JEFFERSON CITY, Mo. (AP) — A coalition of 10 states has filed a lawsuit challenging a new rule by President Joe Biden's administration requiring millions of health care workers to be vaccinated against COVID-19.

 The suit filed Wednesday in a Missouri federal court follows similar ones filed by Republican-led states against Biden's vaccine requirements for federal contractors and business with more than 100 employees. 

The latest suit contends the vaccine requirement issued by the federal Centers for Medicare &amp; Medicaid is unprecedented, unreasonably broad and infringes on states' rights.

 Biden's administration has said its rules supersede state policies and are necessary.

 Joining the lawsuit were the attorneys general of Alaska, Arkansas, Iowa, Kansas, Nebraska, New Hampshire, North Dakota, South Dakota and Wyoming.

States challenge Biden's vaccine mandate for health workers

It’s that time of year when we will begin seeing those red kettles and Salvation Army bell ringers at area stores. The Salvation Army Red Kettle Campaign for Box Butte County starts December 1 and runs through December 24. It’s our chance to make the holidays brighter for someone in need.

Red kettle donations stay local – directly impacting the lives of our neighbors by helping them in their time of need. The funds you raise as a Salvation Army bell ringer make a year-round impact to our community through grocery, prescription, utility, motel, and medical gas voucher assistance, as well as emergency services and stranded motorist assistance. Funds serve residents of Box Butte County and are distributed by Northwest Community Action Partnership and the Alliance Police Department.

The Salvation Army is seeking volunteers to ring bells at three kettle locations in Alliance: Grocery Kart, Carter’s, and new this year, Bomgaars. Volunteers who will ring bells can sign up at registertoring.com, or you can call Jessica Manion at First National Bank (FNBO) at 308-763-2167 to volunteer.

Volunteers are needed. If you have extra time, or if you are a student wanting some community service hours, please sign up to be a bell ringer.

Poverty In Our Area: Salvation Army bell ringers needed

“Nebraska is home to around 127,000 veterans who bravely served our country in every corner of the globe.&nbsp; Their service to defend our freedoms should be honored and celebrated throughout the year, but especially on Veterans Day.&nbsp; We are also grateful to our veterans’ family members for their sacrifices to support their loved ones who have served.&nbsp; As we celebrate Veterans Day, I encourage Nebraskans to say thanks to the veterans in their families and communities for all they’ve done to protect our country.”

Weather permitting, the State Capitol will be illuminated in green on Thursday for Veterans Day.

LINCOLN – Hunters taking to the field for the November firearm deer season will have bagging a deer on their minds. Safety should be uppermost on their minds.

Deer hunters always should heed the following tips from the Nebraska Game and Parks Commission during the season:

• Keep the rifle’s muzzle pointed in a safe direction, with the safety on, and finger off the trigger until ready to fire.

• Properly identify the target and what lies beyond it before pulling the trigger, and never shoot at sounds or movement.

• Wear blaze orange. All deer hunters are required to wear 400 square inches of visible blaze orange on their head, chest and back during the Nov. 13-21 firearm season, whether they are using a firearm or archery equipment.

• Completely unload firearms before travelling in a vehicle, and before crossing obstacles such as barbed-wire fences, creeks or steep embankments.

• When hunting from a tree stand or elevated platform, maintain three points of contact when ascending or descending. Pull the firearm or bow up to you with a haul line and wear a fall arrest system.

Deer hunters urged to be safe during firearm season

Scottsbluff — The U.S. Department of Transportation’s National Highway Traffic Safety Administration is teaming up with Scottsbluff Police Department to make sure you make it to the table this Thanksgiving. Because the Thanksgiving holiday is one of the busiest for America, more drivers will be on the roads than usual, increasing the likelihood of a motor vehicle crash. 

During this kickoff to the holiday season, it’s more important than ever to stress the importance of seat belt safety with this essential reminder: Buckle Up. Every Trip. Every Time.

During the Thanksgiving holiday weekend in 2019 (6 p.m. on Wednesday, November 27, to 5:59 a.m. on Monday, December 2), there were 279 passenger vehicle occupants killed in traffic crashes across the nation. More than half (54%) were unrestrained. Nighttime proved even more deadly, with 52% of Thanksgiving weekend crashes occurring at night. These deaths represent needless tragedies for families across America and may have been prevented with the simple click of a seat belt.

“Thanksgiving is a time for celebrating gratitude with loved ones, and we want to make sure our community members arrive at their Thanksgiving destinations as safely as possible,” said Sgt Philip Eckerberg . “Whether you’re driving 10 minutes to the Thanksgiving dinner table, or 10 hours, it’s critical that drivers and passengers Buckle Up. Every Trip. Every Time. We want everyone to have a safe and happy Thanksgiving, so please, make sure everyone in your vehicle is buckled before you ever turn on the car — and that includes children being in the correct car seats, too,” he said.

Sgt Eckerberg said, “the Scottsbluff Police Department has received a grant from the Nebraska Office of Highway Safety to have officers on overtime looking for traffic violations and specifically seat belt and child safety seat violations. The grant is good for the week of the Thanksgiving holiday November 24 to November 28.”

Scottsbluff police receive Thanksgiving seat belt enforcement grant

Nebraskans often talk about how we feed the world.&nbsp; It’s true now more than ever.&nbsp; The crops and livestock we grow and the goods we make reach far-flung places across the globe.&nbsp; Diners in Japan, drivers in Germany, and farmers in Africa all benefit from the products we make and grow.&nbsp; Our international relationships are having a big impact.&nbsp; Over the past decade, Nebraska exports have totaled almost $10 billion per year. &nbsp;Continuing to grow international trade will create more great-paying jobs to keep our kids and grandkids in Nebraska and attract more people here to our state.

To do this, we brought together all the major stakeholders involved in trade in Nebraska.&nbsp; In July 2017, I convened a Council for International Relations in Nebraska. &nbsp;It aligns the work of leaders in agriculture, business, education, and state agencies to more effectively promote our state.&nbsp; One of the Council’s first initiatives was to advocate for a renegotiated North American trade agreement.&nbsp; By signing USMCA, the Trump Administration delivered on our Council’s goals of reducing tariff barriers and modernizing the trade deal to reflect technological advances.&nbsp; USMCA took effect on July 1, 2020.&nbsp; In 2021, USMCA has helped put the United States on track to break the previous record for annual ag exports to both Canada and Mexico.&nbsp;

The Trump Administration also worked to open China to U.S. beef, reduce tariffs on exports to Japan, and reopen the Vietnamese market to dried distillers grains.&nbsp; These trade deals have greatly benefited Nebraska.&nbsp; For example, China has purchased over $135 million of Nebraska beef so far in 2021 (through September) after buying virtually no beef from our state from 2004-2016.&nbsp; Japan, which is the top international destination for Nebraska agricultural exports, is purchasing near-record amounts of U.S. ag products this year now that lower tariffs are in place.&nbsp; Vietnam, which halted imports of U.S. dried distillers grains in December 2016, has already purchased more than a quarter-billion dollars of them in 2021. &nbsp;

There are still big opportunities for trade deals out there.&nbsp; The Trump Administration was nearing completion of a trade agreement with the United Kingdom in 2020, but negotiations have stalled under the Biden Administration.&nbsp; When I met with UK diplomats in August, they informed me that formal talks hadn’t occurred since President Biden took office.&nbsp; It’s time for President Biden to step up, jump start these talks, and demonstrate a commitment to expanding markets for our farmers and ranchers.&nbsp;

<a>We’ve been doing this work in my administration.&nbsp; Over the years, I’ve led a number of trade missions to help grow Nebraska’s international commerce.&nbsp; I’ve been to Japan three times, Mexico twice, Germany twice, China twice, Hong Kong, Macau, Vietnam, Belgium, Italy, Denmark, and Canada.&nbsp;</a>

As part of our state’s Council for International Relations, the Department of Economic Development (DED) researches markets and industries where Nebraska has high potential for growth.&nbsp; This allows us to be strategic about where to pursue international investments.&nbsp; For example, DED identified Advanced Manufacturing as a high-growth industry, and Germany as a top investor in this segment of the economy. &nbsp;

Last week, I led a small team to Germany to thank companies for choosing to invest in Nebraska.&nbsp; We also promoted our state as a place for even more German firms to do business.&nbsp; While in Germany, our team visited CLAAS, which manufacturers combines, tractors, and harvesters.&nbsp; Its North American operations are based in Omaha, and the Nebraska Chamber of Commerce named CLAAS as our state’s Large Manufacturer of the Year in 2020.&nbsp; CLAAS recently opened a 20,000 square foot training academy in west Omaha.&nbsp; The company’s innovative German apprenticeship program is providing graduates of Nebraska’s high schools with great opportunities to earn income while studying for industry certifications and an associate degree in their field of work.

Trade missions give us the opportunity to promote the innovative products manufactured in our state.&nbsp; For example, our 2019 trade mission helped Lindsay Corporation land a deal to deploy its Road Zipper systems on Germany’s motorways.&nbsp; The Road Zipper is being used outside of Munich to allow the city to rapidly reconfigure traffic lanes to ease congestion.&nbsp;

Through the years, the relationships established on these trade missions have opened doors for our ag producers to sell their premium grains and meats.&nbsp; For instance, Smithfield in Crete signed a major contract to supply a Japanese restaurant chain (Sagami) with pork during our 2017 travels to Tokyo.&nbsp; Just before the pandemic, a Vietnamese trade delegation came to Lincoln as a follow up to our 2019 trade mission to Hanoi.&nbsp; During the visit, they committed to buy $3 billion of beef, corn, distillers grains, soybeans, and wheat from Nebraska.

Aided by the trade relationships we’ve built, we’re seeing strong momentum in ag exports.&nbsp; Nebraska’s beef exports so far in 2021 are higher than they’ve ever been at this point in the year.&nbsp; U.S. corn exports are having a historically strong year. &nbsp;Corn exports over the first nine months of 2021 are greater than they were in all of 2019 and 2020 combined! &nbsp;U.S. soybean and wheat exports are also up compared to last year.

That was up from 4,177 cases during the previous week. Before that, cases had been flat or slightly falling for several weeks. 

An average of 400 Nebraskans were hospitalized with COVID-19 during the past week, which was up from 386 the previous week.

Chadron American Legion to hold Veterans Day luncheon 

TORRINGTON, Wyo. (AP) — An inmate who died Wednesday is the fourth death in as many weeks at the Wyoming Medium Correctional Institution in Torrington.

4th inmate dies in Torrington prison

CHADRON – The Chadron State College Theatre department will present The Whale by&nbsp;Samuel Hunter in the Black Box Nov. 18-20 at 7 p.m., Nov. 21 at 2 p.m., and Dec. 3-4 at 7 p.m. Seating is free and tickets can be reserved&nbsp;<a href="https://www.csc.edu/theatre/index.csc" target="_blank">online</a>.

According to Director Michael Susko, the play is&nbsp;powerful and emotionally difficult.

The play’s setting is rural Idaho. A 600-pound recluse, Charlie, hides away in his apartment and slowly eats himself to death. Desperate to reconnect with his long-estranged daughter, Ellie, he reaches out to her, only to find a viciously sharp-tongued and unhappy teen, according to Susko.

Susko said the play requires a big commitment&nbsp;from the entire cast and crew.

“These incredible actors have come to every rehearsal ready and willing to bare their souls in order take a journey that is not always easy or pleasant,” Susko said.

Zachary Wellnitz, who plays Charlie, said he finds the role physically challenging, as well as&nbsp;exciting.

“Just trying to master the way he breathes and the way he moves has been fun, but is also difficult, as well. Charlie is a very caring person who just wants to do one thing right,” Wellnitz said.

Olivia Freeze, who portrays&nbsp;Liz, Charlie’s controlling and overprotective nurse and friend, said she believes the audience will enjoy the realism of the characters.

“All these characters feel like they could be real people. Some characters remind me of people I’ve met in my life,” Freeze said.

Trista Topil said she sometimes finds it difficult to get into the mindset and personality of Ellie, who is a ball of anger and energy.

Brennan Ackerman portrays 19-year-old Elder Thomas.

“I am really looking forward to being the sweet, awkward Mormon that we slowly find more and more about. The characters are all so fascinating. They are oozing with flaws, but yet are so likable,” Ackerman said.

CSC production highlights mending family relationships

WIND CAVE NATIONAL PARK, S.D. – Firefighters from around the region helped Wind Cave National Park staff conduct the 308-acre Headquarters East prescribed fire on Saturday, November 6. 

This burn unit consisted of&nbsp;&nbsp;the area between Highway 385 and the visitor center’s north and south access roads. Due to time constraints, the second burn unit known as Headquarters South,&nbsp;&nbsp;was postponed until weather and resource availability allow.&nbsp;

Fire fighters from the State of South Dakota, U.S. Forest Service, and other National Park Service units assisted with the prescribed burn. All closures in effect during the burn have been lifted.&nbsp;&nbsp;&nbsp;

“We would like to thank our partners who helped make this prescribed fire a success,”&nbsp;said Park Superintendent Leigh Welling. “It is critical to be able to accomplish projects like this when conditions allow. This fire is going to benefit the park for years.”&nbsp;

Fire effects monitors will study the area burned to determine if the fire met resource management objectives. These objectives included reducing fuel loading in ponderosa pine forest, decreasing encroachment of young ponderosa pine onto the prairie, and improving the flow of water into the cave.&nbsp;

This fire represents a continuation of the park's prescribed fire program which began in 1972. Segments of the park are burned, under favorable conditions, to simulate natural fires. Prescribed fires maintain the balance between forest and prairie, remove the build-up of dead fuels which reduces the chance of a catastrophic wildfire, and rejuvenate the native prairie grasses.&nbsp;&nbsp;&nbsp;

BNSF railroad filed a lawsuit Sunday against its major unions over its mandate. 

It joins Norfolk Southern and Union Pacific, which both filed similar lawsuits against the unions last month. 

The unions, which have filed some of their own lawsuits in response, argue that the railroads should have negotiated with them before imposing their mandates.

LINCOLN –&nbsp;Today, Governor Pete Ricketts and Nebraska Department of Health and Human Services (DHHS) CEO Dannette R. Smith unveiled the DHHS 2021-2022 business plan.&nbsp; The plan consists of 17 priority initiatives that will guide DHHS in its mission to Help People Live Better Lives.&nbsp;

During their remarks, the Governor and CEO Smith highlighted the accomplishments of DHHS to help Nebraskans stay healthy during the pandemic.&nbsp; DHHS assisted with the Test Nebraska initiative, which delivered over 785,000 test results and allowed Nebraska to double its COVID testing during the critical early months of the pandemic.&nbsp; The agency trained 1,000 State teammates to support local health departments in their contact tracing work.&nbsp; DHHS also helped rapidly administer the coronavirus vaccine, which has been especially important to protect older Nebraskans.&nbsp; Over 89% of Nebraskans age 65 or older have now been fully vaccinated.

Additionally, the Governor complimented DHHS for&nbsp;finding innovative ways to carry out its day-to-day business during the pandemic.&nbsp; In particular, he highlighted the agency’s successful work to prevent substance abuse, promote behavioral health, and help food stamp recipients find new or better employment. &nbsp;He also credited DHHS for making continuous improvements, such as the timely processing of Medicaid health service claims.

Gov. Ricketts & Health and Human Services highlight new business plan

SCOTTSBLUFF -&nbsp;Dr. M. Thomas Perkins, a member of the Western Community College Area Board of Governors, Senator John Stinner, and Dr. Robert Byrd among others were honored at the annual Nebraska Community College Association (NCCA) Awards Ceremony, October 3, on Western Nebraska Community College's Scottsbluff Campus.

Perkins was honored with the Special Recognition Award, Stinner the NCCA Friend of Community Colleges Award, and Byrd the WNCC Distinguished Alumnus Award.

Perkins, who serves as the Member At-Large on the WCCA Board of Governors, earned the Special Recognition Award in recognition and appreciation of his exemplary contributions and commitment to supporting the mission of Nebraska's community colleges. Perkins has been heavily involved at both the state and national level, with the Association of Community College Trustees, in advocating for community colleges.

“Tom has been tremendous supporter of NCCA and ACCT for a long period of time," Steve Anderson, vice president of the NCCA Board of Governors said. "This award has never been given at the community college level. We felt he was deserving based on commitment over extended period of time. It’s an award that we may not give again. He’s a real advocate, especially to rural community colleges."

Sen. Stinner, was nominated for the Friend of Community Colleges Award by WNCC Interim President John Marrin. Marrin cited Stinner's dedication to education, his work on the Appropriations Committee to reduce biennium budget cuts for higher education, and his advocation for additional funding for dual-credit programs at community colleges.

"Senator Stinner knows and values the importance and impact of Nebraska community colleges and the communities we serve from both a workforce and economic standpoint," Marrin said. "He is more than deserving of this distinction."

Dr. Byrd attended WNCC from 1967-1969, then named Scottsbluff Junior College, before attending the University of Wyoming where he earned a degree in Zoology and Cell Biology, and eventually was accepted into Meharry Medical College where he earned a doctorate in dental surgery. Byrd practiced dentistry for 35 years while also being a commissioned officer in the United States Air Force Reserves and Army National Guard. He retired from the military with 25 years of honorable service and a rank of Colonel. Currently, Byrd works with the VA healthcare system, specifically regarding long term care, suicide, and violence prevention. He is also the chair for the Wyoming Advisory Committee to the U.S. Civil Rights Commission.

Distinguished alumni were honored from each Nebraska Community College. Chandra Anderson, of Central Community College; Danelle Franzen, of Mid-Plains Community College; James McKenzie of Northeast Community College; and Scott Cordes of Southeast Community College were all recognized from their respective institutions.

ALLIANCE – 12 young ladies from across Nebraska will be competing in the 2022 Best of the West competition in Alliance on Saturday, Nov. 13 at 6 p.m. at the Performing Arts Center at Alliance High School.&nbsp; 

The Best of the West competition is a combination of the Miss Alliance and Miss Chadron competitions traditionally held separately.&nbsp; Titles awarded that evening will include Miss Alliance and Miss Chadron as well as Miss Alliance’s Outstanding Teen and Miss Chadron’s Outstanding Teen.&nbsp; Along with scholarships, crowns and prizes, the winners will advance to the state competition in North Platte in June 2022, competing for the titles of Miss Nebraska and Miss Nebraska’s Outstanding Teen.&nbsp;

The five candidates vying for the Outstanding Teen titles are:&nbsp; Olivia Terwey, the 16 year old daughter of Trevor and Abby Terwey of Hastings; Rylie Wright, the 16 year old daughter of Mick Wright and Bridget Raben of Hemingford; Madisen Meek, the 15 year old daughter of David Meek and Jennifer and Brett Cullan of Hemingford; Tarren Cloyd, the 18 year old daughter of Dawn Cloyd of Hastings; and Alexandra Thompson, the 13 year old daughter of Ryan Thompson and Audri Pelton-Johnson of North Platte.&nbsp;

The seven candidates competing for the Miss titles are:&nbsp; Rose Seeman, a senior at the University of Nebraska at Lincoln and the daughter of Brad And Karrie Seeman of Lincoln; Lexi Nolda, a senior at North Platte High school and the daughter of Gianna Nolda of North Platte; Adrianna Casias, a sophomore at Western Nebraska Community College and the daughter of Rosaria Corona and Martin Corona; Sydny Ridgeway, a senior at Nebraska Wesleyan University and the daughter of Jon and Gale Ridgeway of Gering; Katie Hoatson, a second year law student at the University of Nebraska College of Law and the daughter of Dave and Traci Hoatson of Hershey; Avery Schlote, a freshman at Capital School of Cosmetology and the daughter of Aaron and Amber Schlote of Omaha; Katelyn Bowers, a senior at North Platte High School and the daughter of Melissa and Darreld Bowers of North Platte.&nbsp;

Co-emcees of the evening will be Morgan Holen, Miss Nebraska 2021 and her mother, Jodi Miller Holen, Miss Nebraska 1988.&nbsp; Morgan was crowned Miss Nebraska in June, 2021 in North Platte and will represent Nebraska at the 100th&nbsp;Anniversary Miss America Competition to be held in December, 2021.&nbsp; The Best of the West Competition will also feature 18 young ladies from the area participating in the Little Sister program during the competition!&nbsp; The little sisters are paired up with a candidate and will perform on stage and escort their candidate during evening wear.

The audience will have an opportunity to vote for their favorite candidate by voting for the audience choice award!&nbsp; There will also be a silent auction that will take place during intermission.&nbsp;

The Miss and Outstanding Teen competitions are under the Miss Nebraska and Nebraska’s Outstanding Teen Competition, which is held under the Miss America Organization.&nbsp; It is designed to promote scholastic achievement, creative accomplishment, healthy living and community involvement for America's young women.&nbsp;

Panhandle active living advisory committees are encouraging people to be extra safe while out and about:

· Being active during daylight hours is safer but if you are unable to be outdoors then, wear light colors and reflective material on your clothing. Carry a flashlight.

· Stick to well-used, well-lit places with other people around or take a friend or family member along with you.

· Stay alert at all times so you can hear traffic or other walkers and bikers.

· Sidewalks and paths are safer choices whenever possible. Watch out for uneven sidewalks as tripping hazards.

· Cross at crosswalks or intersections and pay careful attention to traffic signals. Look across all lanes making sure both are clear. Just because one driver stops, don’t presume drivers in other lanes will stop for you.

· Don’t assume a driver sees you crossing the street. Make eye contact with drivers as they approach whenever possible.

· Wear sturdy, appropriate shoes that give you proper footing.

PPHD: Keep active this fall, winter to help ward off the blues

WIND CAVE NATIONAL PARK, S.D. – Wind Cave National Park will offer free tours on November 11, Veterans Day, to commemorate and honor the service of American veterans. &nbsp;

Tours of the Garden of Eden are at 10 a.m. and 3 p.m. This hour-long tour offers opportunities to view of a variety of formations commonly found in Wind Cave. The tour has 150 stairs and is the least strenuous tour the park offers.&nbsp;

There will be a tour of the Fairgrounds leaving at 1 p.m. This tour climbs into a higher level and sees some slightly larger rooms. It lasts an hour and a half and has 450 stairs on it. Visitors on all tours will view the boxwork formation for which the cave is famous. &nbsp;

Tickets will be free that day but will be distributed on a first come, first served basis. Tours are expected to “sell out” by late morning. Following CDC guidelines, face coverings must be worn inside the visitor center and on all cave tours, regardless of vaccination status. &nbsp;

Wind Cave’s temperature is 54 degrees. A light coat or sweater and sturdy walking shoes are recommended. All tours enter and leave the cave via elevators. &nbsp;

Sandoz Center showcases After Hours Artists

CHADRON –&nbsp;More than 75 items created by 25 exhibitors, all Chadron State College employees, are on display in the Mari Sandoz High Plains Heritage Center through Nov. 20. About 20 different media are represented in the Artists After Hours show, including acrylic and oil paintings, ink and pen drawings, cross stitch, multi-media, crochet, gingerbread, creative writing, recycled cardboard, glass, wood, and books.

Organizer of the show, Holly Counts, said it took several days to plan groupings and the appearance of each wall and display case.

“It’s so interesting to discover the creative endeavors of our co-workers and have them share a glimpse into their private lives,” Counts said.

Associate Professor in Education Dr. Ira Ortega, who has paintings in the show, said the&nbsp;display was carefully curated.

“I admired the variety of samples and was reminded of how complex we are as individuals. Many of the samples showcased were labor intensive with minute, intricate details,” Ortega said.

Ortega came away from the exhibit with a goal to talk with newly discovered artist colleagues about their hidden talents.

“I made mental notes to consult with the creators of the oil and acrylic paintings about their technique. I also admired the photography included in the exhibit, read the poems, and smiled. A common thread was that we all found solace in the creation of these pieces,” Ortega said.

Copies are available for visitors to thumb through while the originals are displayed in a glass case.“When I went over to see the display, I was very pleased that (Holly) had arranged the copies to be read while sitting in a nice, comfy chair with a reading lamp nearby. That was what these books were meant to do, to sit down and enjoy with your kids or grandkids and maybe even share a giggle or two,” Mitchell said.Brandon Davenport, development officer with the Chadron State Foundation, said he was pleased to participate in the exhibit.“Not many employers would do something like this. The quantity, quality and variety of artists included among faculty and staff is impressive. Being able to create is something that's more of a drive than it is a hobby and I'm sure anyone presenting in this exhibit could tell you the time, energy and focus that gets put into these projects is usually significant,” Davenport said.He said the exhibit was the first time he had seen his photos on display next to pieces of art.“I've never really considered myself an artist, so this exhibit feels a little extra meaningful to me.
