66 per share, a year ago.

Union Pacific said its revenue grew 8% to $6.2 billion in the quarter as it increased prices, charged more fuel surcharges and delivered 1% more freight, but its expenses were up 14% at $3.8 billion.

UP Chairman and CEO Lance Fritz said the "revenue growth was more than offset by elevated operating expenses from operational inefficiencies and a higher inflationary environment."

The results did not meet Wall Street expectations. The average estimate of seven analysts surveyed by Zacks Investment Research was for earnings of $2.75 per share. UP's share price fell more than 3% to $203.35 in midday trading after the results were released.

Most key performance measures deteriorated during the quarter as the railroad continued to have a hard time hiring enough employees in key locations. The railroad's average headcount is up 4% at 31,120 as it has been hiring throughout the past year, but it still needs more crews and maintenance workers in certain locations. Executives said about 600 additional workers are currently in training.

Union Pacific said freight car velocity declined 3% to 191 daily miles per car and locomotive productivity was down 5% during the quarter.

Edward Jones analyst Jeff Windau said he anticipated the ongoing hiring challenges and pressure from fuel costs that were up 43%. The weather impact was the surprise in the results. Going forward, the staffing situation should improve as UP hires and trains more workers and fuel prices will likely ease.

Investment manager Louis Navellier, who holds UP stock in his funds, said fuel costs clearly hurt the railroad's bottom line. He said he had hoped the railroads might be able to pick up additional grain volume because the low water levels on the Mississippi River last fall limited how much barges could handle, but it looks like the railroad didn't have much capacity to take on that business.

Heading into 2023, the railroad said it still expects shipping volume to grow faster than industrial production, but the current forecast calls for industrial production to be down by half a percent this year amid recession fears.

Fritz said he expects the railroad's performance to continue improving in 2023 as it works to eliminate the delayed deliveries and other service problems that its customers complained about last year.

Even with the service problems last year, the railroad said its 2022 profit was up 7% to nearly $7 billion, or $11.21 per share, from $6.5 billion, or $9.95 per share, the year before.

SCOTTSBLUFF&nbsp; — Troopers with the Nebraska State Patrol have arrested three people in two incidents in Kimball County, including the discovery of over 300 pounds of suspected marijuana.

Sunday, at approximately 11:40 a.m. MT, troopers observed a Toyota van parked on the shoulder of Interstate 80 with apparent vehicle trouble near mile marker 8 in Kimball County. The troopers stopped to perform a motorist assist.

During the encounter the troopers discovered that the driver, identified as Micah Cameron, 38, of Highlands Ranch, Colorado, was in possession of a firearm. Troopers also learned that Cameron is prohibited from possessing a firearm. While attempting to place Cameron under arrest, Cameron threw a glass object against the ground. Troopers determined that the object was drug paraphernalia which contained suspected methamphetamine. A search of the vehicle revealed a rifle and several firearm components.

Cameron was arrested for possession of a deadly weapon by a prohibited person, possession of a controlled substance, tampering with physical evidence, possession of drug paraphernalia, and possession of a deadly weapon during the commission of a felony. He was lodged in Kimball County Jail.

Monday, at approximately 3:50 p.m. MT, troopers observed a Ford Transit speeding as it traveled northbound on 53A Spur near Dix. During the traffic stop, a trooper detected the odor of marijuana coming from inside the vehicle. A search of the vehicle revealed 261.5 pounds of suspected marijuana and 50.5 pounds of suspected THC hash. The total weight of the marijuana products was 312 pounds. Troopers also located a fake driver’s license belonging to the driver.

The driver, Noah Ropon, 19, of Beaver Falls, Pennsylvania, and passenger, Anthony George, 20, of Beaver, Pennsylvania, were arrested for possession of marijuana – over one pound and possession with intent to deliver. Ropon was also cited for criminal impersonation. Both were lodged in Kimball County Jail.

Knight Museum hosting 'Legacy of African Americans in Western Nebraska'

Don’t let the cold stop you from getting outdoors and having fun this winter. Nebraska state parks offer plenty of space to enjoy a wide range of activities — from sledding and snowboarding to ice skating and wildlife watching.

Here are a few ideas to keep you off the couch and having fun this winter.

Racing down a hill on a sled or snowboard is an exciting way to spend time outdoors. And luckily, there’s plenty of opportunity for it at Nebraska’s state parks. Ponca, Chadron and Eugene T. Mahoney state parks have dedicated sled hills; Mahoney even has snow-making capability. And Fort Robinson and Niobrara state parks and Wildcat Hills State Recreation Area have plenty of rolling hills to choose your own slopes.

Get off the beaten path and go cross-country skiing this winter. It’s a chance to explore a different side of a Nebraska state park: what they look like in all their winter beauty. It also gives a great chance for wildlife watching.

Some of the best parks for cross-country skiing in Nebraska are Ponca State Park and Lewis and Clark State Recreation Area; both offer groomed trails. Other good parks to try include Eugene T. Mahoney, Platte River and Indian Cave state parks.

LINCOLN, Neb.-Today, a coalition of organizations announces strong opposition to a legislative proposal that would substantially weaken Nebraska’s motorcycle helmet law, and therefore increase the number of deaths and traumatic injuries on the state’s highways.

LB 91 would allow motorcyclists over the age of 21 to ride without a helmet, whereas current law requires all riders to wear helmets.&nbsp;

Motorcycle helmets reduce the risk of head injury by 69 percent and lower the risk of death by 42 percent. In 2020, in states without universal helmet laws saw a 57 percent death rate among motorcyclists who were not wearing helmets, compared to 11 percent in states with universal helmet laws, according to the National Highway Traffic Safety Administration. From the Government Accountability Office, “laws requiring all motorcyclists to wear helmets are the only strategy proven to be effective in reducing motorcyclist fatalities.”&nbsp; After Michigan weakened its all-rider helmet law in 2012, the percentage of non-helmeted crash scene fatalities quadrupled, and the number of motorcyclist trauma patients hospitalized with a head injury rose 14%.

Multiple studies of states that have repealed their motorcycle helmet law show an increase in rider deaths, serious and disabling brain injuries and medical costs, which are usually borne by taxpayers and the state. Annually, motorcycle crashes cost $13 billion in economic impact and $66 billion in societal harm, as measured by comprehensive costs based on 2010 data. When adjusted only for inflation, these amounts increase to $17 billion and $86 billion, respectively. Serious injuries and fatalities accounted for 87 percent of total comprehensive costs of motorcycle crashes, compared to 57 percent of the total comprehensive costs of all motor vehicle crashes. The repeal of all-rider motorcycle helmet laws has led to increased economic costs, including insurance premiums, in many states.

According to a survey conducted by AAA, 81% of Nebraskans support maintaining the state’s current law. The current law has worked well in keeping motorcyclists safe on our roadways.&nbsp; We cannot afford to weaken it.

Highway Safety coalition urges Neb. Legislature to keep helmet law

Rylie Wright, a graduating senior at Hemingford High School, has been named one of more than 5,000 candidates in the 2023 U.S. Presidential Scholars Program. The candidates were selected from nearly 3.6 million students expected to graduate from U.S. high schools in the year 2023.

Inclusion in the U.S. Presidential Scholars Program is one of the highest honors bestowed upon graduating high school seniors. Scholars are selected on the basis of superior academic and artistic achievements, leadership qualities, strong character and involvement in community and school activities.

The U.S. Presidential Scholars Program was established in 1964 by Executive Order of the President to recognize some of our nation’s most distinguished graduating seniors for their accomplishments in many areas: academic success, leadership, and service to school and community. It was expanded in 1979 to recognize students demonstrating exceptional scholarship and talent in the visual, creative, and performing arts. In 2015, the program was expanded once again to recognize students who demonstrate ability and accomplishment in career and technical fields. Annually, up to 161 U.S. Presidential Scholars are chosen from among that year’s senior class, representing excellence in education and the promise of greatness in America’s youth.

A distinguished panel of educators will review these submissions and select approximately 600 semifinalists in early April. The Commission on Presidential Scholars, a group of up to 32 eminent&nbsp; citizens appointed by the President, will select the finalists, and the U.S. Department of Education will announce the Scholars in May.

U.S. Presidential Scholars are honored for their accomplishments during the National Recognition Program each June. To commemorate their achievement, the Scholars are awarded the Presidential Scholars Medallion.

Hemingford student named candidate in U.S. Presidential Scholars Program 

Honor Beauvais’ every breath was a battle as a snowstorm battered the Rosebud Sioux Reservation in South Dakota.

The asthmatic 12-year-old's worried aunt and uncle begged for help clearing a path to their cattle ranch near the community of Two Strike as his condition worsened, his fragile lungs fighting a massive infection. But when an ambulance finally managed to get through, Honor's uncle already was performing CPR, said his grandmother, Rose Cordier-Beauvais.

Honor, whose Lakota name is Yuonihan Ihanble, was pronounced dead last month at the Indian Health Service’s hospital on the reservation, one of six deaths that tribal leaders say "could have been prevented" if not for a series of systemic failures. Targets of the frustration include Republican Gov. Kristi Noem, the U.S. Congress, the Indian Health Service and even — for some — the tribe itself.

“We were all just in shock,” said Cordier-Beauvais, who recalled that when the snow finally cleared enough to hold the funeral, the family gave out toys to other children as a symbol of how he played with his siblings. “He loved giving them toys.”

As the storm raged, families ran out of fuel, and two people froze to death, including one in their home, the Rosebud Sioux Tribe said in a letter this month seeking a presidential disaster declaration.

The letter described the situation on the reservation in a remote area on the state's far southern border with Nebraska, 130 miles (about 209 kilometers) southeast of Rapid City, as a “catastrophe."

And in a scathing State of the Tribes address delivered last week in the state Legislature, Peter Lengkeek, chairman of the Crow Creek Sioux Tribe, accused emergency services of being “slow to react" as tribes struggled to clear the snow, with many using what he described as “outdated equipment and dilapidated resources."

Noem’s spokesman, Ian Fury, said the claims were part of a “false narrative” and “couldn’t be further from the truth.” The Indian Health Services didn't immediately return email messages from The Associated Press seeking comment.

Noem, who is seen as a potential contender for the 2024 White House, declared an emergency on Dec. 22 to respond to the winter storm and activated the state’s National Guard to haul firewood to the tribe.

But by then the Rosebud Sioux Tribe was worn out from a series of storms starting about 10 days before that were so severe that its leaders ultimately rented two helicopters to drop food to remote locations and rescue the stranded.

The firewood, said OJ Semans, a consultant for the tribe, came in the form of uncut logs, which were not immediately usable. The tribe wrote in its letter that volunteers continue to work diligently to get the wood cut.

“It was a political stunt that did nothing to help the people that were in trouble," he said.

It all started on Dec. 12, when the tribe shut down offices so people could prepare for the first onslaught. The storm hit in earnest around midnight, dumping an average of nearly 2 feet (0.61 meters) of snow on the reservation, most of it in the first day, said Alex Lamers, a National Weather Service meteorologist.

By the time the storm let up on Dec. 16, the reservation also was coated with one-quarter of an inch of ice and wind gusts as high as 55 mph had blown the snow into drifts of up to 25 feet (7.6 meters).

The tribe issued a no travel advisory, except for emergencies, threatening a&nbsp;<a href="https://www.facebook.com/permalink.php?story_fbid=pfbid02Gsj91xk2Kkby98k8wSVezW2sTDZaHeC4kjKzqLFWd1MPCamxjUE6t6GwB3ZHn64kl&amp;id=100087197562838">$500 fine</a>&nbsp;for violators. Still some traveled and got stuck, the tribe said, their abandoned vehicles creating a hazard for first responders.

Starting on Dec. 18, soon after the blizzard moved out, there were 11 straight days with sub-zero temperatures. Wind chills were dangerous, hitting -51 degrees Fahrenheit (-46.11 degrees Celsius) at their lowest. The length and severity of the cold made it one of the worst such stretches on record, Lamers said.

Then, as fierce cold and storms descended across much of the rest of the country, claiming at least&nbsp;<a href="https://apnews.com/article/weather-buffalo-natural-disasters-new-york-city-storms-6cb9f31599be5f698a927fa971fcf019">40 lives in western New York</a>, a phenomenon called a ground blizzard hit the reservation on Dec. 22. Strong winds blew existing snow on the ground, and visibility fell to a quarter mile, Lamers said.

The Bureau of Indian Affairs sent staff to help, and the White House said FEMA also spoke to the tribe's president. But snowplows were paralyzed in the cold, with the freezing temperatures turning the diesel fuel and hydraulics into gel, the tribe said.

Shawn Bordeaux, a Democratic state lawmaker and a former tribal council member, was running out of propane heat at his home on the reservation when Noem announced she was sending in the National Guard. Unable to get out and shop, he had no Christmas gifts for his children. Even for those who could get out, the store shelves were growing bare. Gas stations were running out of gas.

“I don’t want to totally dog out the system, but we kind of got left to our own devices," said Bordeaux, who is a frequent critic of the governor. “She basically left us hanging."

The tribe also alleges Congress is at fault for not changing rules that allocate how money from a tribal transportation program is distributed among the nation's 574 federally recognized tribes.

Semans said the program's reliance on making determinations based on tribal enrollment hurts the Rosebud Sioux because while its enrollment of 33,210 members is relatively modest, its land base of nearly 890,000 acres spread across five counties, is massive.

That meant there simply wasn't enough equipment to respond, said Semans, who lost two family members in the storm.

One of them, his 54-year-old cousin, Anthony DuBray, froze to death outside, his body found after Christmas.

 </figure>The asthmatic 12-year-old's worried aunt and uncle begged for help clearing a path to their cattle ranch near the community of Two Strike as his condition worsened, his fragile lungs fighting a massive infection. But when an ambulance finally managed to get through, Honor's uncle already was performing CPR, said his grandmother, Rose Cordier-Beauvais.Honor, whose Lakota name is Yuonihan Ihanble, was pronounced dead last month at the Indian Health Service’s hospital on the reservation, one of six deaths that tribal leaders say "could have been prevented" if not for a series of systemic failures. Targets of the frustration include Republican Gov. Kristi Noem, the U.S. Congress, the Indian Health Service and even — for some — the tribe itself.“We were all just in shock,” said Cordier-Beauvais, who recalled that when the snow finally cleared enough to hold the funeral, the family gave out toys to other children as a symbol of how he played with his siblings. “He loved giving them toys.”As the storm raged, families ran out of fuel, and two people froze to death, including one in their home, the Rosebud Sioux Tribe said in a letter this month seeking a presidential disaster declaration.The letter described the situation on the reservation in a remote area on the state's far southern border with Nebraska, 130 miles (about 209 kilometers) southeast of Rapid City, as a “catastrophe."And in a scathing State of the Tribes address delivered last week in the state Legislature, Peter Lengkeek, chairman of the Crow Creek Sioux Tribe, accused emergency services of being “slow to react" as tribes struggled to clear the snow, with many using what he described as “outdated equipment and dilapidated resources."Noem’s spokesman, Ian Fury, said the claims were part of a “false narrative” and “couldn’t be further from the truth.” The Indian Health Services didn't immediately return email messages from The Associated Press seeking comment.Noem, who is seen as a potential contender for the 2024 White House, declared an emergency on Dec. 22 to respond to the winter storm and activated the state’s National Guard to haul firewood to the tribe.But by then the Rosebud Sioux Tribe was worn out from a series of storms starting about 10 days before that were so severe that its leaders ultimately rented two helicopters to drop food to remote locations and rescue the stranded.The firewood, said OJ Semans, a consultant for the tribe, came in the form of uncut logs, which were not immediately usable. The tribe wrote in its letter that volunteers continue to work diligently to get the wood cut.“It was a political stunt that did nothing to help the people that were in trouble," he said.It all started on Dec. 12, when the tribe shut down offices so people could prepare for the first onslaught. The storm hit in earnest around midnight, dumping an average of nearly 2 feet (0.61 meters) of snow on the reservation, most of it in the first day, said Alex Lamers, a National Weather Service meteorologist.By the time the storm let up on Dec. 16, the reservation also was coated with one-quarter of an inch of ice and wind gusts as high as 55 mph had blown the snow into drifts of up to 25 feet (7.6 meters).The tribe issued a no travel advisory, except for emergencies, threatening a&nbsp;<a href="https://www.facebook.com/permalink.php?story_fbid=pfbid02Gsj91xk2Kkby98k8wSVezW2sTDZaHeC4kjKzqLFWd1MPCamxjUE6t6GwB3ZHn64kl&amp;id=100087197562838">$500 fine</a>&nbsp;for violators. Still some traveled and got stuck, the tribe said, their abandoned vehicles creating a hazard for first responders.Starting on Dec. 18, soon after the blizzard moved out, there were 11 straight days with sub-zero temperatures. Wind chills were dangerous, hitting -51 degrees Fahrenheit (-46.11 degrees Celsius) at their lowest. The length and severity of the cold made it one of the worst such stretches on record, Lamers said.Then, as fierce cold and storms descended across much of the rest of the country, claiming at least&nbsp;<a href="https://apnews.com/article/weather-buffalo-natural-disasters-new-york-city-storms-6cb9f31599be5f698a927fa971fcf019">40 lives in western New York</a>, a phenomenon called a ground blizzard hit the reservation on Dec. 22. Strong winds blew existing snow on the ground, and visibility fell to a quarter mile, Lamers said.The Bureau of Indian Affairs sent staff to help, and the White House said FEMA also spoke to the tribe's president. But snowplows were paralyzed in the cold, with the freezing temperatures turning the diesel fuel and hydraulics into gel, the tribe said.Shawn Bordeaux, a Democratic state lawmaker and a former tribal council member, was running out of propane heat at his home on the reservation when Noem announced she was sending in the National Guard. Unable to get out and shop, he had no Christmas gifts for his children. Even for those who could get out, the store shelves were growing bare. Gas stations were running out of gas.“I don’t want to totally dog out the system, but we kind of got left to our own devices," said Bordeaux, who is a frequent critic of the governor. “She basically left us hanging."The tribe also alleges Congress is at fault for not changing rules that allocate how money from a tribal transportation program is distributed among the nation's 574 federally recognized tribes.Semans said the program's reliance on making determinations based on tribal enrollment hurts the Rosebud Sioux because while its enrollment of 33,210 members is relatively modest, its land base of nearly 890,000 acres spread across five counties, is massive.That meant there simply wasn't enough equipment to respond, said Semans, who lost two family members in the storm.One of them, his 54-year-old cousin, Anthony DuBray, froze to death outside, his body found after Christmas.The other victim, his brother-in-law, Douglas James Dillon Sr., called for help during the first storm because his asthma was flaring up. He died Dec. 17 at the age of 59.Semans and his wife, Barbara, were snowed in for 15 days, using a propane space heater to ward off the cold after losing power. They were dug out just in time to make it to Dillon's funeral 11 days after his death.“Even angry doesn’t reach the level of the neglect," Semans said. “This was an atrocity,”For Honor, who was beloved as a jokester, his illness came at the worst possible moment of the storm.It was Dec. 14 and his aunt, Brooki Whipple, whom he spent weekdays with as she and her family lived close to his school, was growing frantic as Honor struggled to breath.The family pleaded for help, and finally a snow plow cleared the road to their ranch. Cordier-Beauvais said Honor and his uncle, Gary Whipple, set off immediately for the hospital just 3 miles (4.8 kilometers) away.There, Honor was diagnosed with influenza and sent home despite the fact that Cordier-Beauvais, whom he spent weekends and summers with, called and told hospital staff the family wanted him admitted because they were worried about getting out again.By the next day, Honor was still struggling — and the roads were impassable.“Due to the high winds,” the Rosebud Sioux Tribe Highway Safety warned that day, “the routes plows make are quickly being filled back in.”Cordier-Beauvais, the tribe’s business manager, stayed on the phone with her worried daughter, who had delivered a baby boy just days earlier, praying through the hours-long effort to get help clearing the road.But the help came too late.A doctor called to break the news to Brooki, who was home with the baby and her daughter so close in age to Honor that their family called them “the twins.”“In our Lakota way, they’re brothers and sisters. Inseparable,” Cordier-Beauvais said. “She was not handling it well. Of course, she’s a child and Brooki was so stressed out. But she had her baby, and had to tend to them. And it was just awful.”With no break in the weather, Honor wasn’t buried for nearly four weeks.At the funeral, Cordier-Beauvais recalled how her basketball-loving grandson’s closest friends were pallbearers.“They all just miss him so much,” she said.
